EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioncrs approve a Rcsolution ccrtifying the
dedication and acceptance of a portion of W cstclox Strect, west of Carson Road, in Immokalee, to
Collier County pursuant to Section 95.361, Florida Statutcs, by \lrtuc ofthe County's continuous
and uninterrupted maintenance of the roadway, and authorize the filing of the appropriate
map(s) with the Clerk ofthc Circuit Court,
OBJECTIVE: To formalize the dedication and acceptance of 2,608.51+/- feet of Westclox Street,
west of Carson Road, in Immokalee, to Collier County pursuant to Section 95.361, Florida Statutes, by
virtue of County's continuous and uninterrupted maintenance of the roadway, and authorize the
certification and filing of the appropriate map(s) with the Clerk of the Circuit Court.
CONSIDERATIONS: Section 95,361, Florida Statutes, provides in part: "2) In those instances
where a road has been constructcd by a nongovenunental entity, or where the road was not constructed
by the entity currently maintaining or repairing it, or where it cannot be detennined who constructed the
road, and when such road has been regularly maintained or repaired for the immediate past 7 years by a
county, a municipality, or the Department of Transportation, whether jointly or severally, such road
shall be deemed to be dedicated to the public to the extent of the width that actually has been maintained
or repaired for the prescribed period, whether or not the road has been formally established as a public
highway."

The portion ofWestclox Street at issue appears on the 1969 plat of Mobile Manor as Westclock Road,
Staff is unable to determine who originally constructed this 60-foot wide right-of-way west of Carson
Road; however, the County's Road Maintenance Departmcnt did coniim1 that it has continuously
maintained Westclox Street for the last ten (10) years. A copy of the Affidavit of David Doman, Senior
Field Supervisor of the Collier County Road Maintenance Dcpartment is included in this agenda item's
backup material, Since this section ofWestclox Street is immediately adjacent to the proposed Collier
County Elementary School "K", the County's formal acceptance of the statutory dedication will
document its ownership in the public rccords and help to facilitate the School District's objectives for
school-related in1provements, such as sidcwalks, within the area of historical maintenance,
Additionally, staff has provided notice and a copy of the proposed Resolution to all owncrs of property
fronting this section ofWestclox Street.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with
this Executive SUll1ll1ary,
FISCAL IMPACT: Payment of the recording fees will be from Transportation Fund 101 within the
Planning Services budget, cost center 1636 I 2,
LEGAL CONSIDERATIONS: The proposed Resolution was prepared by the Office of the County
Attorney and is legally sufficient for consideration by the Board of County Commissioners. JW

shall be deemed dedicated to the public if it is continuously mamtained and repaired by a
county, a municipality, or the Department of Transportation to the extent of the width that
actually has been maint::tined or repaired for the prescribed period, whether or not the road

WHEREAS, in the event the original builder of a road emHlot be Jetemlined, Section
95.361. Florida Statutes requires the continuou:-i and uninterrupted maintenunce by a county,
a municipality, or the Department of TransportatIOn for the immediate past seven (7) years
before such road be deemed to be dedicated [0 the public; ;md
WHEREAS, Collier County has continuously and uninterruptedly maintained
2,608,51+/- feet of a 60-Foot Wide right-oF-way known as Westclox Street (formerly known
as Westclock Road), west of Carson Road, in lmmokalee for the immediate past 10 years,
and as such; said right-of-v,"ay has becn slatutorily dedicaled to CoUier County; and
WHEREAS, the Board of County Commissioners desires to accept and certify the
stalulofY dedication uf this portion of \Vcslelox Street, more particularly described in Exhibit
"A," and aulhorize the filing of the appropriate mapl:;) with the Clerk of the Circuit Court
pursuant to Section 95.361, Florida Statures"
NOW. THEREFORE. BE IT Rf'.SOLVED BY THE BOARD OF COUNTY
COMMJSSIONERS OF COLLIER COllINTY, FLORIDA, that the statutory deulCation of
2,608.51+/- kct of the 60-foot wide right-of-","l.lY known as Wcstelox Street (formerly kno\\'n
