Agenda 03/11/2008 Item #10C Agenda Item No. 10C March 11. 2008 Page 1 of 18 EXECUTIVE SUMMARY Recommendation to approve Work Order #SCD-FT-3850-08-03, "Courthouse 5th and 6th floor redesign", retroactive to the Notice to Proceed date of January 18, 2008, to Spillis Candela DMJM to provide for architectural design services for the design of the 5th and 6th floors of the Collier County Courthouse located at 3301 Tamiami Trail East in the amount of $715,680. OBJECTIVE: To obtain approval from the Board of County Commissioners on Work Order #SCD-FT-3850-08-03, "Courthouse 5th and 6th floor redesign" to Spillis Candela DMJM, retroactive to the Notice to Proceed date of January 18, 2008, to provide for architectural design services for the 5th and 6th floors of the Collier County Courthouse located at 3301 Tamiami Trail East in the amount of $715,680. CONSIDERATIONS: Currently, Collier County Government is in the process of constructing a seven-story Courthouse Annex Building which will house various Court-related functions currently occupying space on the 5th and 6th floors of the Collier County Courthouse (Building L), on the Main Government Complex. Once these services are moved, the Government Center Master Plan calls for the creation of additional Courtrooms to fill these office spaces. The recommendation to award is twofold; 1. The work order number was issued on December 6, 2007, the subsequent Notice to Proceed was issued on January 18, 2008 and, 2. Subsequent to these events, staff recognized that the work order and notice to proceed had been inadvertently issued without Board approval. The recommendation to approve the work order will be retroactive to the Notice to Proceed date of January 18, 2008. FISCAL IMPACT: The total cost of this redesign is $715,680. This project was submitted and approved for in the FY07-08 Budget under the Court Facilities Fee Fund 181 (non-advalorem). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. The Consultant shall provide Program Verification services to conceptually address the recommended short term (approximately five year planning horizon, 2012) uses for the existing courthouse. Consultant will meet with the Judiciary, Court Administration, and the Probation Department to determine the uses for the 51h and sixth floors and to verify the use of the existing 1 'I floor probation space and the proposed 151 floor Probation space. The design of the 151 floor space is not a part of this scope and is a part of a separate contract. The Consultant shall provide recommendations and an outline program of the proposed uses for the renovated areas of the 51h and 61h floors. The Consultant shall review the previously proposed uses for the 1 sl floor space and provide an outline program of the proposed uses. The proposed scope includes the demolition of the Clerk of Court space on the 5th floor and the design for new jUdicial suites and/or an expansion of the jury assembly room (approximately 5,400 SF) or other associated uses. It is assumed that the Court Administration, public corridors/lobbies/restrooms. and the main jury assembly/restroom areas will remain as is and are not included in the scope for the 51h floor. Issuance of an ITC (Instructions to the Contractor) during construction phase services to replace existing finishes to match existing, in the public areas, is included in Basic Services. The proposed scope includes the demolition of the Clerk of Court civil and criminal space on the 6th floor and the design of new courtrooms and judicial chambers (approximately 18.800 SF). The number and size of courtrooms and hearing rooms will be determined during the Program Verification phase. It is anticipated that the courtroom/hearing room/chamber layouts will be based on a combination of the existing courtroom/hearing room layouts currently existing. The design of courtroom and chamber fixed millwork including judges and clerks benches, jury boxes, courtroom rails, witness stands, and chamber shelving is included as part of Basic Services. The design of the millwork, finishes, and detailing of the courtrooms and chambers will be based on those of the existing courtrooms to ensure continuity and flexibility in assignment of courtrooms. Collier County is to provide as built documentation of the existing building. including architectural, structural, electrical. and mechanical systems. Security system design and specifications will be coordinated with the County's preferred security systems vendor. Consultant to provide conduit, raceways, and power as required for proposed design. Consultant will review and coordinate security devices location and requirements with Owner. Consultant will coordinate with Owner to incorporate the Owners