COLLIER COUNTY SPECIAL MAGISTRATE
Naples, Florida, October 4, 2019
LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted
business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative
Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the
following persons present:

I. CALL TO ORDER-SPECIAL MAGISTRATE BRENDA GARRETSON PRESIDING
The Honorable Special Magistrate Brenda C. Garretson called the Hearing to order at 9:00 A.M. All
those testifying at the proceeding did so under oath.
Prior to conducting the Hearing, Respondents were given an opportunity to speak with their
Investigating Officers for a Resolution by Stipulation. The goal is to obtain compliance without being
punitive.

store the goods.
Officer Cathey had no objection to the request.
Special Magistrate Garretson GRANTED the Motion for an Extension of Time allowing Mr.
Broitzman an additional 90 days to abate the violation. Fines are not beginning to accrue.

130-66. Parking – Unlawful Area. Parking over four parking spaces.

PROPERTY ADDRESS: Cocohatchee River Park (Boat Ramp Parking Lot), Naples, FL 34110
Park Ranger Araquistain represented the County.
Rick Talford was present and testified he has a 25 foot boat with a trailer that occupies more than
one space and he parked the vehicle in an “out of the way” location in the parking lot and returned
in 20 minutes. He paid the required fee to the County at the bait shop and provisions should be
made which allows an individual to park a trailer of that size on site.

Ranger Araquistain testified he was on routine patrol when he observed the vehicle parked
encumbering more than one space and accordingly issued the Citation. An individual with this
type trailer is allowed to park on the side of the road. The parking lot was not full at the time he
issued the Citation.
Evidence Entered: Exhibit A: 2 photos of the parked vehicle.
Mr. Talford reported he was unaware he could park on the road until after the incident and was
not notified at the time by Staff who collected his fee. Nor is there signage on site notifying the
public of this accommodation.
Special Magistrate Garretson, after hearing the testimony and reviewing the evidence
DISMISSED the Citation as it is not clear where someone with this type of vehicle/trailer should
park after paying the necessary fees to the attendant.

Special Magistrate Garretson, after hearing the testimony and reviewing the evidence UPHELD
issuance of the Citation and ordered the Respondent to pay a $30.00 fine, $50.00 in Operational
Costs and a $5.00 Administrative Fee for a total amount due of $85.00 by November 4, 2019.

County Demolition Permit(s) and required inspections and Certificate of
Completion/Occupancy to repair/replace the missing/damaged roof tile and repair/replace
broken windows, and power wash roof to remove mold by April 4, 2020 or a fine of $100.00
per day will be imposed until the violation has been abated.
3. Abate all violations by obtaining all required Collier County Building Permit(s), or Collier
County Demolition Permit(s) and required inspections and Certificate of Completion to erect
an approved pool barrier to avoid safety concerns by April 4, 2020 or a fine of $100.00 per day
will be imposed until the violation has been abated.
4. Notify Code Enforcement Investigator when the violation has been abated in order to conduct
a final inspection to confirm abatement. If the Respondent fails to abate the violation the
County may abate the violation and may use the assistance of the Collier County Sheriff’s
Office to enforce the provisions of this agreement and all costs of abatement shall be assessed
to the property owner.

$100.00 per day will be imposed until the violation has been abated thereafter.

64. Observed that at all five dumpster enclosures there was extreme amounts of
litter on the ground. Litter consisting of, but not limited to, ripped open trash bags,
food waste, hygiene products and large amounts of plastic containers and wrappers.
These conditions are creating a health, safety and welfare issue.

VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 134-62, Section 1.9, Utilities
Standard Manual. Illegal tampering of RPZ/Backflow. The back-leg of RPZ is
twisted all the way up with hose connected to it. The actual assembly is loose too.
This is a health, safety and welfare issue.

4. Submit a letter by November 14, 2019 apologizing to Collier County Utilities, signed by two
individuals associated with the violation (Bluewater and their subcontractor) acknowledging
they understood tampering with the County device was a violation and a future incident
similar in nature will result in a much greater fine amount being imposed.
Total charges in the amount of $1,555.00 are due and payable by November 4, 2019.

Anna Kovack testified the repairs were necessary as a result of Hurricane Irma damage, and there
were insurance issues including the involvement of a public adjuster on her behalf.

pool barrier in the rear yard of improved occupied residential property and
unmaintained pool with stagnant water.

Mr. Abel was present and testified:
He met with the permitting staff member, Louis Hernandez yesterday and obtained all the
necessary information for applying for the permit.
Mr. Hernandez stated the proposed gate was acceptable as long as there was no more than
2 inches from the bottom of the gate to the ground.
Based on the conversation, he decided to add a concrete pad under the gate area to
prevent the ground from settling more than 2 inches under the gate. Mr. Hernandez
stated it was acceptable, however he needed to submit new plans for the work.
Upon receiving the permit for the work it will only take a matter of hours to finish the
job.
Officer Fuentes noted the Order was issued on July 5, 2019 and:
Part C of the order for the filtration system has not been abated with the equipment
currenlty utilized.
Part D of the Order for the pool barrier is in rejection status at County permitting and the
pool is uncovered.
Part E of the Order has not been satisfied as it requires issuance of a permit and a
Certificate of Completion.

inches to a height of no more than 6 inches by October 11, 2019 or pay a fine of $50.00 a
day that the violation remains unabated thereafter.
3. Notify Code Enforcement Investigator when the violation has been abated in order to
conduct a final inspection to confirm abatement. If the Respondent fails to abate the
violation the County may abate the violation and may use the assistance of the Collier
County Sheriff’s Office to enforce the provisions of this agreement and all costs of
abatement shall be assessed to the property owner.
