EXECUTIVE SUMMARY
CU-2007-AR-12384, Jon Elsworth, Operations Manager, for Entcrprise Leasing Company,
applicants, representing LH&D Properties, LLC, property owners, are requesting a
Conditional Use to permit an Entcrpdse Rent-A-Car llgency in the Gcneral Commercial
(C-4) Zoning District, as specified per Section 2.04.03 of the Collier County Land
Development Code (LDC), for JlroJlcrty located at the southeast comer of Sunrise
Boulevard and Tamiami Trail NOI.th (lJS-41) intersection furthcr dcscribed as 13560
'l'amiami Trail NOI"th, Suite 8, in Section 15, Township 48 South, Range 25 East, Collier
County, Florida
OB,mCTIVE:
To have the Board of Zoning Appeals (BZA) consider an applieation for a eonditional use to
permit a rental car agcney in a Gcncral Commercial (C-4) Zoning Distriet and to ensure the
project is in harmony with all the applicable codes and regulations in order to make certain that
the community's interests are maintained,
CONSIDERATIONS:
~ The subject 1.8n acre site was developed in accordance with an approved Site Development
Plan, SDP-99-06, for a 17,550 square foot, two-unit commercial building with 92 parking spaces.
The major anchor of this 17,550 square foot retail plaza is the Ree Room Furniture and Games
Store. Enterprise Rent-A-Car would oecupy the 2,248 square foot tenant space formerly
oecupied by Lynne's Consignment.
Ninety-two (92) parking spaces are provided on-site. Only 32 spaees are required by Ordinanee
leaving an excess of 60 spaces as noted on page 4 of II in the attaehed staff report. Enterprise
Rent-A-Car has been designated 16 spaces fill' parking of its lease vehicles. These spaees would
all be primarily loeated in Ji'Ol1t of the Enterprise Rent-A-Car business.
Vehic1es would be washed and fueled off site although minor detailing may oeeur at the rear of
the building. There is an existing six-foot wall and I O-foot wide, Type-B Buffer to the rear of the
site, which separates the lot from the adjacent Caribbean Adult Community Mobile Home Park
as noted on page 4 of 11 in the attaehed staff report.
Currently, the existing Entcrprise Rent-A-Car busincss is locatcd next door, eo-located with the
Circle K Convenience Store at 13556 Tamiami Trail NOlth, and has outgrown its existing space,
Caribbean Adult Community Mobile llome Park runs parallel with the rear property line of both
the existing and proposed Enterprise Rent-A-Cal' locations. However, more protection Ii'om
potential l1uisanees is offered at the new proposed Joeation as thcrc is only a six-foot wooden
fenee with no landseaping behind the existing building location.

