EXECUTIVE SUMMARY
Recommendation to accept the staff analysis on the flow patterns and control elevations in the
Cope Lane area, which is within the Lely Area Stormwater Improvement Project boundaries.
OBJECTIVE: To provide an overview of the Stormwater Management system for the Cope Lane area
including flow patterns, control elevations and protected wetlands.
CONSIDERATIONS: Cope Lane and its neighboring streets are located off of County Barn Road and
are part of the Lely Area Stormwater Improvement Project Area (LASIP). LASIP encompasses 17
square miles of project area, including 10.5 miles of channel improvements, 17 water level and flow
control structures (weirs), 3 lakes, 1 pump station and 1 flowway. There are 110 acres of mitigation
area associated to the project. LASIP received final permits in 2005 and took 11 years to construct the
master planned system.
Integral to the project are the jurisdictional wetland areas, including flowways that provide for historical
overland flows, which occur mainly during the rainy season. The jurisdictional wetlands are state and
federally protected, and in the Cope Lane area there are multiple parcels that were purchased for
wetland mitigation and are encumbered by Conservation Easements.
On September 10, 2019, Mr. Bill Wingate, representing himself and other residents of Cope Lane,
presented under Public Petition (Item 6A) his concerns about water management in his neighborhood,
particularly standing water in the roadside swales, low-lying areas of their properties and the
performance of the weirs on County Barn Road and Santa Barbara Boulevard.
Staff from the Growth Management Division (GMD) has been working with Mr. Wingate, and other
residents in the area, since the beginning of the rainy season to ensure that the Stormwater Management
system is performing properly and in accordance with permit parameters. Staff has attended several
onsite meetings to discuss issues and walk the system and has conducted daily field visits to the area
before, during and after rainfall events. County Staff observed system water levels, canal and ditch
flow rates, existing system downstream storage and conveyance capacity, and function of the area weirs
throughout the entire rainy season.
Per system operating protocol, weir adjustments were completed twice this summer in anticipation of
the arrival of two potentially large rainfall events. Weir adjustments were completed in coordination
with the Big Cypress Basin (BCB)/South Florida Water Management District (SFWMD) for nee ded
pre-storm system draw-down. During this time period, until daily rains stopped in early September, the
roads remained clear and passable, no homes were threatened, and properties only held water in swales
and low-lying areas.
In August 2019, South Florida Water Management District Staff completed a technical review of the
system’s permits, weir operating criteria and field observations. This review concluded that the system
is functioning as designed and intended by providing area flood control, preventing flooding of
habitable structures while preventing over-drainage of the area’s jurisdictional wetlands.
The County also worked with Agnoli, Barber& Brundage, Inc. (ABB) to perform an outside review of
the Stormwater Management system in the Cope Lane area of LASIP. Several tasks were outlined by
the County for study by ABB related to the Cope Lane area, permit authorization and structure
operations, surface water levels, overland and channel flows, flood protection level of surface and
verification of the environmental review related to the wetlands in the subject area. ABB met/spoke
with residents of the area, conducted field visits and researched applicable records, permits, studies, etc.
related to LASIP and specifically the Cope Lane area. The ABB report concludes that “The LASIP
system was designed and constructed to provide enhanced flood protection meeting the requirements of
the GMP. A critical component of the design was to prevent over drainage of the land that is classified

as wetlands. The system design and construction achieved this result.”
FISCAL IMPACT: There is no fiscal impact related to this item.
GROWTH MANAGEMENT IMPACT: The construction and management of the LASIP system is
consistent with the applicable sections of the Stormwater Management and Conservation and Coastal
Management elements of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues at this time, and requires majority vote for Board action. -JAK
RECOMMENDATION: To accept the staff analysis of the flow patterns and control elevations in the
Cope Lane area, which is within the Lely Area Stormwater Improvement Project, which is also
consistent with the technical review completed by the Big Cypress Basin and Agnoli, Barber&
Brundage, Inc., confirming that the system is functioning properly by providing flood protection while
also preventing over-drainage of the area’s protected jurisdictional wetlands.