security requirements for the contractor into the project manual. Consultant scope will include the design and layout of the Fire Alarm devices required for the renovated spaces only. The owner provided as-built drawings will accurately identify the existing Fire Alarm Systems layout along with its overall capacity, indicating capacity used for areas to be demoiished and areas to remain. The Consultant understands at the time of this Proposal the County has begun a total Fire Alarm System replacement installation in the Collier County Courthouse, and those system drawings and data will be made available for the Consultant's use. In the event the replacement does not occur. this proposal does not include upgrades to the existing fire alarm system of the courthouse (other than the devices for the renovated portions of the 51h and 61h floors). Any upgrades to the existing fire alarm system out side the limits of the Scope of Work, or as required by the AHJ for Permit, would be considered an additional service. Owner fees, testing and administration (1.75%) $ 715.680.00 $ 147.345.00 Total AlE and County Administrative Fees: $ 863.025.00 Estimate of Total Project Cost: $ 9,282,765.00 The square footage cost utilized for the conceptual project budget for this proposal is based on $20/SF for demolition costs, $142/SF for the 5th floor office renovation, and $360/SF for the 6th floor courtroom renovation. The office renovation cost is based on the October 2007 GMP of approximately $118/SF build-out cost for the Annex 4-7'h floors office build-out, plus 1.5 years escalation at 9% total to a March, 2009 mid-point of construction, plus a 10% renovation factor. The courtroom renovation estimated cost is based on the $300/SF renovation cost for the 4th floor courtroom renovations GMP of February, 2006 plus 20% escalation to a March, 2009 mid-point of construction. Note: FF&E, IT, Voice/Data, and owner move/relocation costs are not included in Project Cost Estimate. These conceptual project budget costs assume that construction work will have to be accomplished at night or on weekends. Permitting/Construction Administration - 52 weeks est. $ 214.700.00 Total Fee $ 715,680.00 BASIC SERVICES: SCHEMATIC DESIGN Based upon the mutually agreed-upon Project program, schedule and budget by OWNER and CONSULTANT, CONSULTANT shall prepare. Schematic Design Documents in compliance with OWNER'S design guidelines for approval by OWNER. OWNER'S acceptance of Schematic Design Documents in no way relieves CONSULTANT of its obligation to deliver complete and accurate documents necessary for successful construction of this Project. All Schematic Design Documents prepared by or for CONSULTANT are subject to OWNER'S review and approval. At completion of the Schematic Design Phase, CONSULTANT shall submit the Schematic Design Documents to the Project Manager for review and comment. CONSULTANT shall respond in writing to the review comments within 7 calendar days of receipt. Responses shall be forwarded directly to the OWNER'S Project Manager. CONSULTANT shall revise the Schematic Design Documents as required by OWNER in order to obtain OWNER'S written approval and authorization to proceed to the Design Development Phase. DESIGN DEVELOPMENT After OWNER'S review and approval of the Schematic Design Documents and issuance of OWNER'S written authorization to proceed, CONSULTANT shall commence the Design Development services and perform the following: Develop design documents to a level of definitiveness and detail to fix and describe the size and character of the various Project components and each Project discipline and system as may be appropriate for this stage of development, including long lead and special order materials and equipment. Continue developing the architectural, civil. structural, mechanical, electrical, security, and other discipline's responsibilities that establish the scope and details for that discipline's work. All Design Development Documents prepared by or for CONSULTANT are subject to OWNER'S review and approval At completion of the Design Development Phase, CONSULTANT shall submit the Design Development Documents to the Project Manager for COLLIER COUNTY GOVERNMENT CENTER COURTHOUSE RENOVATIONS FLOORS 5 AND 6 3 Agenda Item No.1 DC March 11, 2008 Page 8 of 18 review and comment. CONSULTANT shall respond in writing to the review comments within 14 calendar days of receipt. Responses shall be forwarded directly to the OWNER'S Project Manager. CONSULTANT shall revise the Design Development Documents as required by OWNER in order to obtain OWNER'S written approval and authorization to proceed to the Construction Documents Phase. CONSTRUCTION DOCUMENTS After OWNER'S review and approval