A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING ITS CHAIR TO
EXECUTE MEMORANDUMS OF UNDERSTANDING WITH OWNERS
OF LARGE CAPACITY SPACES, SUCH AS NOT-FOR-PROFIT
ORGANIZATIONS, COMMUNITY ASSOCIATIONS, AND PLACES OF
WORSHIP FOR DISTRIBUTION OF FOOD, RELIEF SUPPLIES,
MEDICINES OR OTHER ITEMS AND TEMPORARY SHELTERING
RELATED TO NATURAL AND MANMADE EMERGENCIES AND
DISASTERS WITHOUT FURTHER BOARD ACTION.
WHEREAS, Section 252.38, Florida Statutes, provides that "Safeguarding the life and
property of its citizens is an innate responsibility of the governing body of each political
subdivision of the state" and places the burden for evacuation and sheltering at-risk citizens
during an emergency or disaster upon the County; and
WHEREAS, not-for-profit organizations, community associations, and places of worship
have large capacity spaces that are well suited for sheltering and distribution areas for disaster
and emergency assistance; and
WHEREAS, the attached standard form Memorandum of Understanding sets forth the
roles and responsibilities for both the County and the facility providing space for sheltering and
distribution areas; and
WHEREAS, it is in the public's interest and to the public's benefit if the Board of County
Commissioners authorizes its Chair to administratively execute Memorandums of Understanding
for disaster relief as they are brought forward by Collier County staff and approved by the
County Attorney's Office for form and legality without further Board approval or action.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY,FLORIDA, that:
1. The above recitals are adopted by the Board as being true and accurate and as such, are
hereby incorporated herein as if fully set out in this Paragraph.

Collier County staff and approved by the County Attorney's Office for form and legality

Memorandum of Understanding
Between
Collier County, a Political Subdivision of the State of Florida
and
Name of Group Here
I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or"Collier County Government"), and Name of Group Here.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public-private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Name of
Group Here wishes to assist in rendering the most efficient service with a minimum
of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Name of Group Here, at a time
of major disaster and during the post-disaster recovery period should be maintained at efficient
levels and is part of the purpose of this Memorandum of Understanding. Name of Group Here
works on a voluntary basis as a member of the Voluntary Agencies Working Group, a working
group reporting to the Collier County Citizen Corps, established by Ordinance No. 02-56, as
amended, and will make a continuing effort to acquaint its members of this Memorandum of
Understanding to assist Collier County Government in carrying out mutual responsibilities for
disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Name of Group Here of the potential need to assist in activities following
a disaster; and
2. Participate in and develop training in disaster response for the members of Name
of Group Here; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Name of Group Here for
disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. NAME OF GROUP HERE will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Name of Group Here in the same
condition as it was when occupied/acquired.
V. Effective Date,Automatic Renewal,and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Name of Group Here,will cooperate to aid victims at
the time of disaster. In witness thereof, the parties have executed this Memorandum of
Understanding on the date indicated. The provisions of this Memorandum of Understanding will
be effective from the date approved by the Board of County Commissioners for a period of three

(3) years. At the end of the three-year (3) period, this Memorandum of Understanding will
automatically renew for an additional term of one year, unless terminated as provided in
Paragraph VI of this Memorandum of Understanding. Both Parties have the authority to amend
provisions of this Memorandum of Understanding upon the mutual consent and by written
instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or "Collier County Government"), and Amateur Radio Emergency
Services of Collier County.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organization, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Amateur
Radio Emergency Services of Collier County wishes to assist in rendering the most
efficient service with a minimum of duplication to the citizens and guests of Collier
County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Amateur Radio Emergency
Services of Collier County, at a time of major disaster and during the post-disaster recovery
period should be maintained at efficient levels and is part of the purpose of this Memorandum of
Understanding. Amateur Radio Emergency Services of Collier County works on a voluntary
basis as a member of the Voluntary Agencies Working Group, a working group reporting to the
Collier County Citizen Corps, established by Ordinance No. 02-56, as amended and will make a

continuing effort to acquaint its members of this Memorandum of Understanding to assist Collier
County Government in carrying out mutual responsibilities for disaster relief.
IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Amateur Radio Emergency Services of Collier County of the potential
need to assist in activities following a disaster; and
2. Participate in and develop training in disaster response for the members of
Amateur Radio Emergency Services of Collier County; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Amateur Radio Emergency
Services of Collier County for disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. AMATEUR RADIO EMERGENCY SERVICES OF COLLIER COUNTY will
make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Amateur Radio Emergency
Services of Collier County in the same condition as it was when
occupied/acquired.

