Subject: Productivity Committee’s Recommendations regarding the Collier County
Hearing Examiner
As requested, on July 10, 2019, the County Productivity Committee heard
a presentation from and interviewed the Hearing Examiner, Mark Strain.
The meeting was both informative and instructive. The committee was
required to do some research as most of us were not aware of the details,
duties and processes of the Hearing Examiner.
As the Productivity Committee understands the charge from the B oard, we
were ask to look at opportunities to expand the duties of the Hearing
Examiner. There was concern that in 2018 the Hearing Examiner had 27
petitions. The Hearing Examiner clarified in his presentation that there
had been an issue identified by the Clerk of Courts that impacted the cases
heard in 2018. The average annual number is approximately 38. This year
there have been 29 meetings in the first 6 months.
The Hearing Examiner made 8 recommendations regarding expansion of
his duties. These include:
1. Expand site plan with deviations to residential and infill parcels
2. Close out of PUD’s
3. Create a public process for major special events (suggested by
Sheriff)
4. Disposition of Code Enforcement fines
5. Approval of Plats
6. Street name change

8. Establish a cutoff point for moving actions to other review boards
These recommendations were briefly explained to the Productivity
Committee and given our rudimentary knowledge of the laws, rules and
regulations the committee believes these additions should be reviewed by
the county attorney and as possible incorporated into the Hearing
Examiners duties.
The Hearing Examiner identified that during the Commissions summer
recess the petitioners could be subject to an extended delay in approval of
their petition. The Hearing Examiner felt that he could provide an alternative
path for petitioners to receive approval during the summer recess or take
on the additional responsibilities above to expedite approval.
Additionally, the Committee noted that the Fee Structure that was shared
was based in 2013. The Committee felt that this fee structure should be
reviewed for concurrence with current conditions.
Finally, the Productivity Committee members had all heard presentations
from the Hearing Examiner, and all believe that these presentations are
reflective of county transparency and public education. They serve the
county well and should be encouraged. Based on the Boards
recommendation the Committee feels that a review should be apart of the
Hearing Examiner’s Contract renewal process. With this review the
Commission should identify specific measurables for the Hearing Examiner
to measure against.
