EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$18,927.18 for payment of $1,827.18 in the code enforcement action entitled Board of County
Commissioners v. Randolph Codner and Van B. Rhone, relating to property located at 4343 22nd
Ave SE, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners accept an offer to release a code enforcement
lien with an accrued value of $18,927.18 for payment of $1,827.18, in relation to Code Enforcement
Special Magistrate Case No. CELU20130006249.
CONSIDERATIONS: When the subject property was owned by Randolph Codner and Van B. Rhone,
the Code Enforcement Special Magistrate ordered the imposition of a code lien on the property, due to a
code violation. The lien was placed on the property due to an abandoned recreational vehicle parked on
an unimproved Estates zoned property. The lien was recorded on March 21, 2014, at O.R. Book 5018,
Page 3872. The current lien amount of $18,927.18 is based on 174 days of accrued fines ($100 per day
from October 12, 2013 through April 3, 2014) totaling $17,400, plus $1,300 in abatement fees and
$227.18 in operational costs. The property was brought into compliance on April 3, 2014.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership and the new owner has diligently pursued abatement and
achieved compliance and/or when payment of the lien would impose a severe financial hardship on the
owner. Van B. Rhone took sole possession of the property via Quit Claim Deed recorded on January 24,
2018, at O.R. Book 5470, Page 2677. Mr. Rhone currently lives on a limited income with many financial
obligations due to several major health issues. Any proceeds from the sale of the property will be used to
help cover costs for ongoing treatment and medical expenses. The property is being actively maintained,
and the owner has paid $1,827.18 in settlement of fines.
The owner is requesting a waiver of $17,100 in accrued fines and the required hardship letter is attached
as required. There are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $1.827.18 in settlement of fines has been received. If ap proved by the
Board, accrued fines in the amount of $17,100 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46 KN
RECOMMENDATION: To waive the remaining fines in the amount of $17,100, accept payment
amount of $1,827.18, and authorize the Chair to sign the attached release and satisfaction of lien for
recording in the Official Public Records.

amended, Section 1.04.01(A) and 2.02.03.
B. Respondent must abate the violation by removing thc vchiclc from the unimproved estates zoncd
property on or beforc October 11,2013, or a fine of $100.00 per day will be imposed for each
day the violation remains thereafter.
If Respondent fails to comply with this Order, the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliancc. If nccessary,
the County may request the services of the Collier County Sheril?s OIIce for the purpose
ofaccessing the property forabatement. All costs ofabatement shall be assessed against the
property.
D. Respondent is ordered to pay opcrational costs for the prosecution ofthis case in lhe amount of

The offer of settlement in the amount of 51.827.18 (5300 fines + 51,527.18 costs) has been accepted as the
recommendation for Board of Collier County Commissioners (BCC) approval.
Once the payment is received, we will continue to move forward with seeking BCC approval to reduce the fines and

Mr. Van Rhone said he is willing to pay the administrative fee of S1500.00 and offers S3O0.O0 towards the citations. He
is in a very bad situation due to his health situation and has had many medical bills. He told me if he can not work it out
he may have to look into an attorney. lt seems the state of Florida will be having more and more lawsuits as people are
losing their properties over these citations. Please advise what is the time frame on a response and what the next steps
are in this process.

and include a settlement offer for consideration. He was also advised that any costs incurred by the County are not
eligible for reductions. Attached please find Resolution 2012-46, which allows the Code Enforcement Oirector to
recommend settlement of code enforcement liens, for Board of County Commissioners approval, using specified criteria
Once the request is received, it will be reviewed and a response will be submitted (usually within two weeks).
lf the letter and offer are accepted, we must receive the payment of the settlement before we proceed with seeking
Board of County Commissioners' approval in their next available meeting agenda. ltems that are added to the Board of
County Commissioners' meetings are reviewed by 5-7 levels including the County Attorney's Office and the County
Manager's Office. Any item can be pulled from an agenda at any given time by any of the reviewers.
lf the fine is paid in full at closing, then an administrative release would be recorded. We would not recommend a
reduction of fines approval to the Board of County Commissioners that has already been paid in full, since the matter
would not meet the hardship critieria in the Resolution.
