Mudd County Manager Date Board of County Commissioners County Manager's Office 1/2/200812:44 PM file://C:\AgendaTest\Export\98-January%20 J 5,%202008\05.%20PRESENT A TIONS\5D\5D... 1/9/2008 Agenda Item No. 50 January 15, 2008 Page 2 of 3 THE COLLIER COUNTY AFFORDABLE HOUSING COMMISSION SUMMARY OF RECOMMENDATIONS FOR CHANGES TO THE IMPACT FEE DEFERRAL PROGRAM Background: On September 11, 2007 Collier County staff presented to the Board of County Commissioners (BCe) five issues relating to the Impact Fee Deferral Program. The BCC directed staff to refer the issues to the Affordable Housing Commission (AHC) to obtain recommendation. Below please find a summary of the five issues and the AHC's recommendations, as discussed at the AHC monthly meetings. ISSUE ONE That the Board consider amending the Rental Unit Impact Fee Program by placing a cap on the amount of Impact Fees that can be deferred for the Rental Unit Impact Fee Deferral Program. AHC - RECOMMENDATION ONE The AHC voted to impose a cap of 225 units per fiscal year for rental unit impact fee deferral. At the BCC meeting on 12/11/2007, under agenda item 80, a cap of 225 units per fiscal year was approved and adopted. ISSUE TWO That the Board consider amending the Rental Unit Impact Fee Program to expressly allow for qualified local government entities (such as the Fire Districts and Co llier County School District) and certain non-profit private entities (such as private hospitals and universities) to purchase individual rental units for qualified employees. AHC - RECOMMENDATION TWO The AHC believes that the provision suggested in Issue Two has been addressed in Issue One. With approval and adoption of agenda item 80 on 12/11/2007, no further action is required on this issue. ISSUE THREE With respect to the Owner Occupied Impact Fee Deferral Program, the Board consider reducing the number of Impact Fee Deferrals a Developer can apply for from the current 50 Deferrals at one time. AHC - RECOMMENDATION THREE The AHC voted to maintain the current status of allowing 50 units per developer at one time. Agenda Item No. 5D January 15, 2008 Page 3 of 3 ISSUE FOUR That the Board eliminate the ability of a Developer to receive an Impact Fee Deferral Refund. ABC - RECOMMENDATION FOUR The AHC voted to permit reimbursement on a first come/first serve basis while looking for a source of revenue to support a greater number of deferments. ISSUE FIVE That the Board provide direction to staff regarding Developers utilizing multiple affordable housing incentives. AHC - RECOMMENDATION FIVE The AHC believes that the layering of multiple programs and revenue sources is a recognized national best practice and an essential part of the solution to providing more affordable housing. Collier County should continue to allow layering.
