EXECUTIVE SUMMARY
Recommendation to accept a grant award from the Florida Department of State Division of
Historical Resource in the amount of $455,800, authorize the Chairman to sign the grant agreement
and restrictive covenants and approve the associate d Budget Amendment, for the historic Roberts
home at the Immokalee Pioneer Museum at Roberts Ranch. (Net Fiscal Impact $569,840)
OBJECTIVE: Complete structural stabilization and rehabilitation of the historic Roberts home at the
Immokalee Pioneer Museum at Roberts Ranch.
CONSIDERATIONS: Florida Department of State Division of Historical Resources offers Special
Category Grants for the purposes of providing funding to assist local, regional, and statewide efforts to
preserve significant historic structur es and archeological sites and promote knowledge and appreciation of
the history of Florida.
The Museum Division submitted the application for the Roberts Ranch historic preservation project to
provide structural stabilization and rehabilitation for the R oberts historic home in 2018. The Board of
County Commissioners (Board) approved the submission of the grant application on May 22, 2018
(Agenda Item #16D4).
On June 25, 2019, Collier County received notification from the Florida Department of State that Collier
County's grant application, ranked fifth (5th) in the competitive process. The County has been awarded
$455,800 to facilitate the rehabilitation of this valuable historical site. As a condition of the award, the
County is required to contribute match. The county is a designated Rural Economic Development
Initiative (REDI) county decreasing the 100% required match to the minimum 25% match requirement.
Based on project estimates, the match will be supported by a total cash match contribution of $114,040
through a transfer from the Museum Capital Fund 314 in the amount of $91,250 and a transfer in the
amount of $22,790 from the General Fund.
Work will include but is not limited to; architectural and engineering fees; HVAC; foundation work;
chimney repainting, stabilization; second-floor structural stabilization; repairs to historic fabric including
rotted and termite-damaged wood siding, window and doors trim; hurricane protection; roof repairs and
hurricane tie-downs; repainting; and ADA compliant ramping.
The home and associated ranch structures, which are listed on the National Register of Historic Places
and have a local historic preservation designation, operate as a heritage destination within the Collier
County Museums System. The Division of Historical Resources has previously awarded grants to Collier
County for projects at Roberts Ranch in 2000, 2001, and 2003.
Per grant requirements, Collier County will place restrictive covenants on the property for ten (10) years.
The State’s standard form Restrictive Covenants document is attached to this Item. The standard form
limits how maintenance will be performed, how modifications will be made, and it gives the State rights
to inspect the property. Failure to comply with the Restrictive Covenants will result in all or a prorated
amount of grant funds to be paid by Collier County to the State.
FISCAL IMPACT: The Florida Department of State will provide $455,800 in grant funding. The grant
requires a twenty-five (25%) match requirement, in the amount of $113,950 but project estimates bring
match to $114,040. Budget Amendments are required to appropriate grant revenue and match within the
Public Service Grant Fund (709), Project 33646 and Public Service Match Fund (710), Project 33646.

Matching funds are available in the forms of transfers from the Museum Capital Projects Fund (314) in
the amount of $91,250 and General Fund (001) in the amount of 22,790.

THESE COVENANTS are entered into this dav of 20_, by Collier County Board of
County Commission, hereinafter referred to as the Owner, and shall be effective for a period often years from
the date ofrecordation by the Clerk ofthe Circuit Court of Collier County, Florida.
WHEREAS, the Owner is the fee simple titleholder of the Property located at l2l5 Roberts Avenue W.,
Immokalee, Collier County, Florida, as described in Exhibit A, attached to and made a part hereofand
WHEREAS, the Owner is a grant recipient and is to receive State Historic Preservation Grant assistance
funds administered by the State of Florida, Department of State, Division of Historical Resources, R.A. Gray
Building, 500 South Bronough Street, Tallahassee, Florida 32399-0250, hereinafter referred to as the
Department, in the amount of$455,800, to be used for the preservation ofthe property ofthe Owner as described
in Exhibit A, and
WHEREAS, said State funds have been or will be expended for the purpose of preserving the historic
qualities ofthe property or contributing to the historic character ofthe district in which the property is located,
Now THEREFORE, as part ofthe consideration for the State grant, the Owner hereby make and declare the
following restrictive covenants which shall run with the title to said Property and be binding on the Owner and
its successors in interest, ifany, for a period stated in the preamble above:
The Owner agrees to maintain the property in accordance with good preservation practices and the Secretary
ofthe Interior's Standards for Rehabilitation
2. The Owner agrees that no modifications will be made to the Property, other than routine repairs and
maintenance, without advance review and approval of the plans and specifications by the Department's
Bureau of Historic Preservation.
3. The Owner agrees that every effort will be made to design any modifications tothe Property in a manner
consistent with the Secretarv of Interior's Standards for habilitation
4. The Owner agrees that the Department, its agents and its designees shall have the right to inspect the
Property at all reasonable times in order to ascertain whether the conditions ofthe Grant Award Agreement
and these covenants are being observed.
5. The Owner agrees that these restrictions shall encumber the property for a period of ten years fiom the date
of recordation, and that if the restrictions are violated within the ten year period, the Department shal be
entitled to liquidated damages pursuant to the following schedule:
a. Ifthe violation occurs within the first five years ofthe effective date ofthese covenants, the Department
shall be entitled to retum ofthe entire grant amount.
b. Ifthe violation occurs after the first five years, the Department shall be entitled to return of the entire
grant amount, less l0olo for each year past the first five. For instance, if the violation occurs after the
sixth anniversary of the effective date of these covenants, but prior to the seventh anniversary, the
Department shall be entitled to retum of 80oZ ofthe original grant amount.
6. The Owner agrees to file these covenants with the Clerk of the Circuit Court of Collier County, Florida,
and shall pay any and all expenses associated with their filing and recording.7. The owner agree that the Department shall incur no tax Iiability as a result ofthese restrictive covenants.

historic preservation grants specialist assigned to your project wi ll contact you soon to begin the process
towards the execution of a grant award agreement. He/she will be your main point of contact, but

help you get started:
• Grants Online System – The Department of States uses a Department-wide online grants system.
Please visit dosgrants.com and make sure the Project Contact is still active, along with that
person’s information including active email address and telephone numbers. We will be using
the online system to manage, monitor, and review all documents related to the grant project.
• Procurement – If your grant will require a contractor’s services (e.g. architect, engineer, general
contractor, archaeologist, survey consultant, web designer), depending on the contract amount
for those services, you will be required to document your selection process. Also, draft contracts
must be reviewed and approved by the Division prior to the solicitation of services and/or