V. Effective Date, Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Amateur Radio Emergency Services of Collier
County, will cooperate to aid victims at the time of disaster. In witness thereof, the parties have
executed this Memorandum of Understanding on the date indicated. The provisions of this
Memorandum of Understanding will be effective from the date approved by the Board of County
Commissioners for a period of three (3) years. At the end of the three-year (3) period, this
Memorandum of Understanding will automatically renew for an additional term of one year,
unless terminated as provided in Paragraph VI of this Memorandum of Understanding. Both
Parties have the authority to amend provisions of this Memorandum of Understanding upon the
mutual consent and by written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or

Pride Naples FL, Inc. DBA Naples Pride, a Florida nonprofit corporation
I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or "Collier County Government"), and Pride Naples FL, Inc. DBA
Naples Pride, a Florida nonprofit corporation.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public -private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Pride
Naples FL, Inc. DBA Naples Pride, a Florida nonprofit corporation wishes to
assist in rendering the most efficient service with a minimum of duplication to the
citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Pride Naples FL, Inc. DBA
Naples Pride, a Florida nonprofit corporation, at a time of major disaster and during the post -
disaster recovery period should be maintained at efficient levels and is part of the purpose of this
Memorandum of Understanding. Pride Naples FL, Inc. DBA Naples Pride, a Florida
nonprofit corporation works on a voluntary basis as a member of the Voluntary Agencies
Working Group, a working group reporting to the Collier County Citizen Corps, established by
Ordinance No. 02-56, as amended, and will make a continuing effort to acquaint its members of

this Memorandum of Understanding to assist Collier County Government in carrying out mutual
responsibilities for disaster relief.
IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Pride Naples FL, Inc. DBA Naples Pride, a Florida nonprofit
corporation of the potential need to assist in activities following a disaster; and
2. Participate in and develop training in disaster response for the members of Pride
Naples FL, Inc. DBA Naples Pride, a Florida nonprofit corporation; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Pride Naples FL, Inc. DBA
Naples Pride, a Florida nonprofit corporation for disaster relief and recovery
projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. PRIDE NAPLES FL, INC. DBA NAPLES PRIDE, A FLORIDA NONPROFIT
CORPORATION will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above -named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Pride Naples FL, Inc. DBA Naples
Pride, a Florida nonprofit corporation in the same condition as it was when
occupied/acquired.
V. Effective Date, Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Pride Naples FL, Inc. DBA Naples Pride, a Florida

nonprofit corporation, will cooperate to aid victims at the time of disaster. In witness thereof,
the parties have executed this Memorandum of Understanding on the date indicated. The
provisions of this Memorandum of Understanding will be effective from the date approved by
the Board of County Commissioners for a period of three (3) years. At the end of the three-year
(3) period, this Memorandum of Understanding will automatically renew for an additional term
of one year, unless terminated as provided in Paragraph VI of this Memorandum of
Understanding. Both Parties have the authority to amend provisions of this Memorandum of
Understanding upon the mutual consent and by written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or

