EXECUTIVE SUMMARY
Recommendation to approve and enter into a Revocable License Agreement with the
Golden Gate Estates Area Civic Association, Inc. (GGEACA) for the purpose of the
installation of two ground signs within County right-of-way.
OBJECTIVE: To approve and enter into a Revocable License Agreement with the Golden
Gate Estates Area Civic Association, Inc. (GGEACA) for the purpose of installation of two
ground signs within Collier County right-of-way.
CONSIDERATIONS: On April 23, 2019 (Item 16.C.1), the GGEACA and Collier County
entered into an agreement in an amount not to exceed $12,000 to provide the GGECA funding
from the GAC Land Trust for the purchase of two signs to welcome residents and visitors to
Golden Gate Estates.
The GGEACA has developed a design for the signs and is ready to move forward with the
project. They have requested that the two ground signs be installed within the Immokalee
Road right-of-way, specifically within the median of the roadway.
Since the signage identifies a region of the County and is sponsored by a not-for-profit
corporation GGEACA, the placement of the signage in the road right -of-way is an exception
to the County’s policy of not allowing private signage in the County’s road right-of-way.
A revocable license agreement has been created to allow the placement of the signs within the
County right-of-way. Upon termination of the Agreement, the signs would be removed at the
expense of GGEACA, including the restoration of the property to the condition in which it
existed. The Agreement requires approval by the Board of County Commissioners (Board)
because it is a policy decision on whether the GGEACA signage should be allowed in the
County right-of-way. The Agreement has been reviewed and approved by the County
Attorney’s office.
GGEACA will be responsible for on-going maintenance of the signs. Installation costs of
approximately $1,950 will be incurred using Collier County Road Maintenance in-house
crews.
FISCAL IMPACT: Estimated cost of the installation of the signs with all material is
approximately $1,950. County staff time is included in the annual budget and use of in-house
crews will have a net-zero fiscal impact. Funds are available for incidental material expenses
within Transportation Fund (101), Road Maintenance Cost Center (163620).
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is
approved as to form and legality, and requires majority vote for approval. The proposed
Agreement was drafted by the County Attorney and mirrors similar agreements. The County
Attorney has intentionally crafted this as a revocable license agreement, which would allow
easy removal of the signage based on (1) unintended safety issues resulting from the signage;
or (2) Board direction to remove this and similarly situated signs should a content -based legal
challenge arise concerning the County’s current ban on commercial signs in the County right-
