Recommendation to obtain approval to convey a Construction, Operation, and Maintenance
Easement to Florida Power and Light Corporation (FPL) for the purpose of replacing power
poles to facilitate construction of the Gateway Triangle Storm water Improvements Phase 1,
Collier County Capital Project #51803.
OBJECTIVE: To obtain Board of County Commissioners' approval of conveyance of a
Construction, Operation and Maintenance Eascment to Florida Power and Light Corporation
enabling construction commencement of Phase 1 of the Gateway Triangle Stormwater Improvement
Project.
CONSIDERATIONS: The Gateway Triangle is an area bordered by US 41 to the west and south,
Davis Boulevard to the north and Airport Road to the east connecting both to Davis Boulevard and
US 41 in a triangular shape. It is a low-lying area that is almost fully developed and includes a mix
of residential, commercial and light industrial use properties. The Stormwater Improvement project
is intended to correct the serious drainage problems within this portion of East Naples. This project
will provide an increased discharge rate (to reduce flooding) by use of a pump station, as well as
additional water quality improvemcnts by draining a large portion of the area to a detention pond
for treatment. The construction contract award was approved at the BCC meeting of October 23,
2007, to D.L. Higgins Inc.

Currently there are FPL power poles on property where the pond is to be excavated, specifically;
they are next to the existing ditch immediately north of US 41. County Stormwater staff and FPL
personnel have examined the site and agreed upon a new location [or two poles that must be moved.
This location is at the west edge of a parcel purchased by the County to place the detention pond for
this project. FPL hired a surveyor to draw up a legal description and sketch for this location to
establish an easement, and recommends placing their new poles in the easement described to get
them out of the way and facilitate the project's construction process. Stormwater staff is in
agreemenl and plans to begin construction ol'this project in mid-December.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. However
Collier County will be paying $31,660.84 for FPL to perform pole relocating and line re-stringing in
three distinct areas to facilitate the construction.
GROWTH MANAGEMENT IMPACT: There IS no Growth Management Impact associated
with this Executive Summary.
RECOMMENDATIONS: Recommendation that the Board of County Commissioners:
1.
Approve the attached Easement Instrument and authorize the Board Chairman to execute
same on behalf 0 f the Board;
Convey the Construction, Operation and Maintenance Easement from Collier County to
Florida Power and Light Corporation; and authorize County Manager or his designee to
record same in the public records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00
and other good and valuable consideration, the adequacy and
receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents,
successors, and assigns, an easement forever for the
construction, operation and maintenance of overhead and
underground electric utility facilities (including wires,' poles,
guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct,
improve, add to, enlarge, change the voltage, as well as, the
size of and remove such facilities or any of them within an
easement 6 feet in width described as follows:

Together with the right to permit any other person, firm or corporation to attach wires to any facilities
hereunder and lay cable and conduit within the easement and to operate the same for communications
purposes; the right of ingress and egress to said premises at all times; the right to clear the land and
keep it cleared of all trees, undergrowth and other obstructions within the easement area; to trim and cut
and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement
area which might intertere with or fall upon the lines or systems of communications or power
transmission or distribution; and further grants, to the fullest extent the undersigned has the power to
grant, if at all, the rights hereinabove granted on the land heretofore described, over, along, under and
across the roads, streets or highways adjoining or through said property.
IN WITNESS WHEREOF the said Grantor has caused these presents to be executed in its name
by its Board of County Commissioners acting by the Chairman or Vice Chairman of said Board, the day
and year aforesaid.
