Agenda 01/15/2008 Item #17C --j [,;::1', "ie, f.j ~ Ll. 2'}J8 1 :jf 7 ,.'(.> , - EXECUTIVE SUMMARY Recommendation to approve Petition AVPLAT-2007-AR-12379, Lot 9, Hawksridge, Unit One, to disclaim, renounce and vacate the County's and the Public's interest in a portion of the 10-foot wide drainage easement along the westerly line of Lot 9, Hawksridge, Unit One, a subdivision as recorded in Plat Book 18, Pages 67 and 68 of the Public Records of Collier County, Florida, situated in Section 23, Township 49 South, Range 25 East, Collier County, Florida, and being more particularly described in Exhibit "A", OBJECTIVE: To adopt a resolution to vacate a portion of the 10-foot wide drainage easement along the westerly line of Lot 9, Hawksridge, Unit One, a subdivision as recorded in Plat Book 18, Pages 67 and 68 of the Public Records of Collier County, Florida, situated in Section 23, Township 49 South, Range 25 East, Collier County, Florida, and being more pariicularly described in Exhibit "An CONSIDERATIONS: - Petition AVPLAT-2007-AR-12379, Lot 9, Hawksidge, Unit One, has been received by the Engineering and Environmental Services Department from Howard H. Gust the Petitioner. Mr. Gust intends to build a small addition over 2.5' by 15.54' of the existing 10-foot wide drainage easement leaving a easement width of 75 feet in this area. County staff has determined, because the drainage easement is a perimeter drainage easement being used for a perimeter berm to contain surface water from leaving the site and in light of the fact that the adjoining property has since been developed, each section developed with its own stormwater criteria, and that the stormwater runoff appears to be working properly, and according to design, there is no adverse effect to Collier County by this vacation. Letters of no objection have been received from applicable divisions/entities with the exception of the property to the south. Proof of an attempt of delivery from the U.S. Postal Service has been submitted by the Petitioner. FISCAL IMPACT: Engineering and Environmental Services Department has collected a $1,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated witll this Executive Summary. ENVIRONMENTAL ISSUES: - There are no outstanding environmental issues. HISTORICAL/ARCHAEOLOGICAL IMPACT: There are no historical or archaeological impacts. lEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Resolution and associated legal documents. RECOMMENDA nONS: Adopt the Resolution for Petition A VPLA T -2007 -AR-12379, to vacate a portion of the 10-foot wide drainage easement along the westerly line of Lot 9, Hawksridge, Unit One, a subdivision as recorded in Plat Book 18, Pages 67 and 68 of the Public Records of Collier County, Florida, situated in Section 23, Township 49. South, Range 25 East, Collier County, Florida, and being more particularly described in Exhibit "A".
