HEARING EXAMINER DECISION
PETITION NO. DR-PL20180002034—Petitioner, 7-Eleven, Inc., requests approval of a site
plan with deviations pursuant to LDC Section 10.02.03.F and seeks one deviation from
LDC Section 5.05.05(B)(1), to reduce the front yard setbacks along the western property
line and along the southern property line, for redevelopment of the fuel pump canopy for a
7-Eleven facility with fuel pumps on property located on the northeast corner of U.S. 41
and Pine Ridge Road, in Section 10, Township 49 South, Range 25 East, Collier County,
Florida, consisting of 0.59± acres.

STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant and the
recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section
10.02.03.F.7 of the Land Development Code has been met and the petition should be approved.
ANALYSIS:
No members of the pubic were in attendance for this item and no objections have been received.
The property was originally permitted in 1983 with standards in effect at that time. Part of the
permitted improvements included a gasoline island canopy that was destroyed during Hurricane
Irma. This site plan with deviations provides the property owner the ability to reinstall the
canopy consistent with the 1983 configuration.
DECISION:
The Hearing Examiner hereby approves Petition Number DR-PL20180002034, filed by George
Padilla of AEC Services, Inc. representing 7-Eleven, Inc., for a site plan with deviations for
redevelopment of the fuel pump canopy on the property described in Exhibit "A", allowing for
reduced setbacks along the western and southern property lines. The deviations are described in
the Site Deviation Plans attached as Exhibit "B," and are subject to the condition(s) set forth
below. This decision does not constitute approval of the site plan.

1. All other applicable state or federal permits must be obtained before commencement of
the development.
2. This site plan with deviations shall be limited to that which is depicted on the "7-Eleven
Site Deviation Plans Store No. 25386 —Revised 08-14-2019," prepared by AEC Services,
Inc. (Exhibit B)
