EXEcunVE SUMMARY
Recommendation to app.-ove a Mediated Settlem(,nt Agreement and a Stipulated Final
Judgment to he drafted incorporating the same terms and conditions as the Mediated
Settlement Agreement for the acquisition of Parcels 717R, 917, 7] 8R and 918R in the lawsuit
styled Collier County, Florida )'. Duffield W. Matson. Ill, et al., Case No. 05-I054-CA (South
County Regional Water Treatment Wellfield Project #70892). (Fiscal Impact: $55,844.00)
OBJECTIVE: The public purpose is to expand the South County Regional Water Treatment Plant
(SCR WTPl Wellfield by 23 wells to produce sufficient reliable raw water for the prcviously
approved SCR WTP l2-MGD RO Expansion and increase the plant's finished water Reverse
Osmosis (RO) capacity to 20 MGD.
CONSIDERATIONS: On July 25, 2006, Agenda Item JOP.the Board of County Commissioners
awarded contract #06-3992 to John Reynolds & Sons, Inc. for the construction of the SCR WTP 20
MGD Wellfield Expansion Project #70892. The project is included in the 2005 Water Master Plan
Update (Table 8-2, page I line 18) and requires the acquisition of lands along the welltield route to
accommodate the wells and necessary tcmporary construction easements.
Through mediation, the County and Respondents have negotiatcd a settlement for the acquisition of
these parcels in the amount of $40,000 j()r full compensation plus attorney's jees and costs. This
Executive Summmy seeks approval or the Mediated Settlement Agreement and a Stipulated Final
Judgment to be drafted incorporating the S'"11e terms and conditions as the Mediatcd Settlement
Agreement to be presented to thc Court lor the laking 0 r Parccls 71 7R. 917, 7] 8R and 9 I 8R in
Collier C01l11ly, Florida v. Duffield W. MaISOn. !If., ('I al.. Case No. 05- I 054-CA. Thcse parcels are
pm1 of the required land acquisitions f"r this project.
The County acquired the subject propet1y by entry 0 r an Order of Taking on Octobcr 5, 2005 and
subsequently depositcd $ I 5.300 into the registry of the Court. The owners' appraiser valued the
taking at \.67, 100. The difference in values is due to the valuation of Parcel 9 17. which is
encumbered by a road easement. and due 10 owners' claim for sevcrance damages. One of the
County's wclls is being placed Oil the no!1hwcst corner of owners' property, which will be at the
entrance to the parent trClCt. Stein rcconllnends settlement due to exposure f,x additional
compensation and eost avoidance. I r thc,elllcmcnt is approved. 1he COllnty is responsible for the