Surrounding Land Uses and Zoning: The 1,871: aere subject property is in the General
Commercial (C-4) Zoning District. Thc propcrty is abutted to thc north and cast by Caribbean
Adult Mobile Home Park. South of the property is Circle K Convenience Store and Gas Station
and (the existing) Enterprise Rent-A-Car in the C-4 Zoning District. W cst of the property is a
Lowe's Store, currcntly under eonstruction, in the PUD Zoning District.
Zoning Synopsis: As deseribed in LDC Seetion 2,03.02.D., the purpose and intent of the C-4
district is to provide an opportunity for the most diverse types of eommereial activities delivering
goods and services at a larger scale than would be allowed in the C-l through C-3 distriets. The
outside storage ofmerehandise ,md cquipmcnt is prohibited in C-4 Zoning Districts, exeept to the
extent that it is associated with the commercial activity conducted on-site. This proposal meets
that criteria,
FISCAL IMPACT:
The Conditional Usc (CU), by and of itself, will have no fiscal impact on Collier County, There
is no guarantee that the projeet, at build out, will maximize its authorized level of development,
however, if the CU is approved, a portion of the land could be developed.
The County eolleets impact fees prior to the issuance of building permits to help offset the
impacts of each new development on public facilities. These impaet fees arc used to fund
projeets identified in the CapItal Improvement Element of the Growth Management Plan as
needed to maintain adopted Level of Service (LOS) for publie facilities. Additionally, in order to
meet the requirements of eoneurreney management, the developer of every local development
order approved by Collier County is required to pay 50 pereent of the estimated Transportation
Impact Fees associated with the project. Other fees colleetcd prior to issuance of a building
permit inelude building pcrmit review fces and utility fees associated with conneeting to the
County's water and sewer system.
Please note that the inclusion of impaet fccs and taxcs eollected are for informational purposes
only; they arc not included in the critcria used by Staff and the Planning Commission to analyze
this petition.
GROWTH MANAGEMENT PLAN (GMI') IMI'ACT:
FutUl'C Land Usc Elemcnt (FLUE): The petitioner's properly, as identified on the Future Land
Use Map (FLUM) of the Growth Managemcnt Plan (UMP), is within a Mixed-Use Aetivity
Center Subdistrict, and is located within Aetivity Center H20 as noted in the Future Land Use
Elcment (FLUE). Thc Mixed-Use Activity Center eoneept is designed to concentrate almost all
new eommereial zoning in locutions where truffie impacts ean readily be aeeommodated to avoid
strip and disorganizcd pattel'l1s of commercia] development and to ereate foeal points within thc
community, Activity Centers allow thc full array of eommereial uses (C-l - C-5), The subjeet
site is zoned C-4 and is dcvclopcd. Although the subject requcst is a eonditional use, the
...~~ busincss operation proposed qualifies as a commercial usc and its plaecmcnt within the existing
future land use designation of Mixed-Use Activity Center Subdistrict (within Activity Ccnter

#20) would be consistent with the design and intent of the FLUE as it relates to the subject
designation,
GMP Conclusion: Staff deems the subject CU -2007-AR-12384 to be eonsistent with the FLUE.
Transportation Element:
This Conditional Use ean be eonsidered eonsistent with Policies 5.1 and 5.2 of the
Transportation Element of the GroVl1h Management Plan for the following reasons:
. There is no inerease in trips.
. The projeet proposes a net reduetion in traffic,
Therefore, this projeet is consistent with Policy 5.1 and 5.2 of the Transportation Element (TE).
AFFORDABLE HOUSING IMPACT:
This request contains no provisions to address the Affordable- W orkforee housing demands that it
may create.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMJr:NDATION:
The Envirorunental Advisory Council (EAC) did not hear this petition because an Environmental
Impact Statement (EIS) was not required, and the land had been previously impaeted, Also, the
land was cleared prior to 1975 before the adoption of vegetation elearing permit requirements.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The CCPC heard petition CU-2007-AR-12384 on January 17,2008 and by a vote of 8 in favor
and 0 opposed to recommend forwarding this petition to the Board of Zoning Appeals (BZA)
with a reeol11mendation of approval subject to the following 1It0diJications to the stairs
conditions of approval:
1. The existing landscape buf1ering to the rem- (east) of the subject site, shall be brought

major ehanges to the approved plan, shall require the submittal of a new eonditional
use application, and shall comply with all applieable County ordinanees in effeet at
the time of submittal, including Chapter 10,02.03, Site Development Plan (SDP)
review and approval, of the Collier County Land Development Code, Ordinance 04-
41, as mnended.
5. The Conditional Use is limited to what is shovm on the conceptual site plan,
identified as "Sunrise Ccnter Conditional Use Coneeptual Site Plan," prepared by
Phoenix Plmming & Engineering, Ine., dated June 28, 1999. The site plan noted is
conceptual in nature for Conditional Use approval. The final design must be in
complianee with all applieable federal, state mld county laws and regulations. The
Depmtment of Zoning and Land Development Review Director may approve minor
ehanges in the loeation, siting, or height of buildings, struetures, and improvements
authorized by this Conditional Use, so long as thcsc minor ehanges rcmain consistent
with all applicable development standards.
6. There shall be no anlI2Jified sound of anv kind or nature emitted from the nremises.

