Adjourn June 9, 2006 The Workshop was called to order by Chairman Frank Halas at 3:04 p.m. June 19, 2006 The Pledge of Allegiance was recited. County Manager Jim Mudd reviewed the Agenda for second annual Post Legislative session. I. Lobbyist J. Keith Arnold was introduced to review events during this past Legislative session. Mr. Arnold in turn introduced his associate Mr. Mark Flynn. Mr. Arnold gave highlights listed below. . ECONOMIC DEVELOPMENT - Florida state economy is "red hot." Hurricanes have boosted the economy. Revenue collections, due to hurricanes, increased astoundingly. This year State of Florida started with about 71.5 billion dollar budge proposal, and ended with almost a 74 billion dollar budget. Legislature agreed to huge increases in amount of money to be utilized for economic development purposes, more than 300 million dollars. . IMMINENT DOMAIN - Legislature responded with limiting the amount of imminent domain for private purposes. Unless it is for public good, imminent domain is not to be used for private property nor given to developer for development purposes. . PROPERTY INSURANCE REFORM - Government put in 750 million dollars to stabilize Citizens Insurance. State of Florida is currently negotiating largest bond issue going on in the United States to back up all insurance companies. . BUDGET - Increases across the board for education, health, human services, and mental health. . RED TIDE RESEARCH - This is a priority; about 4 million dollars earmarked for red tide research. . GROWTH MANAGEMENT - Rep. Goodlette, Rep. Davis with Senator Saunders worked hard for proportionate fair share and concurrency. Important to mention that through efforts of particularly Rep. Goodlette, Collier County has letter from DCA which grandfathers in two-year concurrency issue. Prop share remains to be dealt with by this Commission or Board to adopt an Ordinance by December of this year. . SENATE BILL 1112 by Senator Bennett. This is a bill that requires Board to provide notice, a procedural issue, requiring specific notice in case of not granting development orders. This needs attention. Page 2 June 9, 2006 . GAS TAX INDEXING - This has been opposed in the House; Speaker has not been in favor of this bill. However, the Legislature did agree Senate Bill 1350 for Board to hold a referendum for additional rental surcharge on rental cars in the amount of $2 no more than 30 days of rental period. This could possibly generate $5 or $6 million dollars. Can be imposed only by majority vote of Board followed by a referendum. . DJJ COST SHIFT - Change in formula in cost shifts funding Department of Juvenile Justice. Legislature approved 1.5% through which Department of Financial Services could require local government spend on their judicial system. . BEACH ACCESS - Local governance to be maintained per legislature. . AFFORDABLE HOUSING - Rep. Davis worked very hard on this issue. Package of roughly $500 million dollars. Collier County will be priority to receive some of these funds. . ANNEXATION POLICY - Legislature adopted a policy after a compromise was worked out between League of Florida Cities and League of Florida Counties and this Board's knowledge. . DISCRETIONARY SALES TAX REFERENDUM - State is not giving ability to local government to increase sales tax. . TRANSPORTATION FUNDING SEAT BELT USE - If seat belt enforcement mandated across State as primary offense instead of secondary offense, estimates from State DOT for State of Florida increased funding is $33-35 million. If passed, our portion would not have major impact on Collier County transportation needs. . PARK RANGER SPECIAL MASTER - Rep. Davis introduced that Bill on our behalf. It was passed. . IMPLEMENTATION OF 311 SYSTEM - 311 Bill passed the legislature. There is a requirement in this Bill of matching 1: 1 from the State. . 