Items Requiring Action by Authority A. Final Order 2019-01 – Annual Price Index Mr. Kovensky presented a Memo, Subject: “Authority Agenda Item – February 19, 2019 – Final Order 2019-01” dated February 19, 2019 for consideration. He noted:  On January 15, 2019 the Florida Public Service Commission issued its order approving the 2019 Price Index of 2.36 percent.  County Ordinance requires the new index be adopted by May 15th of each year.  Staff has reviewed the information and recommends the Authority adopt the price index as outlined in the Order. Dr. Ritter moved to approve the Request (Final Order No. 2019-01) as presented. Second by Mr. Krawczun. Carried unanimously 3 - 0. B. Annual Election of Officers Mr. Kovensky presented the Memo Subject: “Authority Agenda Item – February 19, 2019 – Annual Election of Officers Chairman and Vice Chairman” for consideration. Mr. Lam moved to appoint Dr. Sherwin Ritter as Chairman of the Collier County Water and Wastewater Authority. Second by Mr. Krawczun. Carried unanimously 3 – 0. TO: Chairman, Collier County Water and Wastewater Authority FROM: Ashley Lang, Senior Management and Budget Analyst, Operations & Regulatory Management Division, Growth Management Department SUBJECT: Authority Agenda Item – October 21, 2019 Ave Maria Utility Company, LLLP – Notice of Tariff Updates DATE: October 14, 2019 On July 3, 2019, Ave Maria Utility Company, LLLP (“Utility”), filed an application titled “Notice of Intent to Adjust Rates Pursuant to Final Order No. 2017-01” (Attachment “A”) with the Collier County Water and Wastewater Authority (“Authority”). On July 9, 2019, in response to staff’s request for more information needed to validate the petition, the Utility submitted updated calculations and associated tariff sheets, resulting in a change to their wastewater percentage from 6.04% to 6.03% (Attachment “B”). This request is part of a phased increase to water and wastewater rates over five years for the Utility’s customers in Collier County that was previously approved by the Authority under Final Order No. 2017-01 (Attachment “C”). In the original application to the Authority, filed on March 4, 2016, and approved by Final Order 2017-01 and adopted on March 31, 2017, the Utility requested a phased annual revenue increase for five years, based on a combination of three factors: (1) a 5% annual increase; (2) a percentage increase based on the annual Florida Public Service Commission price index; and (3) 25% of the cost of preparing and going through the rate case process for the first four yearly phases. Even though the original petition to increase rates had been previously approved for the five-year period, the Utility is still required to submit an application each year to reflect the current adopted Florida Public Service Commission price index. The Authority adopted Final Order No. 2019-01 (Attachment “D”) on February 19, 2019, establishing the 2019 Price Index of 2.36%. Staff reviewed the petition which reflected the Utility’s requested increase to rates in the third year of the five-year approved period. This review included ensuring the required documents were filed, the methodology used was appropriate, the calculations were correct, and the revised tariff sheets reflected the approved rate increases. Staff is satisfied all requirements were met. The petition resulted in rate increases of 6.29% for water service and 6.03% for wastewater service. The Authority thereafter approved a phased annual revenue increase for five years, based upon a combination of three factors: (1) a 5% annual increase; (2) a percentage increase based upon federal inflation indexes; and (3) 25% of the cost of preparing and going through the rate case process for the first four yearly phases. In the 5th fixed year of the phased increase, only the first two factors would be added. The first phase of those rate and charges was effective for all service rendered on or after April 9, 2017. The second phase was effective for all service rendered on or after July 20, 2018. This serves as notice of the third phase of those rates and charges effective for all service after the date of this notice.
