EXECUTIVE SUMMARY
Recommendation to approve Petition AVROW-2006-AR-10761 , to disclaim, renounce and
vacate the County's and the Public's interest in two 20' by 30' right-of-way areas along
Alachua Street being originally a part of Monroe Avenue right-of-way as shown on the
Plat known as "Newmarket Subdivision", as recorded in Plat Book 1, Pages 104 & 105 of
the Public Records Collier County, Florida being located within section 34, Township 46
South, Range 29 East, Collier County Florida being more specifically shown in Exhibit A
OBJECTIVE:
To adopt a Resolution to vacate the County's and the Public's interest in two 20' by 30' right-of-
way areas along Alachua Street being originally a part of Monroe Avenue right-of-way as shown
on the Plat known as "Newmarket Subdivision", as recorded in Plat Book 1, Pages 1 04 & 1 05 of
the Public Records Collier County, Florida being located within section 34, Township 46 South,
Range 29 East, Collier County, Florida being more specifically shown in Exhibit A.
CONSIDERATIONS:
Petition AVROW-2006-AR-10761 has been received by the Engineering and Environmental
Services Department from J. Jeffery Rice as agent for one petitioner, Schwab Ready-Mix, Inc
for the northerly 20' by 30' right of way area and from Richard Johnson, as agent for himself, for
the southerly 20' by 30' right of way area.

Letters of no objection have been received from applicable divisions/entities.
FISCAL IMPACT:
Engineering and Environmental Services Department has collected a $1,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAUARCHAEOLOGICAL IMPACT:
There are no historical or archaeological impacts

The County Attorney's Office has reviewed and approved the Resolution and associated legal
documents.
RECOMMENDA nONS:
Adopt the Resolution for Petition AVROW-2006-AR-10761 to vacate the County's and the
Public's interest in two 20' by 30' right-of-way areas along Alachua Street but being originally a
part of Monroe Avenue right-of-way as shown on the Plat known as "Newmarket Subdivision"
thereof, as recorded in Plat Book 1, Pages 104 & 105 of the Public Records Collier County,
Florida being located within section 34, Township 46 South, Range 29 East, Collier County,
Florida being more specifically shown in Exhibit A.
Authorize the Chairman to execute the Resolution and direct the Clerk to the Board to record a
certified copy of the Resolution in the Public Records.

PAGES 104 & 105 OF THE PUBLIC RECORDS OF COLLIER
COUNTY, FLORIDA BEING LOCATED WITHIN SECTION 34,
TOWNSHIP 46 SOUTH, RANGE 29 EAST, COLLIER COUNTY
FLORIDA, BEING MORE SPECIFICALLY SHOWN AND
DESCRIBED IN EXHIBIT A.
WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioners, Schwab
Ready-Mix, Inc., and Mr. Richard Johnson, have requested the vacation of the northerly
portion of a 20' by 30' right-of-way area, and the southerly portion of a 20' by 30' right-
of-way area along Alachua Street being originally a part of Monroe Avenue right-of-way
as shown on the Plat known as "Newmarket Subdivision" , as recorded in Plat Book 1,
Pages 104 & 105 of the Public Records COllierCounty, Florida being located within
section 34, Township 46 South, Range 29 East, Collier County Florida being more
specifically shown in Exhibit A; and
WHEREAS, the Board has this day held a public hearing to consider the
aforementioned vacation request, and notice of said public hearing to was given as
required by law; and
WHEREAS, the granting of the vacation request will not adversely affect the
ownership or right of convenient access of the property owners.
NOW, THEREFORE, BE iT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORiDA, that the County's interest in the
rights-of-way as specifically described in Exhibit 'A' is hereby vacated, extinguished,
renounced and disclaimed, and this actron is declared to be in the Public's interest and
for the Public's benefit.
BE IT FURTHER RESOLVED AND ORDERED that the entire right-of-way as
described in Exhibit 'A' is retained as a utility easement.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of this Resolution in the Official Records of
Collier County, Florida, and to make proper notation of this vacation on the recorded
plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring same,