II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organization, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the BENISON
CENTER wishes to assist in rendering the most efficient service with a minimum of
duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and BENISON CENTER, at a time
of major disaster and during the post -disaster recovery period should be maintained at efficient
levels and is part of the purpose of this Memorandum of Understanding. BENISON CENTER
works on a voluntary basis as a member of the Voluntary Agencies Working Group, a working
group reporting to the Collier County Citizen Corps, established by Ordinance No. 02-56, as
amended and will make a continuing effort to acquaint its staff members and other
representatives ("members") of this Memorandum of Understanding to assist Collier County
Government in carrying out mutual responsibilities for disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify BENISON CENTER of the potential need to assist in activities following
a disaster; and
2. Participate in and develop training in disaster response for the members of
BENISON CENTER; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of BENISON CENTER for
disaster relief and recovery projects as set forth below; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
6. Collier County shall include BENISON CENTER as an additional insured under
applicable insurance policies for any loss or damages to any facility or equipment
utilized pursuant to this Agreement for any potential liability for actions taken in
furtherance of this Agreement; and
B. BENISON CENTER will make efforts to:
1. Provide desienated areas of its facilities to Collier County to the extent available,
at no charge during the disaster or local emergency relief and recovery periods for
County management and operational services, provided a BENISON CENTER
staff member is present at all times; and
2. Provide a reasonable number of staff members, to the extent available, to Collier
County at no charge during the disaster recovery period; and
3. Provide a 24-hour contact person and alternates; and
4. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
5. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
6. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both BENISON CENTER and Collier County agree to the following:
1. No modifications or changes whatsoever will be made to the facility/property by
the Collier County Representative without the express prior written approval of
BENISON CENTER, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on an inspection form, and/or
this Memorandum of Understanding; and

3. The facility/property will be returned to the BENISON CENTER in the same
condition as it was when occupied/acquired.
4. Prior to vacating the facility, representatives of both parties will again inspect the
facility / property to note any discrepancies on the release form.
5. BENISON CENTER's facility/property shall not be used as an emergency
shelter for any persons or animals.
6. Collier County will timely notify BENISON CENTER regarding (a) the number
of staff requested; (b) how quickly staff must report; (c) the location to which
staff must report; and (d) the estimated length of time such staff services shall be
required.
7. BENISON CENTER is not obligated to provide staff if personnel are unavailable
or unwilling to participate. In addition, BENISON CENTER retains the right to
recall staff members if reasonably necessary for the operation of BENISON
CENTER's programs and facilities.
8. BENISON CENTER reserves the right to relocate County management and
operational services to a different area of its facilities if reasonably necessary for
the operation of BENISON CENTER's programs and facilities; and
9. Collier County shall use its best efforts to provide a certificate from its insurer
that BENISON CENTER shall be included an additional insured in the event of
any disaster contemplated under the terms of this Agreement.
V. Effective Date, Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and BENISON CENTER, will cooperate to aid victims at
the time of disaster. In witness thereof, the parties have executed this Memorandum of
Understanding on the date indicated. The provisions of this Memorandum of Understanding will
be effective from the date approved by the Board of County Commissioners for a period of three
(3) years. At the end of the three-year (3) period, this Memorandum of Understanding will
automatically renew for an additional term of one year, unless terminated as provided in
Paragraph VI of this Memorandum of Understanding. Both Parties have the authority to amend
provisions of this Memorandum of Understanding upon the mutual consent and by written
instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the OUR
DAILY BREAD FOOD PANTRY wishes to assist in rendering the most efficient
service with a minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and OUR DAILY BREAD FOOD
PANTRY, at a time of major disaster and during the post -disaster recovery period should be
maintained at efficient levels and is part of the purpose of this Memorandum of Understanding.
OUR DAILY BREAD FOOD PANTRY works on a voluntary basis as a member of the

3. The facility/property will be returned to the COALITION OF IMMOKALEE
WORKERS in the same condition as it was when occupied/acquired.
4. Prior to vacating the facility, representatives of both parties will again inspect the
facility / property to note any discrepancies on the release form.
5. COALITION OF IMMOKALEE WORKERS's facility/property shall not be
used as an emergency shelter for any persons or animals.
6. Collier County will timely notify COALITION OF IMMOKALEE
WORKERS regarding (a) the number of staff requested; (b) how quickly staff
must report; (c) the location to which staff must report; and (d) the estimated
length of time such staff services shall be required.
7. COALITION OF IMMOKALEE WORKERS is not obligated to provide staff if
personnel are unavailable or unwilling to participate. In addition, COALITION
OF IMMOKALEE WORKERS retains the right to recall staff members if
reasonably necessary for the operation of COALITION OF IMMOKALEE
WORKERS's programs and facilities.
8. COALITION OF IMMOKALEE WORKERS reserves the right to relocate
County management and operational services to a different area of its facilities if
reasonably necessary for the operation of COALITION OF IMMOKALEE
WORKERS's programs and facilities; and
9. Collier County shall use its best efforts to provide a certificate from its insurer
that COALITION OF IMMOKALEE WORKERS shall be included an
additional insured in the event of any disaster contemplated under the terms of
this Agreement.
V. Effective Date, Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and COALITION OF IMMOKALEE WORKERS, will
cooperate to aid victims at the time of disaster. In witness thereof, the parties have executed this
Memorandum of Understanding on the date indicated. The provisions of this Memorandum of
Understanding will be effective from the date approved by the Board of County Commissioners
for a period of three (3) years. At the end of the three-year (3) period, this Memorandum of
Understanding will automatically renew for an additional term of one year, unless terminated as
provided in Paragraph VI of this Memorandum of Understanding. Both Parties have the authority
to amend provisions of this Memorandum of Understanding upon the mutual consent and by
written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or