Beeause the CCPC approval reeommendation was unanimous and no letters of objeetion

LEGAL CONSIDRRATIONS:
Before you is a rceommendation by the Planning Commission for approval of a conditional use
authorizing a car rental ageney in a C-4 Zoning District. A conditional use is a use that is
permitted in a parlieulur zoning distriet subject to certain rcstrietions. Deeisions rcgarding
eonditional uses arc quasi judicial, and all testimony given must be under oath. The attached
repolt and recommendations of the Plarming Commission required are advisory only and are not
binding on you, Petitioner has the burden of demonstrating that the nccessary rcquirements havc
been met, and you may question Petitioner, or staff, to satisfY yourself that the neeessary criteria
has been satisfied. In addition to meeting the necessary criteria, you may plaee such conditions
and safeguards as you deem appropriate to allow the use, provided that there is eompetent,
substantial evidence that these additional eonditions and safcguards are ncecssary to promote the
public health, safety, welfare, morals, order, eomfort, convenienec, appearanee, or the general
welfare of the neighborhood. As a further condition of approval of the conditional use, you may
require that suitable m'eas for streets, public rights-of-way, sehools, parks, and other publie
facilities be set aside, improved, and/or dedieatcd for public usc, subjeet to appropriate impact

Comprehensive Planning staff has reviewed this request and offered the following COtmnents:
The petitioner's propcrty, as idcntified on the Future Land Use Map (FLUM) of the Growth
Managcment Plan (GMP), is within a Mixed-Use Activity Center Subdistriet, amI is located
within Activity Center #20 as notcd in the Putme Land Use Element (FLUE).
The Mixed-Use Activity Center concept is designed to concentrate almost all new commercial I
.zoning in locations wherc traffic impacts ean readily beaceomlTIodated to avoid strip and
disorganized pallerns of conunercial development and to ereate focal points v,ithin the
eommunity. Activity Centers allow the full anay of eommereial uses (C-l - C-5). The subjeet
site is zoned C-4 and is developed, Thc proposed usc would oeeupy a pOltion of the existing
building and parking lot.
Although the subjeet requcst is a conditional use, the business operation proposed qualifies as a
eommercial use and its plaeemcnt within the existing future land use designation of Mixed-Use
Activity Center Subdistrict (within Acti,ity Center #20) would be consistent with the design and
intent of thc FLUE as it relates to the subject designation.
The following FLUE policies and objectives apply to the subject use with respect to potential site
utilization (note various staff comments italicized and boldcd below):
FLUE Policy 5.4 requires new land uses to be eompatible with the surrounding area..
Comprehensive Planning leaves this determination to the Zoning and Land Development statT as
palt of their review of the petition in its entirety.

CONCLUSION: Staff dcems the subject ClJ-2007-AR-J 2384 to be consistent with thc FLUE,

The other applicable element of the GMP for which a eonsisteney review was made is the:
Transportation Element.
This Conditional Use ean bc considcrcd consistent with Policies 5.1 and 5.2 of lhe
Transportation Elemcnt of the Gro\\'ih Management Plan for the following reasons:

developed with an existing building, parking, lighting, landscaping, and fcneing. A six foot
wall separates the building from the adjacent mobile home parle In addition, there is a 10-
foot wide, Type B buffer along the rear propelty line, The existing Enterprise Rent-A-Car
ageney next door to the subjeet property has been a part of the immediate community since
1997, and there are no pending enforcement eases. There would be improvement over the
existing loeation as there only exists a six foot wooden fence behind the eurrent location and
no landseaping is providcd. Thcre is a six-foot wall and IO-foot, Type B Buffer bchind the I
proposed location.
4. Compatibility with adjacent properties and other property in the district.
The proposed use is compatible with surrounding uses, According to the GMP thc propClty
is designated in a Mixcd Use Aetivity Center Subdistrict, which allows a variety residential
and non-residential land uses, Surrounding the propelty are a Lowe's Store (under
eonstruetion), mobile home park, and Circle K Convenienee store. These nses combined
with the proposed rental car ageney meet the definition of the Mixed Use Activity Center
Subdistrict.
Environmental Advisory Council (EAe) RECOMMENDATION:
The EAC did not review this petition beeause the site is under the size threshold (10 aeres) to
require an Environmental Impact Statement, and the propc/ty is alrcady developed.

