I. Call to Order (Determination of Quorum) and Roll Call
Chairman Lam called the meeting to order at 2:00 P.M. Roll call was taken and a quorum
established.
II. Approval of Agenda – Meeting of September 17, 2018
Dr. Ritter moved to approve the Agenda. Second by Mr. Krawczun. Carried unanimously 3 - 0.
III. Approval of Minutes – Meeting of September 17, 2018
Dr. Ritter moved to approve the minutes of the September 17, 2018 meeting. Second by Mr.
Krawczun. Carried unanimously 3 - 0.
IV. Items Requiring Action by Authority
A. Final Order 2019-01 – Annual Price Index
Mr. Kovensky presented a Memo, Subject: “Authority Agenda Item – February 19, 2019 –
Final Order 2019-01” dated February 19, 2019 for consideration. He noted:
On January 15, 2019 the Florida Public Service Commission issued its order approving
the 2019 Price Index of 2.36 percent.
County Ordinance requires the new index be adopted by May 15th of each year.
Staff has reviewed the information and recommends the Authority adopt the price index
as outlined in the Order.
Dr. Ritter moved to approve the Request (Final Order No. 2019-01) as presented. Second by
Mr. Krawczun. Carried unanimously 3 - 0.
B. Annual Election of Officers
Mr. Kovensky presented the Memo Subject: “Authority Agenda Item – February 19, 2019 –
Annual Election of Officers Chairman and Vice Chairman” for consideration.
Mr. Lam moved to appoint Dr. Sherwin Ritter as Chairman of the Collier County Water and
Wastewater Authority. Second by Mr. Krawczun. Carried unanimously 3 – 0.
Mr. Lam moved to appoint Patricia Sherry as Vice Chairman of the Collier County Water
and Wastewater Authority. Second by Dr. Ritter. Carried unanimously 3 – 0.

Staff reported the new developer agreements related to Ave Maria Utility Company are
included in the meeting packet.

Ave Maria Utility Company, LLLP – Notice of Tariff Updates
DATE: October 14, 2019
On July 3, 2019, Ave Maria Utility Company, LLLP (“Utility”), filed an application titled “Notice
of Intent to Adjust Rates Pursuant to Final Order No. 2017-01” (Attachment “A”) with the Collier
County Water and Wastewater Authority (“Authority”). On July 9, 2019, in response to staff’s
request for more information needed to validate the petition, the Utility submitted updated
calculations and associated tariff sheets, resulting in a change to their wastewater percentage from
6.04% to 6.03% (Attachment “B”). This request is part of a phased increase to water and
wastewater rates over five years for the Utility’s customers in Collier County that was previously
approved by the Authority under Final Order No. 2017-01 (Attachment “C”).
In the original application to the Authority, filed on March 4, 2016, and approved by Final Order
2017-01 and adopted on March 31, 2017, the Utility requested a phased annual revenue increase
for five years, based on a combination of three factors: (1) a 5% annual increase; (2) a percentage
increase based on the annual Florida Public Service Commission price index; and (3) 25% of the
cost of preparing and going through the rate case process for the first four yearly phases. Even
though the original petition to increase rates had been previously approved for the five-year period,
the Utility is still required to submit an application each year to reflect the current adopted Florida
Public Service Commission price index. The Authority adopted Final Order No. 2019-01
(Attachment “D”) on February 19, 2019, establishing the 2019 Price Index of 2.36%.
Staff reviewed the petition which reflected the Utility’s requested increase to rates in the third year
of the five-year approved period. This review included ensuring the required documents were
filed, the methodology used was appropriate, the calculations were correct, and the revised tariff
sheets reflected the approved rate increases. Staff is satisfied all requirements were met. The
petition resulted in rate increases of 6.29% for water service and 6.03% for wastewater service.
As the original petition submitted by the Utility has already been approved by the Authority, and
the review of this petition (year 3) only requires an administrative review, the Authority is not
required to take any action on this item.

Please find below the requested additional detail. In addition, we found a formula error in the total gallons of reclaimed
water treated, this reduced the sewer index by 0.01% (from 6.04% to 6.03%). Attached are the revised schedules. I
apologize for this oversight. Please let us know if you need anything else.
Information used to create the annualized revenue schedule was based on data tracked during the 2018 billing year.
Gallon tracking was determined by using 2018 cumulative data rounded to the nearest 10 gallons. Bill tracking was
based on the total number of meters by type (Construction, General, Residential, etc.) as of 12/31/18 and multiplied
by 12 to annualize the numbers. We then used that data broken down by meter size and rate codes to determine the
annualized data. All data was gathered monthly using the closeout reports provided by the billing system which
include usage breakdowns by rate code and meter size.

Dear Valued Customer:
On March 4, 2016, Ave Maria Utility Company, LLLP (“Utility”) filed an application with
the Collier County Board of County Commissioners and the Collier County Water and Wastewater
Authority (the “CCWWA” or “Authority”) for increased water and wastewater rates for its
customers in Collier County based on a historical test year ending December 31, 2014.
The Authority thereafter approved a phased annual revenue increase for five years, based
upon a combination of three factors: (1) a 5% annual increase; (2) a percentage increase based
upon federal inflation indexes; and (3) 25% of the cost of preparing and going through the rate
case process for the first four yearly phases. In the 5th fixed year of the phased increase, only the
first two factors would be added.
The first phase of those rate and charges was effective for all service rendered on or after
April 9, 2017. The second phase was effective for all service rendered on or after July 20, 2018.
This serves as notice of the third phase of those rates and charges effective for all service after the
date of this notice. You can review a schedule of the present and new phase 3 rates at the utility
offices or on the utility website at: www.AMUC.com. The adjusted rates should be reflected on
your next 2019 bill.

