EXECUTIVE SUMMARY
(
Recommendation to approve conveyance of an Easement to Florida Power
& Light Company for providing utility services to the expansion of the
Golden Gate Library at 2432 Lucerne Road, at a cost not to exceed $27.00,
Project 54261.1.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) to
approve conveyance of an easement lor the provision 01 electric service lor the
expansion 01 the Golden Gate Library.
CONSIDERATION: The Board, at their November 28, 2006 meeting, approved Agenda
Item 17E authorizing the vacation 01 the County's and the Public's interest in the 46-loot
wide strip 01 Lucerne Road Right-ol-Way immediately to the northwest 01 the Golden
Gate Library, and at their December 12, 2006 meeting approved the expansion 01 the
Golden Gate Library, which requires new pubiic utilities. Library expansion construction
is underway and the attached Easement to Florida Power & Light Company (FP&L) is lor
the installation 01 street lights to service Lucerne Road as required in the Right-ai-Way
permit issued in connection with the construction 01 the Golden Gate Library expansion.
The easement area measures 5 leet in width and comprises a total 01 .07 acres, more or
less, and is shown and described on Exhibit "A" to the Easement. The County will not
be compensated because the Easement is a requirement lor FP&L to provide street
lights pursuant to the Right-ol-Way permit.
A location map is attached lor relerence.
The Easement documents have been reviewed and approved by the Facilities
Management Department and the County Attorney's Office.
FISCAL IMPACT: The total cost will not exceed $27.00 lor recording the three page
Easement. Funds in the amount 01 $27.00 are available in the budget under Project
54261.1.
GROWTH MANAGEMENT IMPACT: Golden Gate Library is inventoried in the Collier
County Growth Management Pian.
RECOMMENDATION: That the Board 01 Collier County Commissioners approves the
attached Easement and authorizes the Chairman to execute the Easement; and also
that the Board directs the County Manager or his designee to proceed to lollow all
appropriate closing procedures and to record the Easement in the Public Records 01
Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Ught Company, its licensees, agents, successors, and assigns, an easement
forever for the construction, operation and maintenance of overhead and underground electric
utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the
voltage, as well as, the size of and remove such facilities or any of them within an easement 5
feet in width, described as foHows:
An FP&L Company easement more particularly described on Exhibit uA" attached hereto and
made a part hereof. Said legal description and sketch prepared by George W. Hackney of
Agnoli, Barber & Brundage, Inc.
Together with the right to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cable and conduit within the easement and to operate the same for
communications purposes; the right of ingress and egress to said premises at all times: the right
to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the
easement area; to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous
trees or limbs outside of the easement area which might interfere with or fall upon the lines or
systems of communications or power transmission or distribution; and further grants, to the
fullest extent the undersigned has the power to grant, if at all, the rights hereinabove granted on
the land heretofore described, over, along, under and across the roads, streets or highways
adjoining or through said property.