I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or "Collier County Government"), and Guadalupe Center
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organization, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the
GUADALUPE CENTER wishes to assist in rendering the most efficient service
with a minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and GUADALUPE CENTER, at a
time of major disaster and during the post -disaster recovery period should be maintained at
efficient levels and is part of the purpose of this Memorandum of Understanding.
GUADALUPE CENTER works on a voluntary basis as a member of the Voluntary Agencies
Working Group, a working group reporting to the Collier County Citizen Corps, established by
Ordinance No. 02-56, as amended and will make a continuing effort to acquaint its staff
members and other representatives ("members") of this Memorandum of Understanding to assist
Collier County Government in carrying out mutual responsibilities for disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify GUADALUPE CENTER of the potential need to assist in activities
following a disaster; and
2. Participate in and develop training in disaster response for the members of
GUADALUPE CENTER; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of GUADALUPE CENTER for
disaster relief and recovery projects as set forth below; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
6. Collier County shall include GUADALUPE CENTER as an additional insured
under applicable insurance policies for any loss or damages to any facility or
equipment utilized pursuant to this Agreement for any potential liability for
actions taken in furtherance of this Agreement; and
B. GUADALUPE CENTER will make efforts to:
1. Provide designated areas of its facilities to Collier County to the extent available,
at no charge during the disaster or local emergency relief and recovery periods for
County management and operational services, provided a GUADALUPE
CENTER staff member is present at all times; and
2. Provide a reasonable number of staff members, to the extent available, to Collier
County at no charge during the disaster recovery period; and
3. Provide a 24-hour contact person and alternates; and
4. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
5. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
6. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both GUADALUPE CENTER and Collier County agree to the following:
1. No modifications or changes whatsoever will be made to the facility/property by
the Collier County Representative without the express prior written approval of
GUADALUPE CENTER, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on an inspection form, and/or
this Memorandum of Understanding; and

3. The facility/property will be returned to the GUADALUPE CENTER in the

Lodge No. 295 F. & A.M. wishes to assist in rendering the most efficient service
with a minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Cypress Lodge No. 295 F. &
A.M., at a time of major disaster and during the post-disaster recovery period should be
maintained at efficient levels and is part of the purpose of this Memorandum of Understanding.
Cypress Lodge No. 295 F. & A.M. works on a voluntary basis as a member of the Voluntary
Agencies Working Group, a working group reporting to the Collier County Citizen Corps,
established by Ordinance No. 02-56, as amended, and will make a continuing effort to acquaint
its members of this Memorandum of Understanding to assist Collier County Government in
carrying out mutual responsibilities for disaster relief

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Cypress Lodge No. 295 F. & A.M. of the potential need to assist in
activities following a disaster; and
2. Participate in and develop training in disaster response for the members of
Cypress Lodge No. 295 F. & A.M.; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Cypress Lodge No. 295 F. &
A.M. for disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. CYPRESS LODGE No. 295 F. & A.M. will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Cypress Lodge No. 295 F. & A.M.
in the same condition as it was when occupied/acquired.
V. Effective Date,Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Cypress Lodge No. 295 F. & A.M., will cooperate to
aid victims at the time of disaster. In witness thereof, the parties have executed this
Memorandum of Understanding on the date indicated. The provisions of this Memorandum of

Understanding will be effective from the date approved by the Board of County Commissioners
for a period of three (3) years. At the end of the three-year (3) period, this Memorandum of
Understanding will automatically renew for an additional term of one year, unless terminated as

to amend provisions of this Memorandum of Understanding upon the mutual consent and by
written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or"Collier County Government"), and Lely Presbyterian Church.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,