Wetlands and Water Control Structure Operations Review
Mr. Casalanguida:
The South Florida Water Management District (District) is in receipt of your request for technical
assistance regarding the above referenced area in Collier County. We have reviewed the relevant District
and U.S. Army Corps of Engineers (USACE) permits and operating criteria for each water control
structure. Relevant permit highlights, field observations, and findings for this year’s wet season are
summarized below.
South Florida Water Management District issued Environmental Resource Permit No 11-01140-S
(Application No. 980828-1) on October 13, 2004.
The U.S. Army Corps of Engineers issued permit SAJ-2002-2436 (IP-MJD) on July 25, 2005
Both the USACE and SFWMD Permits identified large portions of the area bounded by County
Barn Rd., Santa Barbara Blvd., Whitaker Rd., and Cope Ln. as jurisdictional wetlands that pre-
date the Lely Area Stormwater Improvement Project (LASIP). (Exhibit A)
Florida Statute 373.019(27) define wetlands as follows:
o “Wetlands,” means those areas that are inundated or saturated by surface water or ground
water at a frequency and a duration sufficient to support, and under normal circumstances
do support, a prevalence of vegetation typically adapted for life in saturated soils. Soils
present in wetlands generally are classified as hydric or alluvial, or possess characteristics
that are associated with reducing soil conditions…
There are over 20 water control structures and over 10 miles of associated conveyance features
constructed as part of the total LASIP project. The area of interest, Lely Canal Basin, consists of
10 operable control structures. (Exhibit B) The system is multifaceted by improving flood
control by reducing structure flooding while simultaneously preventing over-drainage of
groundwater, including within jurisdictional wetlands. All LASIP weir control structures have a
fixed elevation to mimic the pre-project elevation of the surface water and groundwater upstream
of each structure.
Most of the control structures, including the ones on Santa Barbara Blvd., Whitaker Rd, and
County Barn Rd. have operable gates to achieve the full flood control benefit during times of
emergency and high flows. As required by permit, gates are only to be opened/lowered in
coordination with SFWMD once a certain emergency water level is reached upstream of the
control structure, or in advance of a major rain event (i.e. tropical cyclone), or other emergency.

The 2019 wet season rainfall totals to-date (June 1st – August 14th) in the LASIP basin have been
just above average at 25.2 inches compared to the average rainfall of 20.4 inches. Rainfall has
been well distributed over the last 75 days, meaning no large widespread rainfall events in excess
of 4 inches per day have been recorded this wet season. (Exhibit C)
On July 31, 2019, SFWMD held a coordination call with all local water management agencies in
anticipation of a tropical wave that was forecast to bring large rain totals to the District. SFWMD
and Collier County coordinated gate operations on the primary (SFWMD) and secondary (Collier
County) drainage systems in anticipation of the event. After the event concluded and forecasted
rainfall did not occur, SFWMD returned to normal wet season operations.
Review of requested drainage systems and current conditions on August 7th yielded the following
results. (Exhibit D)
o County Barn Rd. control structure is discharging a small amount over the weir and water
levels appears stable.
o Current water levels at the Whitaker Rd control structure are approximately 1 foot below
the control elevation and the structure is not discharging. The upstream wetlands have
the capacity to store additional water.
o Current water levels at the Santa Barbara control structure are approximately 1 foot
below the control structure elevation and the structure is not discharging water.
o Cope Lane drainage ditches are holding water at approximately the control elevation of
the downstream County Barn Rd. water control structure. This is in accordance with the
permits to prevent impacts to the jurisdictional wetlands.
o The Cope Lane driving surface is approximately 1.5 feet above the control elevation of
the County Barn Rd. control structure, this allows runoff to discharge from the area into
the jurisdictional wetlands and through the County Barn Rd structure without inundating
the roadway for an extended period of time.
The review of the drainage system indicates that the system is functioning as designed and intended by
permits to prevent impacts to the jurisdictional wetlands and providing flood control to prevent flood
waters from entering habitable structures. If the County observes steady flow over control structure that
meets or exceed the permitted triggers in the District permit, please coordinate gate operations with the
District as required by permit.
