adding development standards for residential only buildings; by adding deviations related to the
residential uses; by revising development commitments and by revising the master plan. The
property is located on the south side of US 41 and opposite Airport Pulling Road in Sections 11, 12
and 13, Township 50 South, Range 25 East, Collier County, Florida consisting of 20.35+/-acres; and

As purchasers of property in Pipers Grove 25 years ago, we chose a private, gated, quiet, safe
community, and were assured Orchards had their own entry/exit, negating their need for access
to Old Groves Road in the Pipers Grove Community.
We object to opening Old Groves Road to traffic from The Orchards and the public. Our
community should continue to be a private gated community, as it was from its inception.
Please uphold and adopt the official interpretation that was rendered by your professional staff, and deny the

We are contacting you as a neighborhood group out of respect for your busy schedule and time
constraints. All names attached are here and they are original owners from 1996 when North Groves
was complete.
The commissioners back then re-zoned these plats from agricultural farming to residential. We were all
drawn to this community due to its wonderful location and most importantly that it was GATED. We all
unanimously OPPOSE the Orchards with trying to interfere with our community and damage the value
and serenity we currently enjoy.
PLEASE deny this appeal and let us continue as a GATED community. If you open this community up the
damage to us and Collier County would be horrendous. Do the right thing. DENY DENY DENY.

I have been an owner and full-time resident since 1998 in The Groves Residents Association and I am writing in support
of the planning and zoning staffs determination that our private gated roads in the Groves remain private.
PLEASE UPHOLD AND ADOPT THE OFFICIAL INTERPRETATION BY YOUR PROFESSIONAL STAFF AND DENY THE APPEAL
filed by The Orchards.
In 1998, I purchased my unit in Piper's Grove (the residential section of The Groves Residents Association) in no small
measure based upon the fact that it was a gated community. In fact, it has been a continuously gated community since
its inception in 1992 or 1993 or for 27 years.
Moreover, even to the most untrained observer, it is obvious that Old Groves Road was designed for local traffic only
and not for through traffic.
The allowing of access to Old Groves Road by The Orchards would create a very substantial safety issue in our 10 mile
per hour community. Secondarily, it would be disastrous for our property values.
If our private gated roads were to be opened up,then I would see no reason why it would not apply to the rest of the
Vineyards PUD and other PUDs with private roads within the county. If this were to happen, I think I would be a master
of understatement to state that the damage to Collier County would be substantial.
Lastly, as stated in the executive summary,this is a PRIVATE MATTER BETWEEN TWO PARTIES. It is respectfully
submitted that any determination should be done by the Courts as this is a legal dispute and not a zoning dispute. It
seems to me this is just an end-run by The Orchards to avoid the legal system and to avoid the costs involved therewith
and should not be allowed.

We purchased our condo in Piper's Grove in 2004 for the location, safety and serenity of a gated community. Please do
not let 668 more cars (assuming two vehicles per residence in the Orchards) pass through our community.
I understand that the Orchards was given the opportunity to install their own back gate when Livingston Rd. was
improved and they chose not to spend the money. Our community should not have to suffer for their poor choice.

access through Piper's Grove.

My husband and I moved to Naples last year, and after visiting many communities we bought in Pipers Grove primarily
because the sense of security, gated entry, and location. Why else would the community have a gate house if it wasn't a
private community. Private community assured us of home value and security.
Much of our condominium fees go toward the security of the community.
Please do not open the community to local traffic.
If we knew this was an issue we would not have bought in Pipers Grove.

We purchased our condominium after researching a number of gated communities and Piper's Grove
met the gated criteria along with other desired amenities.To remove the gates would change Piper's
Grove from a gated community to an open residential development contrary to the original
community development plans and remove a value added amenity which we desired and purchased.
These are two of several factors which I assume were reviewed and found to be valid by your staff in
reaching the decision to deny the zone change filed by the Orchards.
As owners we support the staff's decision and oppose any determination by the County that would
allow residents from the Orchards or the general public to use our private gated roads.To reiterate,
we purchased in Piper's Grove having done our research into the amenities which Piper's Grove did
and did not offer. If the residents of the Orchard's failed to do the same the consequence is theirs'to
bear and should not be placed upon the residents of Piper's Grove.
If such a consequence should occur and our private gated roads are going to be opened up,then the
same should apply for the rest of the Vineyards PUD,and for the rest of the residential PUDs with

