EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway (private) and
drainage improvements for the final plat of Grey Oaks Unit Eleven, the
roadway and drainage improvements will be privately maintained.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Grey Oaks Unit Eleven.
CONSIDERATIONS:
1, On March 2, 1998, the Board of County Commissioners granted
preliminary acceptance of the roadway and drainage improvements in
Grey Oaks Unit Eleven.
2. The roadway and drainage improvements will be maintained by the
project's homeowners association.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. According to PUD Monitoring, this PUD has been found to be in
"substantial compliance".
6. The developer is still in control of the Homeowner's Association and has
provided an approval letter on behalf of the Association. The developer
was not able to obtain a letter from a resident of the neighborhood.
7. On May 13, 1997 the Board entered into a Construction and Maintenance
Agreement for Subdivision Improvements with the developer. The
developer has fulfilled his obligations with respect to the Construction and
Maintenance Agreement.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association.

GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency.
RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage improvements in Grey Oaks Unit Eleven and release the
maintenance security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

RESOLUTION NO. 08-_
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTHORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN GREY OAKS
UNIT ELEVEN, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 28,
PAGES 45 THROUGH 46; RELEASE OF THE
MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY THE
GREY OAKS PROPERTY OWNER'S
ASSOCIATION, INC.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
May 13, 1997 approved the plat of Grey Oaks Unit Eleven for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-41, as
amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
WHEREAS, the Engineering Services Section of the Development Services
Department has inspected the roadll,'ay and drainage improvements, and is recommending
acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORlDA, that final acceptance is hereby
granted for those roadway and drainage improvements in Grey Oaks Unit Eleven,
pursuant to the plat thereof recorded in Plat Book 28. pages 45 through 46, and the Clerk
is hereby authorized to release the maintenance security.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required to be maintained by the Grey Oaks Property Owner's
Association, Inc.
This Resolution adopted after motion, second and majority vote favoring same,

Dear Stan,
We have received final inspection approval from Mr. Darryl Hughes, Engineering Inspector, for
Grey Oaks Units of Development II, 17 and 18 and have requested County's final acceptance
of the required subdivision improvements. We also received a letter from Mr. John Houldsworth
requesting a letter from the Property Owners Association that owns the improvements
acknowledging that the Association understands the functions of the surface water management
system and that it is responsible for the maintenance of the roads, storm water management,
sidewalks and any other plat-dedicated improvements.
Please be advised that I am the President of the developer controlled Grey Oaks Property
Owners Association the owner of all improvements included in the abovementioned Grey Oaks
Units of Development 11, 17 and 18. These Units of Development consist of the roadways
within the Palm Island community and of the two sections of Grey Oaks Drive South that
connects the main Grey Oaks loop road, Grey Oaks Drive South, and Livingston Road.
I hereby certify that this Association will be responsible for the maintenance of all roads, storm
water management systems, sidewalks and all other plat dedicated improvements and
additionally that the residents of Grey Oaks will be fully informed of the operation of the system
and of the maintenance responsibility of the Grey Oaks Property Association prior to its
twnover to their control.
We respectfully request the County grant final acceptance of the required subdivision
improvements in Units of Development II, 17 and 18 and the performance bonds posted to
guarantee these improvements be released.
