EXECUTIVE SUMMARY
Recommendation to hear Land Development Code Amendments relating to an amendment to the
Airport Overlay zoning district at two regularly scheduled daytime hearings and waive the
nighttime hearing requirement.
OBJECTIVE: To present to the Board of County Commissioners (Board) a Land Development Code
(LDC) amendment that changes several zoning atlas maps at two regularly scheduled daytime hearings on
Tuesday, October 8, 2019, and Tuesday, October 22, 2019. This waiver requires the Board to waive the
nighttime hearing by a super majority vote.
CONSIDERATIONS: A LDC amendment was recently required due to an update to Chapter 333,
Florida Statutes (F.S.), and includes amendments to several Zoning Atlas Maps. This LDC amendment
requires public hearings and notice requirements pursuant to LDC section 10.03.06 K. This LDC section
requires two Board meetings, and at least one hearing shall be held after 5:00 p.m. on a weekday, unless
by super majority vote the Board elects to conduct the hearing at another time of day.
This amendment proposes a new review process for airspace obstructions within Collier County and
proposed new compatibility regulations based on the requirements within Chapter 333, F.S. The airspace
obstruction review process was previously under the jurisdiction of the FDOT but is now required to be
completed by Collier County. In order to effectively implement this required process, the existing Airport
Overlay (APO) will now be depicted on the applicable zoning atlas maps, as well as, on the maps
provided in Appendix D of the LDC. The Airport Overlay maps are also being updated and improved for
clarity.
This amendment received recommendations of approval from the Development Services Advisory
Committee (DSAC) and the CCPC.
To date, no objections to this amendment have been raised by the public. However, if any amendments
require additional public input after the first hearing, the Board may choose to reschedule the second
hearing to hold a meeting after 5:00 p.m.
FISCAL IMPACT: There are no fiscal impacts associated with this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority
vote from Board approval (HFAC).
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
RECOMMENDATION: To hold two regularly scheduled daytime hearings to consider LDC
amendments. This option waives the night meeting requirement as provided for in LDC section 10.03.06
K.