the Applicant, was pre~ent, Two Collicr County staff members were prcscnt: Willie Brown
(Prineipal Planner) and Linda Bedtclyon (Community Plalming Coordinator), No members of
the public appeared. The meeting was o[!icially adjourned at 6:20 PM. However, Mr. Ron
Freeman Jr., Gencral Manager of Caribbcan Park 55+ Adult Mobile Home Community, left a
voice mail message for Ms. Bedtelyon. He, according to Ms, Bedtelyon, stated several eonecms
regarding the applicant's "rear wash rack, lighting, trees, hours of operation, and closure of an
emergeney rear entrance access - that is now bloeked with staking", Thc explanation given to
Mr. Freeman was that the physical appearanee of the Sunrise Centcr would remain unchanged.
Vehicles for leasing, howcver, would he parked on the sides and in front of the existing building.
These vehicles would be washed and fueled off-site at a nearby fueling station. Minor detailing
may occur to the rear of the premises. Busincss activities, however, would cease at 6:00pm.
Transportation has researched the emergency vehicle access closure, and found that thc existing
intcrconnection between the mobile home park and Sumise was not required by the
Tran~portation Department; however, intereonnections are encouraged by the County's Growth
Management Plan and Land Development Code. The TranspOJ1ation Depmtment also
supports the existence of the intcrconnection, and would require it to be operational abovc an
'emergency use' status at thc Development Order applieation ~tage. Because there arc no trips
proposed at rear cmcrgcncy aecess drive, no impaets arc noted in Transp0l1ation's rcview. i

RECOMMENDATION:
Staff recommends that the Collicr County Plalming Commission recommend approval of
Petition CU.2007-AR.12384 to the Board of Zoning Appeals subject to the following
eonditions:
1. The existing landseape buffering to the rear (east) of the subject site, shall be
brought up to cun'ent LDC standards for a Type B Buffer where deficient.
2. All minor detailing work or cleaning of vehicles on-site shall not begin before
8:00am and shall eease no later than 6:00pm, 7 days a week.
3. Any changes to the building's outside appearance, including but not limited to
paint colors, trim colors, and signage, shall be arehitecturally unified for the entire
building and site. All ehanges shall be consistent with the County's aI'ehitectural
guidclines and site design requirements.
4. Expansion of the uses identified and approved within this eonditional use
approval, or major ehanges to the approved plan, shall requirc the submittal of a
new conditional use applieation, alld shall comply with all applicable County
ordinances in effect at the time of submittal, ineluding Chapter 10,02.03, Site
Development Plan (SOP) review and approval, of the Collier County Land
Development Code, Ordinance 04-41, as amended.
5, Thc Conditional Use is limited to what is shown on the conceptual site plan,
identified a~ "Sunrise Center Conditional Use Coneeptual Site Plan," prepared by
Phoenix Planning & Engineering, Ine., dated June 28, 1999. The site plaulloted
is conceptual in nature for conditional use approval. The final design must be in
complianee with all applicablc federal, state and county laws ~md regulations.

Conditions:
1. The existing landscape buffering to the rear (east) of the subject site, shall
be brought up to eurrent LDC standards for a Type B Buffer where
deficient.
2. All minor detailing work or cleaning of vehicles on-site shall not begin
before 8:00am and shall cease no later than 6:00pm, 7 days a week.
3. Any ehanges to the building's outside appearance, ineluding but not
limited to paint colors, trim colors, and signage, shall be architecturally
unified for the entire building and site. All ehanges shall be eonsistent
with the County's architeetural guidelines and site design requirements,
4. Expansion of the uses identified and approved within this conditional use
approval, or major ehanges to the approved plan, shall require the
submittal of a new conditional use applieation, and shall eDmply with all
applicable County ordinanees in effeet at the time of submittal, including
Chapter 10,02.03, Site Development Plan (SDP) review and approval, of
the Collier County Land Development Code, Ordinance 04-41, as
amended,
5. The Conditional Use is limited to what is shown on lhe conceptual site
plan, identified as "Sunrise Cenler Conditional Use Conceptual Site Plan,"
prepared by Phoenix Planning & Engineering, Inc., dated June 28, 1999.
The site plan noted is conceptual in nature for conditional use approvaL
The final design must be in eompliance with all applicable federal, slale
and eounty laws and regulations. The Depmtment of Zoning and Land
Development Review Direelor may approve minor changes in the
loeation, siting, or height of buildings, structures, and improvements
authorized by this conditional use, so long as these minor changes remain
consistent with all applleable development standards.

