Ordinance of the Board of County Commissioners of Collier County, Florida amending Ordinance
Number 92-08, as amended,the Courthouse Shadows Planned Unit Development by adding 300
multi-family rental dwelling units as a permitted use in addition to the commercial development;
by adding development standards for residential only buildings; by adding deviations related to the
residential uses; by revising development commitments and by revising the master plan.The
property is located on the south side of US 41 and opposite Airport Pulling Road in Sections 11, 12
and 13,Township 50 South, Range 25 East, Collier County, Florida consisting of 20.35+/-acres; and

Dear Chairman McDaniel, K.R.G. (Kite Development)will soon seek county approval to construct 300 rental apartments
on the Courthouse Shadows Shopping Center site.They seek to increase the density from an allowable 4 units per acre
to 16 units per acre. However,they are playing games with the numbers.They claim the site has 18 acres but fail to
deduct nearly 3 acres of the submerged land of Haldeman Creek and commercial areas already developed, like Buffalo
Wild Wings,which will remain. They are attempting to jamb as many glorified Section 8 rental housing units on the
parcel as possible.The actual buildable area is approximately 15 acres and the density will be closer to 20 units per acre,
with parking for 30 automobiles on one acre.The density is unacceptably far too intense and adding several hundred
veichles to the traffic gridlock at the intersection of Airport Road and US 41 East,the third busiest intersection in Collier
County,should not be allowed.Their proposal is not the best use of the land.The site would be an ideal location for
expansion of the Collier Government Center and consolidation or remote operations with a pedestrial bridge over US 41
connecting the sites or a mixed use of commercial and residental, similiar to Bayfront,with extensive use of the 700
feet of waterfront property on Haldeman Creek, which has direct access to the gulf, might also be appropriate. I speak
for many neighbors and ask you to stop this proposal in it's tracks. Thank you, Robert E. Smith

I'm emailing the following letter on behalf of my parents, Robert and Helen Smith, regarding the Courthouse

Dear Commissioners,
We are Robert and Helen Smith and reside at 3312 Collee Ct. directly behind the Courthouse Shadows
Redevelopment Project. We and our six neighbors are not opposed to the project but ask that our homes be
adequately buffered from it.
The developer has proposed a "decorative fence" and retention of existing vegetation as a buffer fronting our
homes. This is extremely insufficient. Further, they seek to reduce the required fence setback from 10 feet to
5 feet, thereby moving their parking and waste containers that much closer to our homes.
As a buffer, we ask the Commission to require the developer to:
1 construct a 6 foot high masonary wall sited upon a 2 foot high berm along Collee Ct in front of our homes
2 remove existing overgrown vegetation and landscape as needed
3 site all waste containers at least 100 feet from our homes
4 adhere to the 10 foot setback requirement
5 shade all lights
A wall rather then a fence will buffer us from noise, lights from vehicles parking in front of our homes and
odor and vermin from waste containers.
On a personal note, I am a disabled US Marine with service connected PTSD. A wall if required would reduce
my exposure to loud and sudden noise and allow us to live out our lives in this safe peaceful and quiet
neighborhood which has been our home for 38 years.

RE: Courthouse Shadows,LLC Small-Scale Plan Amendment
Dear Commissioners:
On behalf of the Haldeman Creek MSTU Advisory Committee,we would like to express our concern
for the proposed Courthouse Shadows project. The proposed change will allow for residential units
that will have access to Haldeman Creek. The project includes two parcels. The current boundaries of
the Haldeman Creek MSTU only includes one of those parcels. As you consider this project,'we
request that the developer agrees to expanding the boundary to include the additional parcel,as shown
on the attachment.
The Committee voted unanimously at their regularly scheduled November 7, 2019 meeting to
request the Commissioners recognize that the entire proposed project is within the taxing district
and any boundary expansion necessary to confirm the taxing authority be initiated. It is the
opinion of the Committee that all projects be treated consistently with the precedent of other
multi-unit properties with frontage on Haldeman Creek(clear example being Sandpiper Bay and
Regatta Landings) and that this property is within the taxing district.