211 - This Bill did not pass. . PROTECTION OF SENSITIVE DATA - This Bill did pass. . HOMESTEAD PROPERTY ASSESSMENT - Many bills, perhaps 12 in House and 12 in Senate dealing with portability. The one bill passed to expand the Homestead Exemption to seniors by another $25 thousand dollars; this joint resolution will be on the ballot this November. Concept of portability is here to stay. Page 3 June 9, 2006 At this point, Mr. Arnold concluded his report. Commissioner Halas opened the meeting for discussion. Commissioner Coyle asked about ongoing gas tax indexing denial on local level. Reps. Davis and Goodlette attempted to answer. Chairman Halas questioned the 2008 Citizens Insurance elimination of house costing greater than 1 million dollars. Mr. Arnold answered that Citizens may insure for the first million; homeowner would then need to get secondary carrier. Rep. Goodlette seconded the concept that Citizens will be capping at the $1 million dollar mark, perhaps in attempt to bring back commercial insurance compames. Chairman Halas asked about the future of portability of Homestead Exemption within the County. The representatives answered that Legislature is not ready at this time, but good probability in 2008. Commissioner Coletta asked representatives where BCC should put more effort in legislators, perhaps on Committee Members or Committee Chairpersons. The representatives said the lobbyists are the strongest avenue, but that Committee Members would be good place to focus efforts, also creating a consortium of several counties working together would carry greater weight. Commissioner Coyle observed that trying to oppose Homestead portability would be useless; perhaps BCC should support in positive way say portability within county rather than the state. What would be likelihood of success if BCC were to go in the positive direction? Discussion ensued. Perhaps task force should be created along with the City of Naples. II. GROWTH MANAGEMENT AND CONCURRENCY. This bill did not pass. Proportionate fair share issues are a work in progress. III. IMPACT FEES. Collier delegation was concerned about language, so task force established. Issues are delineated even though this bill did not pass at this time. John Norman arrived - 3:55 p.m. Discussion on impact fees ensued. Currently no state rules on impact fees. Legislature will be dealing with this issue for long time, as 67 Counties and four hundred plus cities are involved. Page 4 June 9, 2006 IV. AFFORDABLE HOUSING - Funding sheet redistributed and reviewed by Rep. Davis. Program meant to stimulate private/public partnerships to come up with innovative solutions. Hurricane hardening activity is important to retain affordable housing. County, school districts, fire districts, etc. may now build affordable housing on their properties for their employees. Rep. Davis and tax appraisers have pledged to work together to work by the same rules. Chairman Halas interjected that a good thing to come out of this Legislature is that fuel depots are mandated to dispense fuel at times of hurricanes to ease evacuation and life after hurricane. County Manager Mudd expressed that he has been approached to see if county wished to partner with private sector for affordable housing. Each time Mr. Mudd has attended meeting for such partnership, it has been discovered land is not properly zoned. County willing to proceed once the zoning issues have been cleared up. Rep. Williams sponsored many bills including preservation bills. Senator Saunders was extremely successful getting quite a few healthcare projects funded in Collier County. EEOC BILL - Collier County will need to apply for its share of funding passed. Dan Summers, Director of Emergency Services Collier County - there is a competitive grant, staff working to get grant finished by August 15,2006 deadline, to be model of emergency operation center. Along with construction, also applying for FEMA mitigation dollars. V. OUTLOOK 2007. . Indexing gas tax. . Positive approach to getting bills passed in legislature. . Impact fees. . Portability of Homestead exemption. Save our homes (intracounty rather than intercounty). . Growth management. . Change in Collier County Team and effectiveness in Tallahassee. Focus on Committee Chairperson, consortiums, and timing. BCC to establish good rapport with presiding officers of House and Senate. . Class room size. . Transportation funding. May see more toll facilities. Entry of private sector to make investment to make road funding. How to get more contractors to come in to bid on projects. VI. GENERAL COMMUNICATIONS . Mr. Mudd expressed appreciation for everyone's participation; also, the post legislative session is good to enlighten County residents. Page 5 June 9, 2006 · Chairman Halas thanked the work done in Tallahassee by Senators and Representatives. · Mr. Arnold agreed with Chairman Halas. Especially thanking Rep. Goodlette and Senator Saunders for all their work over the years, stating that they will be missed. · Rep. Goodlette thanked the BCC and its staff for its cordiality and cooperation. VII. PUBLIC COMMENT · None.