Old Groves Road (as well as Oleander Gate Drive and Orchid Bay Drive and others) are roads thru Pipers Grove that are
exclusively used by residents and the maintenance paid for thru assessments to the residents of Piper's Grove for over
twenty-five years.
As such, Collier County does not need to maintain the roadway surfaces, the cost of catch basin maintenance and
roadway lighting.
We feel If the county allows the Orchard community (and potentially others) to utilize these roads it places an unfair
financial burden on Piper's residents as well as greatly increasing the volume of traffic for the residents of Piper's Grove.
Orchard community drivers want to use Piper's Grove roads as a shortcut to and from their community to Airport Pulling
Road. They are less likely to observe the 20 miles per hour speed limit as are the residents who live here and desire a
safe community for their children and walkers.
If the Orchard community desires or needs additional access to and from their community, they have a deeded right to
connect to Livingston Road, a road parallel to Airport Pulling Road.

planning and zoning staff's determination in the above matter that our private gated roads in the Groves
remain private. Please uphold and adopt the official interpretation that was rendered by your
professional staff, and deny the appeal filed by the Orchards. We purchased our condominium in a
private gated community, and we oppose any determination by the County that would allow residents
from the Orchards or the general public to use our private gated roads.
I strongly don't support this action because I want to live in a gated community It makes me feel safe
and when u take that right away this opens it up to everyone and then I won't feel safe also we'll have
more then twice the vehicles driving through here so what happens to our roads and our gates plus all
the people walking and riding there bikes through and using our facilities STRONGLY DISAGREE. Please
help to keep our community safe

subsequent pending appeal for the Orchard's use of private gated roads in the Groves.
I support the planning and zoning staff's determination in the above matter. It is my understanding that the Orchard's
request is for safety related reasons, however, I believe it's solely for convenience purposes. My belief is dictated by the
fact that the majority of gated communities, malls, churches, etc. that require a left turn and cross a many lane road
without a traffic sign are unsafe. Is the county prepared to look at all these that are in the same situation before
making a final decision? Your consideration in this matter is greatly appreciated.

My wife and I are currently owners and residents in The Groves Residents Association, Inc., and have been so since 2010.
We are writing you to express our support of the planning and zoning staff's determination in the above matter that our
private gated roads in the Groves remain private.
One reason we chose this private gated community was because of the layout of the development, part of which is the
street pattern and the fact that we felt safe driving, biking, and walking throughout it. We oppose any determination by
the County that would allow residents from the Orchards, or the general public, to use our private gated roads. Such an
alteration would obviously greatly increase traffic flow density.This in turn would create a hazardous situation and
overload the original design of the roadway network. Please uphold and adopt the official interpretation that was
originally rendered by your professional staff, and deny the appeal filed by the Orchards.To allow their appeal would set
a precedent that could be used to open up other private roads throughout the County for general use.

I am not only a brand new homeowner in Pipers Grove since October 10th of this year, but I am a first time homeowner
in general. I have patiently waited to be able to buy in this type of community and location, and after hearing about the
Orchards development wanting to turn our gated community into a public roadway just 2 days after moving in, I am
extremely disturbed as this is only for their benefit.
I bought in a gated community so that I didn't have public traffic on my street. I have a 3 year old son, our location in the
community is directly next to entrance where the Orchards development is.
I don't understand how this issue can even be raised considering the fact that this community has been gated, and been
through the zoning and planning department and issued a permit to be gated since the day it was built.
I am asking you to uphold and adopt the official interpretation that was made by your staff, and deny the appeal filed by

I author this letter for the concern that the Orchards community wishes to be granted the appeal to have access to Old
Groves road, located within the deeded privately gated community of Pipers Grove.
I question the Orchards appeal, since the counties Planning and Zoning departments not only approved Pipers Grove
original site plan, which included Old Groves road as a private road within the gated community. Planning and Zoning
also upheld the appeal in denying the Orchards access thru our community via Old Groves road.
As an after thought, one questions why the gated Orchards with a large residential population,was developed with only
one entrance and one egress?
Florida is noted for its private gated communities . Should this appeal be granted,then the counties Planning
department should amend its related ordinances and Master Plan, since the interpretation of gated communities and
private roads within as been compromised.

I am an owner and resident in The Groves Residents Association, Inc. and I am writing in support of the planning and
zoning staff's determination in the above matter that our private gated roads in the Groves remain private. Please
uphold and adopt the official interpretation that was rendered by your professional staff, and deny the appeal filed by
the Orchards.We purchased our condominium in a private gated community, and we oppose any determination by the
County that would allow residents from the Orchards or the general public to use our private gated roads. If our private
gated roads are going to be opened up, then the same should apply for the rest of the Vineyards PUD, and for the rest of
the residential PUDs with private roads throughout the County. Please forward this message to the members of the BZA
and include it in the public record for any hearing.
