EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve for
recording the amended final plat of Maple Ridge at Ave Maria Phase 6B, (Application Number
PL20190000868) approval of the standard form Construction and Maintenance Agreement and
approval of the amount of the performance security.

OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the amended
final plat of Maple Ridge at Ave Maria Phase 6B, a subdivision of lands located in Section 4, Township
48 South, Range 29 East, Collier Count y, Florida, following the alternative procedure for approval of
subdivision plats pursuant to Resolution 99-199. This procedure allows for the Board to approve the
amended plat and associated construction documents for construction purposes and recording purposes
concurrently.
CONSIDERATIONS: On February 26, 2019, the Board approved the final subdivision plat for Maple
Ridge at Ave Maria Phase 6B PL20180001175. The developer has reduced the previously approved 204
single-family residential units to 177 units by replacing the 45’ lots with 55’ and 65’ lots, necessitating
this additional approval by the Board. According to Section 10.02.04 B.5.b of the Land Development
Code, following approval by the Board of the final subdivision plat, but prior to recordat ion, the Board
may approve amendments to the final subdivision plat.
The Development Review Division of the Growth Management Department has completed the review of
the construction drawings, specifications, and amended final plat of Maple Ridge at Ave Ma ria Phase 6B.
These documents are in compliance with the County Land Development Code and Chapter 177, Florida
Statutes. This project is within the Ave Maria SRA. All fees have been paid.
Security in the amount of 10% of the total cost of the required improvements associated with this
amended final plat, and 100% of the cost of any remaining improvements, together with a Construction
and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the
County Manager or his designee and the County Attorney’s office prior to the recording of the amended
final plat. This procedure is in conformance with Section 10.02.04 F.2 of the Land Development Code.
The Development Review Division recommends that the amended final plat of Maple Ridge at Ave Maria
Phase 6B be approved for recording.
FISCAL IMPACT: The project cost associated with this amended final plat is $3,893,635.65
(estimated) to be borne by the developer.
The cost breakdown is as follows:
a) Water & Sewer $1,056,484.90
b) Drainage, Paving, Grading $2,837,150.75
The Security amount, equal to 110% of the
project revision cost, is $4,282,999.22
The County will realize revenues as follows:

Revenue generated by this project: Total: $86,439.52

The bulk of the fees were paid under the previously approved PPL (PL20180001175) and were paid in
October 2018. Additional fees for this amended plat, are based on a constr uction estimate of
$3,893,635.65 (does not include Ave Maria Utilities) and were paid in April 2019 .
The breakdown is as follows:

GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public
Facilities (COA) prior to the issuance of the construction plan final approval letter and plat recordation,
except when the applicant elects to delay obtaining a COA for non-residential developments that are
required to obtain approval of a site development plan prior to the issuance of a building permit.
LEGAL CONSIDERATIONS: The applicant is requesting approval of the amended final subdivision
plat and construction and maintenance agreement. The Board shall consider the County Manager or
designee’s recommendation and shall take evidence and testimony in regard to the final subdivision plat
requirements identified in LDC sections 10.02.04 B, 10.02.04 C, and other provisions of the LDC, as well
as Chapter 177, Florida Statutes. If the Board denies or places conditions on the amended final
subdivision plat, it shall state reasons for such denial or conditions.
The original final subdivision plat was approved by the Board on February 26, 2019. In accordance with
the LDC, the applicant is required to submit the final subdivision plat to the County Manager or designee
for recording within 18 months of the date of approval of the final subdivision plat by the Board.
However, following approval by the Board, but prior to recordatio n, the County Manager or designee may
approve minor insubstantial changes to the final subdivision plat, and the Board may approve any changes
that are not minor and insubstantial. The applicant’s proposed changes to the originally approved final
subdivision plat are not considered minor and insubstantial, and therefore this amended final subdivision
plat requires Board approval.
This item has been approved as to form and legality, and requires a majority vote for Board approval -

RECOMMENDATION: To endorse staff’s recommendation to approve the amended final plat of
Maple Ridge at Ave Maria Phase 6B (Application Number PL20190000868) for recording with the
following stipulations:
1. Approve the amount of $4,282,999.22 as the performance security for th e required improvements
associated with this amended plat; or such lesser amount based on work completed, and as is
approved by the Growth Management Department.
2. Approve the standard form Construction and Maintenance Agreement and direct the County Mana ger
or his designee:
a. To withhold Certificates of Occupancy until the required improvements have received
preliminary acceptance.
b. To delay recording of the amended plat until suitable security and an appropriate Construction

Board of County Commissioners or the County Manager or his designee on behalf of the Board
pursuant to Section 10.02.04 F.2 of the Land Development Code.
