RECITALS: WHEREAS, Developer and County entered into an Amended and Restated Developer Agreement dated May 10, 2016, recorded in Official Records Book 5274, Pages 411-423 in the Official Records of Collier County, Florida("Developer Agreement"); and WHEREAS, Developer and County entered into a First Amendment to the Developer Agreement on March 27, 2018, as recorded in Official Records Book 5491, Pages 3482-3484 in the Official Records of Collier County, Florida; and WHEREAS, the parties wish to amend Paragraphs 9 and 10 of the Developer Agreement, as amended, to extend the date of the bridge improvements at Logan Boulevard and Immokalee Road to be completed no later than May 31, 2020, and extend the completion date of the Logan North Phase 2 construction to no later than January 31, 2020; and WHEREAS, after reasoned consideration by the Board of County Commissioners, the Board finds that the terms and conditions set forth below are in conformity with contemplated improvements and additions to the County's transportation network and are consistent with both the public interest and with the County's comprehensive plan, and other regulations pertaining to development. WITNESSETH: NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and valuable consideration exchanged amongst the parties, and in consideration of the covenants contained herein,the parties agree as follows: 1. All of the above RECITALS are true and correct and are hereby expressly incorporated herein by reference as if set forth fully below. 2. Paragraph 9 of the Developer Agreement (Logan North Phase 2) is hereby amended so that construction shall be completed no later than January 31, 2020. Page 1 of 3 1 6 A 1 7 3. Paragraph 10 of the Developer Agreement (Logan/Immokalee Intersection Improvement) is hereby amended so that that construction would commence December 2, 2019 with an estimated 180 construction timeframe to May 31, 2020, or receipt of the CO for the 575th dwelling unit,whichever comes first. 4. Except as modified by this Second Amendment, the Developer Agreement, as amended, remains in full force and effect. If there is a conflict between the terms of the Second Amendment and the Developer Agreement, as amended, the terms of the Second Amendment shall prevail. 5. This Second Amendment shall be recorded by the County in the Official Records of Collier County, Florida, within fourteen (14) days after the County enters into this Second Amendment. Developer shall pay all costs of recording this Second Amendment. A copy of the recorded document will be provided to the Developer upon request.