I: Purpose: The purpose of the Memorandum of Understanding (MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida, through its Emergency Management
Division ("the County" or"Collier County Government"), and Harry Chapin Food Bank of
Southwest Florida.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public-private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Harry
Chapin Food Bank of Southwest Florida wishes to assist in rendering the most
efficient service with a minimum of duplication to the citizens and guests of Collier
County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Harry Chapin Food Bank of
Southwest Florida, at a time of major disaster and during the post-disaster recovery period
should be maintained at efficient levels and is part of the purpose of this Memorandum of
Understanding. Harry Chapin Food Bank of Southwest Florida works on a voluntary basis as
a member of the Voluntary Agencies Working Group, a working group reporting to the Collier
County Citizen Corps, established by Ordinance No. 02-56, as amended, and will make a

continuing effort to acquaint its members of this Memorandum of Understanding to assist Collier
County Government in carrying out mutual responsibilities for disaster relief.
IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Harry Chapin Food Bank of Southwest Florida of the potential need to
assist in activities following a disaster; and
2. Participate in and develop training in disaster response for the members of Harry
Chapin Food Bank of Southwest Florida; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Harry Chapin Food Bank of
Southwest Florida for disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. HARRY CHAPIN FOOD BANK OF SOUTHWEST FLORIDA will make efforts
to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffmg capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Harry Chapin Food Bank of
Southwest Florida in the same condition as it was when occupied/acquired.
V.Effective Date,Automatic Renewal,and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through

its Emergency Management Division, and Harry Chapin Food Bank of Southwest Florida,
will cooperate to aid victims at the time of disaster. In witness thereof, the parties have executed
this Memorandum of Understanding on the date indicated. The provisions of this Memorandum
of Understanding will be effective from the date approved by the Board of County
Commissioners for a period of three (3) years. At the end of the three-year (3) period, this
Memorandum of Understanding will automatically renew for an additional term of one year,
unless terminated as provided in Paragraph VI of this Memorandum of Understanding. Both
Parties have the authority to amend provisions of this Memorandum of Understanding upon the
mutual consent and by written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. GROW CHURCH will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator,or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Grow Church in the same condition
as it was when occupied/acquired.
V. Effective Date,Automatic Renewal,and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County,through
its Emergency Management Division, and Grow Church, will cooperate to aid victims at the
time of disaster. In witness thereof, the parties have executed this Memorandum of
Understanding on the date indicated. The provisions of this Memorandum of Understanding will
be effective from the date approved by the Board of County Commissioners for a period of three

(3) years. At the end of the three-year (3) period, this Memorandum of Understanding will
automatically renew for an additional term of one year, unless terminated as provided in
Paragraph VI of this Memorandum of Understanding. Both Parties have the authority to amend
provisions of this Memorandum of Understanding upon the mutual consent and by written
instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

and
Immokalee Unmet Needs Coalition(IUNC)
I: Purpose: The purpose of the Memorandum of Understanding(MOU) is to set forth, define
and establish mutual agreements, understandings, and obligations by and between Collier
County,a political subdivision of the State of Florida,through its Emergency Management
Division ("the County" or"Collier County Government"),and Immokalee Unmet Needs
Coalition.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public-private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Immokalee
Unmet Needs Coalition wishes to assist in rendering the most efficient service witha
minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Immokalee Unmet Needs
Coalition, at a time of major disaster and during the post-disaster recovery period should be
maintained at efficient levels and is part of the purpose of this Memorandum of Understanding.
Immokalee Unmet Needs Coalition works on a voluntary basis as a member of the Voluntary
Agencies Working Group, a working group reporting to the Collier County Citizen Corps,
established by Ordinance No. 02-56, as amended, and will make a continuing effort to acquaint
its members of this Memorandum of Understanding to assist Collier County Government in
carrying out mutual responsibilities for disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Immokalee Unmet Needs Coalition of the potential need to assist in
activities following a disaster; and
2. Participate in and develop training in disaster response for the members of
Immokalee Unmet Needs Coalition;and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Immokalee Unmet Needs
Coalition for disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida

