EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 32, Block A, Naples
Mobile Estates, according to the plat thereof as recorded at Plat Book 10, Page 91 of the public
records of Collier County.

OBJECTIVE: To approve an Easement Use Agreement between the County and the current property
owners of Lot 32, Block A, Naples Mobile Estates, in order to allow a set of concrete steps to e ncroach
approximately 3 feet into a 15-foot wide drainage and utility easement, more specifically shown on
Exhibit “A.”
CONSIDERATIONS: The property is located at 248 Cape Sable Drive. The homeowners are
attempting to obtain a permit for the stairs that were built as part of the repairs to the home after
Hurricane Irma. The set of concrete steps encroaches 3 feet into a 15 -foot wide drainage and utility
easement located along the rear boundary of the property. The subject easement is dedicated to the
perpetual use of the public, according to the plat. The homeowners maintain the easement area. There are
no drainage facilities within the easement, just a small swale.
The Development Review Division has reviewed the Agreement and Exhibits and recommends a pproval
of the Easement Use Agreement.
Letters of No Objection have been received from F.P.& L., Comcast, CenturyLink, Guardian Property
Management and Collier County Capital Project and Impact Fees Program Management, Stormwater
Management Section.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the
recording fees of this Agreement.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. SAA
RECOMMENDATIONS: To approve the Easement Use Agreement between the County and current
property owners of Lot 32, Block A, Naples Mobile Estates, and authorize the Chairman to execute the
Agreement and direct the Clerk to record the Easement Use Agreement into the public records of Collier
County, Florida.
