THE HEARING EXAMINER. PERSONS WISHING TO HAVE WRITTEN OR GRAPHIC

plan with deviations pursuant to LDC Section 10.02.03.F and seeks 11 total deviations, including
one deviation from LDC Section 4.06.02.C.1 to remove the 10 foot wide Type A buffer along the
western property line due to existing rip-rap and docks, three deviations from LDC Section
4.06.02.C.2, to reduce the 15-foot Type B buffer and reduce the number of plantings along the

This letter is in reference to petition number VA-PL20180002576 Kristine Mary
Stewart Rattray and John Peacock, trustees of the Hurlburt trust.
Zoning setbacks are there for a reason. I do not think that there should be a
variance from this. Once variances are granted, it opens the door to many more

We purchased our condo at 7741 Pebble Creek Circle more than 15 years ago because of the PUD
restrictions and the clustered building planing which were approved prior to construction of the
buildings in the area allowing maximum use of line of sight in a restricted area. The proposed
variance will directly subtract from our seasonal 3rd floor view from our condo. On this basis we
are opposed to granting of the variance since it would change the character of the neighborhood.