Memorandum of Understanding
Between
Collier County, a Political Subdivision of the State of Florida
and
Collier Community Foundation
I: Purpose: The purpose of the Memorandum of Understanding(MOU) is to set forth, define
and establish mutual agreements,understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida,through its Emergency Management
Division ("the County" or"Collier County Government"), and Collier Community
Foundation.
II.Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public-private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Collier
Community Foundation wishes to assist in rendering the most efficient service with
a minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government, through its Emergency Management Division, and Collier Community
Foundation, at a time of major disaster and during the post-disaster recovery period should be
maintained at efficient levels and is part of the purpose of this Memorandum of Understanding.
Collier Community Foundation works on a voluntary basis as a member of the Voluntary
Agencies Working Group, a working group reporting to the Collier County Citizen Corps,
established by Ordinance No. 02-56, as amended, and will make a continuing effort to acquaint
its members of this Memorandum of Understanding to assist Collier County Government in
carrying out mutual responsibilities for disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Collier Community Foundation of the potential need to assist in
activities following a disaster; and
2. Participate in and develop training in disaster response for the members of Collier
Community Foundation; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize,when and as appropriate, the services of Collier Community Foundation
for disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. COLLIER COMMUNITY FOUNDATION will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
The facility/property will be returned to the Collier Community Foundation in
the same condition as it was when occupied/acquired.
V. Effective Date,Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Collier Community Foundation, will cooperate to
aid victims at the time of disaster. In witness thereof, the parties have executed this
Memorandum of Understanding on the date indicated. The provisions of this Memorandum of
Understanding will be effective from the date approved by the Board of County Commissioners

for a period of three (3) years. At the end of the three-year (3) period, this Memorandum of
Understanding will automatically renew for an additional term of one year, unless terminated as
provided in Paragraph VI of this Memorandum of Understanding. Both Parties have the authority
to amend provisions of this Memorandum of Understanding upon the mutual consent and by
written instrument executed by the Parties.
VI. Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AUTHORIZING ITS CHAIR TO
EXECUTE MEMORANDUMS OF UNDERSTANDING WITH OWNERS
OF LARGE CAPACITY SPACES, SUCH AS NOT-FOR-PROFIT
ORGANIZATIONS, COMMUNITY ASSOCIATIONS, AND PLACES OF

WHEREAS, Section 252.38, Florida Statutes, provides that "Safeguarding the life and
property of its citizens is an innate responsibility of the governing body of each political
subdivision of the state" and places the burden for evacuation and sheltering at-risk citizens
during an emergency or disaster upon the County; and
WHEREAS, not-for-profit organizations, community associations, and places of worship
have large capacity spaces that are well suited for sheltering and distribution areas for disaster
and emergency assistance; and
WHEREAS, the attached standard form Memorandum of Understanding sets forth the
roles and responsibilities for both the County and the facility providing space for sheltering and
distribution areas; and
WHEREAS, it is in the public's interest and to the public's benefit if the Board of County
Commissioners authorizes its Chair to administratively execute Memorandums of Understanding
for disaster relief as they are brought forward by Collier County staff and approved by the
County Attorney's Office for form and legality without further Board approval or action.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY,FLORIDA, that:
1. The above recitals are adopted by the Board as being true and accurate and as such, are
hereby incorporated herein as if fully set out in this Paragraph.
2, Its Chair is authorized to administratively execute Memorandums of Understanding in
substantially the form attached hereto as "Exhibit A" as they are brought forward by