A FINAL ORDER OF THE COLLIER COUNTY WATER AND WASTEWATER
AUTHORITY, PURSUANT TO COLLIER COUNTY ORDINANCE NO. 96-6, AS
AMENDED, REGARDING AVE MARIA UTILITY COMPANY, LLLP'S WATER
AND WASTEWATER RATES AND SERVICE AVAILABILITY CHARGES;
PROVIDING THE EFFECTIVE DATE.
WHEREAS, Ave Maria Utility Company, LLLP (UTILITY) is the holder of a
certificate for the provision of water and wastewater services to certain portions of
Collier County; and
WHEREAS, on March 4th, 2016, the UTILITY submitted its Application for
Increase in Rates to the Growth Management Department Operations & Regulatory
Management Division Utility Regulation Section (STAFF); and
WHEREAS, STAFF's engineering and rate consultant, Burton & Associates
(BURTON), submitted its findings and recommendations regarding UTILITY'S
application by means of a Final Report dated November 2gth,2016; and
WHEREAS, the UTILITY accepted all findings in BURTON's Final Report,
including all modifications regarding schedules, final water and sewer rates, and service
availability charges; and
WHEREAS, on March 27th,2077, the Collier County Water and Wastewater
Authority (AUTHORITY) held a duly advertised public hearing to consider the petition
submitted by the UTILITY; and
WHEREAS, on March 3}th, 2017, the AUTHORITY held a duly advertised
public hearing near the UTILITY's certificated area to receive public comment regarding
the increase in rates and service availability charges; and
WHEREAS, on March 3l't, 2017, the AUTHORITY held a duly advertised
public hearing to consider the petition and to receive evidence and testimony; and
WHEREAS, at these public hearings, the AUTHORITY has considered the
UTILITY's application for increases in rates in accordance with the factors described in
Section 1-6.L. of Ordinance96-6,as amended.
NOW, THEREFORE, IT IS HEREBY ORDERED by the Collier County Water and
Wastewater Authority, in public meeting assembled, that pursuant to Collier County
Ordinance No. 96-6, as amended:

A FINAL ORDER OF THE COLLIER COUNTY WATER AND WASTEWATER
AUTHORITY, PURSUANT TO SECTION I-6, COLLIER COUNTY ORDINANCE
NO. 96-6, AS AMENDED, PROVIDING FOR THE ADOPTION OF THE 2019
PRICE INDEX FACTOR SET ANNUALLY BY THE FLORIDA PUBLIC
SERVICE COMMISSION, FOR UTILIZATION IN PRICE INDEX RATE
APPLICATIONS FOR NONEXEMPT WATER AND/OR WASTEWATER
UTILITIES PROVIDING SERVICE IN UNINCORPORATED COLLIER
COUNTY AND THE CITY OF MARCO ISLAND, FLORIDA.
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides for the
Collier County Water and Wastewater Authority (AUTHORITY) to adopt a price index
factor for water and/or wastewater utilities on or before May 151h ofeach calendar year for
the utilization in price index rate application; and
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides that the
price index factor shall be equivalent to the price index factor set annually by the Florida
Public Service Commission (COMMISSION); and
WHEREAS, the COMMISSION issued OrderNo. PSC-2018-0612-PAA-WS on
December 27,2018, establishing the 2019 Price Index of 2.36 percent for water and./or
wastewater utilities; to be effective January I 5, 2019.
NOW, THEREFORE, IT IS HEREBY ORDERED by the Collier County Water
and Wastewater Authority, in public meeting assembled, that:
1. The 2019 Price Index is 2.36 percent.
2. Any water and/or wastewater utility that intends to increase its rates by
implementation of this price index must notify the AUTHORITY on or after
the effective date of this Final Order of such intent and shall apply the 2019
Price Index to applicable 2018 calendar year operation and maintenance
expenses.
3. Utilities using the 2019 Price Index shall use the forms attached as Appendices
"A", "8", "C" and "D", and shall follow all price index application
requirements specified in Collier County Ordinance No. 96-06, as amended,
before implementing any index.
4. This Order shall become effective upon adoption by the AUTHORITy and
shall remain in effect until the AUTHORITY authorizes a change.

NOTICE TO CUSTOMERS
On February 19th, 2019, the Cotlier County Water and Wastewater Authority
adopted provisions permitting water and sewer utilities to adjust the rates it charges to its
customers without those customers bearing the additional expense ofa public hearing. The
adjustments in rates would depend on increases or decreases in non-controllable expenses
subject to inflationary pressures such as chemicals, and other operational and maintenance
costs.
On filed notice ofintent
with the Growth Management Department (GMD) Operations & Regulatory Management
Division, to increase water and wastewater rates as a result ofthis action. Ifacknowledged
and approved by the Collier County Water and Wastewater Authority, water rates will
increase by approximately _% and wastewater rates by _%. The adjusted
rates should be reflected on your bill.

Please find the enclosed copy of the Developer Agreement Amendment 1 – Maple Ridge Phase 6B executed
between Ave Maria Utility Company, LLLP and CC Ave Maria, LLC. This agreement is subject to the general
terms of the Master Developer Agreement – Maple Ridge @ Ave Maria executed on May 22, 2014.
The current amount of capacity reserved at the water and wastewater plants (including this project) are 1.29
MGD and 1.09 MGD, respectively. The water and wastewater plants have a total permitted maximum day
operation capacity of 0.999 MGD and 0.9 MGD, respectively and the current Max Daily Flow is .588 MGD and
.502 MGD, respectively.