for Conditional Use in a C-4 zone at 13560 Tamiami Trail N, Naples, FL.
Enterprise has been operating a store at the adjacent property to the South for 10+ years, That
store has served us well, but he Circle K convenience store has decided to expand their store,
thus needing our space
We have been working with L H & 0 properties to secure space #8, in the Rec Room Furniture
plaza immediately North, This site makes an easy transition for our customer base, as well as
giving us a much nicer facility with a belter organized parking plan. Our intention is to have 20
assigned parking spaces, 16 in the front with 4 in the back, for parking of rental vehicles and
employee parking. The owners are also going to give us non-exclusive rights to an additional 10
spaces, likely behind the building. The center is equipped with a lotal of 92 parking spaces, more
than enough 10 accommodate both businesses, The Enterprise business model calls for a 91 %
occupancy of the rental fleet at all times. This store currently has approximately 80 units in its
fleet At 91 %, this leaves 8 units not on rent. Of that, there are usually 2 or 3 units that are in the
shop for maintollance, Also, we employ a team of drivers to move any over flow off site. The !
owners of Ree Room have indicated that at anyone time, they may I,ave 10 customers on site. I
This of course mOans tllat the parking lot will likely remain at a maximum of 30% of capacity at all
times.

Conditions:
1. The existing landscape buffering to the rear (east) of the subjeet site, shall be
brought up to eurrcnt LDC standards for a Type B Buffer where deficient.
2. The days of operation shall bc limitcd to Monday through Saturday. Thc daily
hours of operation shall be limited from 7:30a.m. to 6:00 p,m. The tcrm
"operation" ineludes the on-premises washing and interior vacuuming of thc
rental vehicles assoeiated \.vith this vehicle rental conditional use.
3. Any changes to the building's outside appearance, including but not limited to
paint eolors, trim colors, and signage, shall be arehiteeturally unified for the
entire building and site. All ehanges shall be consistent with the County's
arehiteetural guidelines and site design requirements.
4, Expansion of the uses identified and approved within this eonditional use ,
approval, or major ehanges to the approved plan, shall rcquire the submittal of !
a new conditional use application, and shall comply with all applicable
County ordinances in effcet at thc time of submittal, including Chapter
10.02.03, Site Devdopment Plan (SOP) review and approval, of the Collier
County Land Development Code, Ordinance 04-41, as amcndcd.
5, The Conditional Use is limited to what is shown on the conceptual site plan,
identified as "Sunrise Center Conditional Use Conecptual Site Plan," prcpared
by Phoenix Planning & Engineering, Inc., dated June 2S, 1999. The sitc plan
noted is conceptual in nature for conditional use approval. The final design
must be in compliance with all applieable federal, state and county laws and
regulations. The Department of Zoning and Land Development Review
Director may approve minor changes in the IDeation, siting, or height of
buildings, structures, and improvements authorized by this conditional use, so
long as these mlllor ehanges remam consistent with all applieable
development standards.
6. There shall be no amplified sound of any kind or nature emitted fi'om the

Enterprise Rent-a-Car Relocation project. The project is located on the southeast corner of the

RE: CU-2007-AR-12384; ENTERPRISE RENT-A-CAR CONDITIONAL USE
REQUESTED ACTION: To have the Collier County Planning Commission (CCPC) review the
conditions of approval for petition CU-2007-AR-12384 as rendered at the CCPC January 17,2008
meeting along with the attached Resolution and exhibits.
PROJECT STATUS: On January 17, 2008, the CCPC by a vote of 8 in favor and 0 opposed voted
to forward petition CU-2007-AR-12384 to the Board of County of Commissioners (BCC) with a
recommendation of approval subj ect to the following strike through and underline changes to staff's
conditions of approval:
Conditions:
1. The existing landscape buffering to the rear (east) of the subject site, shall be
brought up to current LDC standards for a Type B Buffer where deficient.