Memorandum of Understanding
Between
Collier County, a Political Subdivision of the State of Florida
and
Naples Botanical Garden
I: Purpose: The purpose of the Memorandum of Understanding(MOU)is to set forth, define
and establish mutual agreements,understandings, and obligations by and between Collier
County, a political subdivision of the State of Florida,through its Emergency Management
Division("the County" or"Collier County Government"), and Disaster Ready Collier
County.
II. Statement of Basic Responsibilities:
A. Collier County Government, through its Emergency Management Division, provides
coordination of emergency services with Collier County, including incorporated
areas. This includes the selection and utilization of various resources and
organizations capable of rendering assistance. Under Chapter 252, Florida Statutes,
Collier County Government, through its Emergency Management Division, also
coordinates the administration of relief activities of both public and private relief or
disaster assistance organizations which agree to volunteer their services under the
direction or guidance of Collier County authorities. In addition, Collier County
Government may utilize personnel and facilities of relief or disaster assistance
organizations, churches, temples, and synagogues in the distribution of food, relief
supplies, medicines or other items and temporary sheltering as part of the restoration,
rehabilitation or reconstruction of community services and essential facilities
whenever Collier County Government authorities deem it necessary.
B. Recognizing the increased demand for churches, temples, synagogues, large capacity
spaces, and public-private partnership facilities to supplement assistance and recovery
to victims of both Presidentially declared or undeclared disasters, and the need to
work in harmony with local governments and private relief agencies, the Naples
Botanical Garden wishes to assist in rendering the most efficient service with a
minimum of duplication to the citizens and guests of Collier County.
III: Coordination of Effort: Cooperation and coordination between Collier County
Government,through its Emergency Management Division, and Naples Botanical Garden, at a
time of major disaster and during the post-disaster recovery period should be maintained at
efficient levels and is part of the purpose of this Memorandum of Understanding.Naples
Botanical Garden works on a voluntary basis as a member of the Voluntary Agencies Working
Group, a working group reporting to the Collier County Citizen Corps, established by Ordinance
No. 02-56,as amended, and will make a continuing effort to acquaint its members of this
Memorandum of Understanding to assist Collier County Government in carrying out mutual
responsibilities for disaster relief.

IV: Responsibilities:
A. Collier County Emergency Management Division will make efforts to achieve the
following:
1. Notify Naples Botanical Garden of the potential need to assist in activities
following a disaster; and
2. Participate in and develop training in disaster response for the members of Naples
Botanical Garden; and
3. Schedule periodic meetings and/or exercises to familiarize members of disaster
preparedness or recovery initiatives; and
4. Utilize, when and as appropriate, the services of Naples Botanical Garden for
disaster relief and recovery projects; and
5. Collier County agrees to be responsible, to the extent provided under Florida
Statute 768.28, for its negligent acts, however, this responsibility shall not serve
as a waiver of Collier County's Sovereign Immunity limits.
B. NAPLES BOTANICAL GARDEN will make efforts to:
1. Provide facilities and/or staff to Collier County at no charge during the disaster or
local emergency relief and recovery periods; and
2. Provide a 24-hour contact person and alternates; and
3. Provide a representative to attend periodic meetings of the Voluntary Agencies
Working Group; and
4. Participate in exercises, drills, planning sessions, webinars and conference calls
developed by the Emergency Management Division; and
5. Provide the Emergency Management Division with an update of the facility and
staffing capabilities at least annually prior to June of each year.
C. Both of the above-named parties agree to the following:
1. No modifications or changes will be made to the facility/property by the Collier
County Representative without the express written approval of the
owner/operator, or designee; and
2. Prior to occupancy, representatives of both parties may inspect the
facility/property and will note any discrepancies on the inspection form, and/or
this Memorandum of Understanding; and
3. The facility/property will be returned to the Naples Botanical Garden in the
same condition as it was when occupied/acquired.
V.Effective Date,Automatic Renewal, and Modification: This Memorandum of
Understanding presents general, and some specific, guidelines by which Collier County, through
its Emergency Management Division, and Naples Botanical Garden, will cooperate to aid
victims at the time of disaster. In witness thereof, the parties have executed this Memorandum of
Understanding on the date indicated. The provisions of this Memorandum of Understanding will
be effective from the date approved by the Board of County Commissioners for a period of three

(3) years. At the end of the three-year (3) period, this Memorandum of Understanding will
automatically renew for an additional term of one year, unless terminated as provided in
Paragraph VI of this Memorandum of Understanding. Both Parties have the authority to amend
provisions of this Memorandum of Understanding upon the mutual consent and by written
instrument executed by the Parties.
VI.Termination: Either party may terminate this Memorandum of Understanding by
providing the other party with notice of its intent to terminate with 30 days written notice. The
Memorandum of Understanding may be immediately and automatically terminated by the
County without providing such notice, should the County reasonably believe that the spirit or
intent of Chapter 252, Florida Statutes, is not being effectuated by this Memorandum of
Understanding.
