To the extent no permits or approvals are required for hand-cutting and removal of exotics within ten feet of the perimeter of the property line, all Collier Count Prohibited Exotic vegetation within ten feet of an adjacent property (from property boundary moving toward the center of the Respondent’s property, as depicted in attached Exhibit “A”) shall be cut down and removed by July 2, 2020 or a fine of $100.00 per day will be imposed until the encroaching exotic vegetation is removed. 3. Remove all Collier County Prohibited Exotic vegetation that remains within a 200 foot radius of any abutting, improved property by January 1, 2021 or a fine of $200.00 per day will be imposed until the violation is abated. 4. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. The Stipulation was entered into by Martha A. Zavala on August 2, 2019. . Special Magistrate Garretson found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.90 incurred in the prosecution of this case by September 2, 2019. 2. Remove all unauthorized accumulation of litter from the property to a site intended for final disposal or store items with a completely enclosed structure by August 9, 2019 or a fine of $100.00 per day will be imposed until the violation has been abated thereafter. 3. Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-179. I observed a person living in a tent on this unimproved property. I observed an abundance of litter including trash, garbage and other materials on this unimproved property. FOLIO NO: 23370760002 PROPERTY ADDRESS: Bayview Park Lots 25 and 26, Naples, FL Officer Johnson requested the hearing. The Stipulation was entered into by Sonia Blanco on August 2, 2019. . Special Magistrate Garretson found the Respondent GUILTY of the alleged violation and was ordered to: August 2, 2019 6 1. Pay Operational Costs in the amount of $111.80 incurred in the prosecution of this case by September 2, 2019. 2. Remove or cause to remove all unauthorized litter which is a public nuisance pursuant to this section by September 2, 2019 or a fine of $100.00 per day will be imposed until the violation has been abated thereafter. 3. CASE NO: CENA20190004521 OWNER: Alejandra Lynch OFFICER: Jonathan Musse VIOLATIONS: Collier County Land Development Code 04-41, as amended, Section 2.02.03 and the Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-179. Repeat violation of illegal outside storage including, but not limited to, a camper shell, window A/C unit, riding lawn tractor, old real estate sign, air compressor, assorted mechanical equipment, etc. FOLIO NO: 62260040000 PROPERTY ADDRESS: 5330 Broward St, Naples, FL Officer Musse and Manager Letourneau represented the County reporting Ms. Lynch’s property has been the subject of 36 cases since 1996 with 6 cases previously brought to hearing. They requested a finding of a violation existing at the time the notice was issued on April 19, 2019. Evidence Entered: Composite Exhibit A: 2 photos dated 4/18/19 Composite Exhibit B: 12 photos dated 8/1/19 Alejandra Lynch was present and testified:  The items in question should not be considered litter as they are things such as bags of mulch, a camper shell she takes on and off a truck, a concrete table and benches, bicycles, etc.  The previous case was closed as she was in compliance and she has not stored any new items on the property since that time.  She is unsure what items need to be removed. Special Magistrate Garretson expressed concern the notice does not specifically list each item and it may be confusing to Ms. Lynch on the steps necessary to comply with the Ordinance. Manager Letourneau noted the Officer visited the site 6 times and the items were not removed and the ongoing complaints stem from adjacent property owners and routine patrols and a violation existed at the time of notice. August 2, 2019 7 Special Magistrate Garretson recommended the Officer meet with Ms. Lynch on site and individually identifying each item required to be removed and consider labeling them with stickers. Photographic documentation of the items identified to be removed during the meeting would also be helpful for future proceedings. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence CONTINUED the case until the next hearing date. 11. CASE NO: CEV20190002430 OWNER: James M Poteet OFFICER: Virginie Giguere VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 130, Article III, Section 130-95. Multiple unlicensed/inoperable vehicles on property. FOLIO NO: 68342680007 PROPERTY: 71 Isles of St. Thomas, Naples, FL Officer Giguere, representing the County, reported the case is a repeat violation but was abated on December 1, 2018. Owber paid the Operational Costs associated with the first offense. James Poteet was present and testified he had a violation but abated it when he was contacted by the Code Enforcement Division. He has remained in compliance and any further costs would be a financial hardship for him. Special Magistrate Garretson, after hearing the testimony found the Respondent GUILTY of the alleged violation and order him to: 1. Pay Operational Costs in the amount of $111.80 incurred in the prosecution of this case by February 2, 2020. 2. Pay a Civil Penalty for the repeat violation in the amount of $100.00 by February 2, 2020. Total Amount Due: $211.80 VII. NEW BUSINESS B. MOTION FOR IMPOSITION OF FINES AND LIENS 2. CASE NO: CEAU20170015623 OWNER: Odonel Joseph, Nathalie Romelus, Cathia Claire Juste, Ernest Abellard and Raunie Abellard August 2, 2019 8 OFFICER: Jonathan Musse VIOLATIONS: Florida Building Code, Fifth Edition (2014) Building, Chapter 1, Part 2, Section 105.1. Damaged wooden fence that was built prior to obtaining all required Collier County Building permits. FOLIO NO: 54900400002 PROPERTY 101 Willow Creek LN, Naples, FL Joseph Odonel was present and the other Resondents were given notice by Certified Mail on July 18, 2019 and the notice was posted at the Courthouse on July 18, 2019. Supervisor Mucha represented the County and reported the violation has been abated but Operational Costs in the amount of $111.90 for the previous hearing have not been paid.