8:00am and shall cease He later than 6:00pm, 7 days a week.
The davs of operation shall be limited to Monday through Saturday. The dailv
hours of operation shall be limited from 7:30a,m. to 6:00 p.m. The term
"operation" includes the on-premises washing and interior vacuuming of the rental
vehicles associated with this vehicle rental conditional use.
3. Any changes to the building's outside appearance, including but not limited to
paint colors, trim colors, and signage, shall be architecturally unified for the entire
building and site. All changes shall be consistent with the County's architectural
guidelines and site design requirements.

4. Expansion of the uses identified and approved within this conditional use
approval, or major changes to the approved plan, shall require the submittal of a
new conditional use application, and shall comply with all applicable County
ordinances in effect at the time of submittal, including Chapter 10.02.03, Site
Development Plan (SDP) review and approval, of the Collier County Land
Development Code, Ordinance 04-41, as amended.
5. The Conditional Use is limited to what is shown on the conceptual site plan,
identified as "Sunrise Center Conditional Use Conceptual Site Plan," prepared by
Phoenix Planning & Engineering, Inc., dated June 28,1999. The site plan noted is
conceptual in nature for conditional use approval. The final design must be in
compliance with all applicable federal, state and county laws and regulations. The
Department of Zoning and Land Development Review Director may approve
minor changes in the location, siting, or height of buildings, structures, and
improvements authorized by this conditional use, so long as these minor changes
remain consistent with all applicable development standards.
6. There shall be no amplified sound of anv kind or nature emitted from the premises.
This restriction includes but is not limited to vehicle radios and portable radios.
This petition is scheduled for the BCC's Febraury 26, 2008 meeting.

SUPPLEMENTAL ANALYSIS: The primary concern of the CCPC was to address potential
nuisances of the business related to the wash rack at the rear of the building abutting Carribean Adult
Mobile Home Park. Thus item #2 was modified to limit hours of operation, and item #6 was added to
restrict sounds emanating from the premises including radios,
RECOMMENDATION: Staffreconunends that the CCPC confirm that the modified conditions of
approval attached to the Resolution for Petition CU-2007-AR-12384 are consistent with the CCPC
motion made during their January 17, 2008 meeting.

WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of
Florida, and Chapter 125, Florida Statutes. has conferred on Collier County the power to
establish. coordinate and enforce zoning and such business regulations as are necessary for the
protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-4-1. as amended) which includes a Comprehensive Zoning Ordinance
establishing regulations for the zoning of particular geographic divisions of the County, among
which is the granting of Conditional Uses; and
WHEREAS, the Board of Zoning Appeals has held a public hearing and has considered
the advisability of a Conditional Use for a automobile rental agency in the General Commercial
(C-4) Zoning District, pursuant to Land Development Code Section 2.04.03, Table 2, on the
property described in Exhibit "B", and has found as a matter of fact (Exhibit "An) that
satisfactory provision and arrangement have been made concerning all applicable matters
required by said regulations and in accordance with Section lO.08.00.D of the Land
Development Code, as amended; and
WHEREAS. all interested parties have been given opportunity to be heard by this
Board in a public meeting assembled and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED by the Board of Zoning Appeals of Collier
County, Florida, that:
Petition CU-2007~AR-I2384, filed by Enterprise Leasing Company d/b/a Enterprise
Rent-A-Car, with respect to the property described in Exhibit "B," attached hereto and
incorporated by reference herein, is hereby approved for a Conditional Use pursuant to Section
2.04.03. Table 2, of the Collier County Land Development Code in the General Commercial
