EXECUTIVE SUMMARY
V A-2007-AR-12232, Michael T. Traficante, Esqnire, of Grant, Fridkin, Pearson,
Athan and Crown, P.A, representing John Hamilton, requests a 3.9-foot after-the-fact
Variance from the 7.5-foot side yard setback requirement of the RSF-4 Zoning
District. The ",O.13-acre subject property contains a single-family dwelling with a 3.6-
foot side yard setback along its northeastern boundary. The site is located at 85
Shores Avenue, in Section 22, Township 48 South, Range 25 East, Collier County,
Florida
OBJECTIVE:
To have the Board of Zoning Appeals (BZA) consider the above-referenced Variance
petition and render a decision pursuant to Scction 9,01,00 of the Land Development Code
(LDC) in order to ensure that the project is in harmony with all applicable codes and
regulations and that the community's interests are maintained,
CONSIDERATIONS:
The petitioner is requesting an after-the-fact Variance of 3,9 feet from the 7.S-foot side
yard setback for principal structures in the Residential Single-family (RSF-4) Zoning
District, pursuant to Land Development Code (LDC) Section 4,02,01, Setbacks for Base
Zoning Dislricts, to legitimize a 3,6-toot setback along the northeastern propeliy boundary
that has been in existence since 1994,
The O,13-acre subject property is a canal lot located at 85 Shores Avenue, Lot 46 of the
Palm River Shores Subdivision, The applicant, who is the not the Oliginal owner of the
single-family home, purchased the property in 2005, Although the original building pennit
for the dwelling is not on file with the Building Review and Permitting Department, which
is not uncommon for structures built prior to 1980, the year the County converted to an
electronic archival system, an "inspection record card" obtained from the Property
Appraiser's office confinned that the dwelling was permitted in 1973 A "property card"
received from the Property Appraiser's oftice indicated that a pelmit for an "addition" to
the home had been issued in 1994, This pernlit (No, 94-5262) allowed for the addition of a
"340 square-foot screen room with vinyl windows." However, the pelmit automatically
expired six months from the date of its issuance because a Celiificate of Occupancy (CO)
was never granted for the addition, and County staff ofticially canceled the permit from
their computerized project tracking system on August 31,1999,
As side yard setbacks at the time of the single-family dwelling's construction in the early
1970s were five feet, which still would have forbidden the current 3,6-foot setback, it is
staffs opinion that the offending portion of the home is most likely a concrete slab/patio
(which would not have had to respect the setback limits) that was subsequently enclosed,
for which Pennit No, 94-5262 was issued in 1994, A visit to the site confirmed that this
portion of the home, although constructed of masonry rather than screening, was indeed a

not-so-reccnt patio conversIOn that now provides additional living space; and,
coincidentally, has a Door area measuring 340 square feet. Thcrefore, it is both the
applicant's and staffs assessmcnt that this 340 square-foot patio enclosure is most likely
the same addition applied for by the home's 1994 owner. Zoning Ordinance No. 91-102, in
effect at the time, required~as does the present LDC~a 7.5-foot setback along this side
yard, Therefore, tbe applicant is now requesting an after-the-fact Variance of 3.9 feet to
legitimize the existing 3.6-foot setback.
FISCAL IMPACT:
Approval of this Variance petition would have no fiscal impact on Collier County,
GROWTH MANAGEMENT PLAN (GMP) IMPACT:
Approval of this Variance would not affcct or change the requircments of the Growth
Management Plan,
AFFORDABLE HOUSING IMPACT:
Approval oflhis Variancc would have no affordablc housing impact.
ENVIRONMENT AL ISSUES:
There are no cnvironmental issues associated with this Variancc.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION:
The EAC did not review this pclition as they do not nonnally hcar Variance petitions.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The ccpe heard petition VA-2007-AR-12232 on December 20,2007, and believing that
approving the Variance would not be injurious to the neighborhood or detrimcntal to the
public welfare, voted unanimously (7-0) to forward this petition to the BZA with a
recommendation of approval, subject to staff stipulations,
Because the eepe approval recommendation was unanimous and no letters of objection
have been received, this petition has been placed on the Summary Agenda,
LEGAL CONSIDER-\ TIONS:
The petitioner is requesting an after-the-fact Variance to the setback requiremcnt with
respect to a single-family dwelling, The granting of such a Valiance is pem1itted under
LDe Section 9.04,02. The attached staff report and recommendations of the Planning
Commission are advisory only and are not binding on you, Dccisions regarding Variances
are quasi-judicial, and all testimony given must be under oath, Pctitioners have the burden
to prove that the proposed Variance is consistcnt with all the criteria set fOlih below, and

