EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners adopt an Ordinance amending
"Appendix A" of Ordinance No. 2001-13, as amended, the Collier Count)' Consolidated
Impact J<'ee Ordinance, by providing for an amendment to Ordinance No. 2007-57 to
correct a scrivener's error in the Correctional Facilities Impact Fee Rate Schednle
OBJECTIVE: That the Board of County Commissioners (Hoard) adopt an Ordinance amending
"Appendix A" of Ordinance No. 2001-13, as amended, the Collier County Consolidated Impact
Fee Ordinance, by providing 1'01' an amendment to Ordinance No. 2007-57 to correct a
scrivener's error in the Con'ectional Facilities 1mpact Fcc Ralc Schcdule.
CONSlDERA TI0NS: On June 26, 2007, the Board adopted Ordinance No. 2007-57, which
amended Ordinance No. 2001-13 (The Collier County Consolidaled Impact Fee Ordinance) by
adopting the "Collier Count)" ImpaL'l Fcc Indexing Study" and amending lhe impact fee rates
with an etfective dale of January 1,2008.
Slajf has since identilled a scrivener's error in "Schedule Four" of "Appendix A", which is the
"Correctional Facilities Impact Fee Rate Schedule," that inadveJ1ently omitted the rates j,lI' the
land use categories of Church Schuol/CoU,'ge and (;uvC/'l1Il1('nl/l'ublic Buildings.

FISCAL IMPACT: Based on the adopted "Collier Coullty Impact Fc'e Indexing Study" the
Correctional Facilities Impact Fcc rates were increased hy 8.4"'0. Below is a side-by side
comparison of the currenl adopted rales f,\r the specified categories and the indexed rates lhat
were omi1ted and thereror,' the basis ofthc c.crivener's error.

helps to avoid large rate escalations caused by time lapses between ['>rInal studies.
LEGAL CONSIDERATIONS: rhe proposed amendment is legally sufIieielll for Board
consideration and approval.

PROVIDING FOR AN AMENDMENT TO ORDINANCE
NO. 2007-57 TO CORRECT A SCRlVE~ER'S ERROR;
PROVIDING FOR INCLUSION IN THE CODE OF LAWS
AND ORDINAl'\CES; PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING AN EFI<'ECTIVE
DATE.
\VHEREAS, on June 26, 2007, the Board of County Commissioners adopted Ordinance
No. 2007-57, amending Ordinance No. 2(X)}-13, as amended, the Collier County Consolidated
Impact Fee Ordinance, by adopting the "Collier County Impact Fee Indexing Study" and
amending the impact fee rates with an effective date of January 1. 2008; and
WHEREAS, following said action adopting Ordinance No. 2007-:')7, it was detennined
that" Schedule Four" of "Appendix A", which is the "CorrcctioIT'<.'lt- Facilities Impact Fce Rate
Schedule, " inadvertently omitted the rates for the land use categories of Church, School/College
and Government/PuNic Buildings that was othcfVi'isc imendcd and made part of the public
hearing and therefore constitutes a scrivener's error.