you may question the pctitioners or staff to assure yourself that the necessary criteria have
been satisficd. Should you considcr denying the Variance, to assure that your decision is
not later found to be arbitrary, discriminatory or unreasonable, the denial must be based
upon competcnt, substantial evidence that the proposal does not meet one or more of the
listed criteria below, Approval of this requcst requires three afTinnative votes of the Board.
In granting any Variance, the Board of Zoning Appeals may prcscribe appropriatc
conditions and safcguards in conformity with the zoning code, including, but not limitcd to,
reasonable time limits within which action for which the Variance is required shall be
bcgun or completed, or both, Violation of such conditions and safeguards, when made a
part of the tcrnlS under which the Variance is granted, would be deemed a violation of the
zoning code,
Criteria for Variances
I. There are special conditions and circumstances eXlslIng which arc peculiar to the
location, size, and charactcristics of the land, structure, or building involved,
2. There are special conditions and circumstances which do not result from the action of
the applicant, such as pre-existing conditions relative to the property which is the
subject of the Variance rcquest.
3. A literal interpretation of the provisions of the LDC work unnecessary and undue
hardship on the applicant or create practical difficulties on the applicant.
4. The Variance, if granted, will be the minimum variance that will make possible the
reasonable use of the land, building, or structure and which promote standards of
health, safety, or wel fare,
S. Granting the Variance requested will not confer on the petitioner any special privilege
that is denied by these zoning regulations to other lands, buildings, or structures in the
same zoning district.
6, Granting the Variance will be in hannony with the intent and purpose of the LDC, and
not be injurious to the neighborhood, or otherwise detrimental to the public welfarc,
7. There are natural conditions or physically induced conditions that ameliorate the goals
and objectives of the regulation, such as natural preservcs, lakes, golf course, cte,

GROWTH MANAGEMENT PLAN (GMPI CONSISTENCY:
The site is located in the Urban Residential Land Use Designation of thc Future Land Use Map
(FLUM), The GMP does not address individual Variance requests, but deals with the larger
issue of the actual use, This Variance is being sought for a single-family home located within a
single-family subdivision, As residential uses are an authorized use in this land use designation,
the single-family home is consistent with the FLUM, Therefore, the use on the subject site is
deemed to be consistent with the Future Land Use Elcment of the GMP,
ANALYSIS:
Seetion 9,04,01 of the Land Development Code (LDC) gives the Board of Zoning Appeals
(BZA) the autllOl'ity to grant Variances, TIle Planning Commission is advisory to tbe BZA and
utilizes the provisions of Section 9,04.03 A. through H., in bold font below, as general guidelines
to assist in making a recommendation of approval or denial. Staff has analyzcd this petition
relative to these provisions, and offers the following responses:
A, Al'e thcl'c spccial conditions and cil-cumstances existing, which are peculiar to the
location, sizc and characteristics of the land, structure or building involvcd?
Yes, As shown in the survey on page three of this rcport, the subject parcel is pic-shaped,
which results in the northeastern side yard of the property requiring this Variance to have a
3.6-foot setback at its narrowest point, gradllally broadening to a wider 6.3-foot setback,
As such, the addition's encroachment is indeed 3,9 feet at its worst point of intrusion; hut
progressively diminishes southward to intrude only 1.2 feet into the setback area,
Furthermore, the length of the aberrant side yard (on the northeastern sidc of the property)
measures only 19,7 feet, comprising just 37 percent of the approximately 53-foot lcngth of
the total eastern side yard that separatcs the subjeef dwelling from its neighbor to the east.
The remuinder of this eastern side yard, which measures 33 fect and does not requirc a
Variance (since its setbacks vary between the required 7.5 feet and a generous 18,5 feet),
comprises a mucb larger 63 percent of the total side yard length, Consequently, only a
relatively smail pDltion oftbe overall eastern side yard necessitutes the rcquesfed Variance,
However, the lot is situated in a platted, developed subdivision; and absent this Variance
approval, the petitioner would still have reasonable use of his property,
B. Arc thcre spccial conditions and circumstanccs, which do not rcsult from thc action
of the applicant such as pre-existing conditions rclativc to the propcrty, which is thc
subjcct of the variance request?
Yes, The applicant is not tbe original owner of the properly, which as previously stated,
most likely contained the enclosed patio for 11 years npon his purchase of the home in
2005, From the 1994 sketch submitted with the addition's permit application (see Exhibit
F), it appears the required 7,5-foot setback along the affected side yard was acknowledged
prior to the addition's consh'uction; however, the contractor (or homeowner at the time)
never sought to get a CO for it. NCvcltheless, tbe applicant assumcd that the structure had
been properly permitted upon his purchase of the propelty, Therefore, this condition is pre-
existing,

C. Will a literal interprctation of the provisions of this zoning code wol'l{ unnecessary
and undue hardship on the applicant 01' Cl'eate practical difficulties for the applicant?
If this Variance were not approved, the addition would have to be moved back a distance
varying between 3,9 feet and 1.2 feet. Therefore, a literal interpretation of the setback

provide documentation to the planning seNices department indicating tliat property
owners within 150 feet of the subject site have been advised of the extent and
nature of the variance or parking exemption requested within 30 days of receipt of a
letter indicating that the application is sufficient."