of the Design Development Documents and issuance of OWNER'S written authorization to proceed, CONSULT ANT shall commence the Construction Documents selVices and perform the following: Prepare final calculations, Construction Documents setting forth in detail each discipline's requirements into a cohesive whole based upon the approved Design Development Documents and consultations with OWNER'S Project Manager. All Construction Documents prepared by or for CONSULTANT are subject to OWNER'S review and approval. At compietion of the Construction Documents Phase, CONSULTANT shall submit the Construction Documents to the Project Manager for review and comment. CONSULTANT shall respond in writing to the review comments within 7 caiendar days of receipt. Responses shall be forwarded directiy to the OWNER'S Project Manager. CONSULTANT shall revise the Construction Documents as required by OWNER to obtain OWNER'S written approval of such documents. BIDDING CONSULTANT shall cooperate with and assist OWNER during the Bidding Phase as hereafter provided with respect to the selection of the Contractor: CONSULTANT shall provide the OWNER'S Project Manager with one electronic copy of the Construction Documents and all other bidding documents prepared by or for CONSULTANT. The documents provided will be consistent with a format required by Collier County Purchasing for issuance of the Project Bid Documents. CONSULTANT shall assist OWNER in reviewing, evaluating and advising OWNER regarding bids. CONSULT ANT shall attend the pre-bid conferences and shall be responsible for developing and providing to OWNER any addenda to the Contract Documents that result from those conferences. The CONSULTANT shall make a written recommendation to the OWNER with respect to the OWNER entering an agreement with the apparent Successful Bidder. CONSULTANT shall prepare any required addenda to the Construction Documents, submit addenda for OWNER review and approval, and distribute all required copies to all necessary parties as determined and approved by OWNER. CONSULTANT shall respond only to questions or requests for clarifications concerning the Construction Documents submitted in writing by OWNER. Written questions by bidders during bidding shall be answered by the CONSULTANT through the issuance of an Addenda through the Owner's Project Manager. CONSTRUCTION CONSULTANT shall keep OWNER apprised of all contacts and/or communications between CONSULTANT and Contractor. OWNER shall be copied on all correspondence between COLLIER COUNTY GOVERNMENT CENTER COURTHOUSE RENOVATIONS FLOORS 5 AND 6 4 Agenda Item NO.1 OC March 11, 2008 Page 9 of 18 CONSULTANT and Contractor. All contacts and/or communications between CONSULTANT and the various subcontractors shall be routed through Contractor. During the Construction Phase. CONSULTANT shall provide the following seIVices: . Process, review, respond and distribute shop drawings. product data, samples, substitutions and other submittals required by the Construction Documents within five (10) business days, . Maintenance of a master file of all submittals, including submittal register, made to CONSULTANT, with duplicates for OWNER. OWNER'S copy shall be in electronic/CD format and submitted at time of Substantial Completion, . Construction field obselVation seIVices consisting of visits to the Project site as frequently as necessary, but not more than (once every two weeks). to become generally familiar with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Construction Documents, When CONSULTANT discovers portions of the Work which do not conform to the Construction Documents. CONSULTANT shall recommend to Owner to reject such Work, Provide a written report of each visit. within five (5) business days from the CONSULT ANT'S site visit, to the OWNER'S Project Manager. This field obselVation requirement shall apply to any sub consultants or subcontractors of CONSULTANT at appropriate construction points, . CONSULTANT, as representative of OWNER during construction, shall advise and consult with OWNER, Through its on-site obselVations of the Work in progress and field checks of materials and equipment, CONSULTANT shall endeavor to provide protection for OWNER against defects and deficiencies in the Work of Contractor and the various subcontractors of Contractor, . Prior to the first Application for Payment, the CONSULTANT shall review the Contractor's Schedule of Values and recommend adjustments, Based on such obselVations at the site and on the Applications for Payment submitted by the Contractor, CONSULTANT shall recommend the amount owing to Contractor and shall acknowledge the Application for Payment initially completed by the Contractor for such amounts, The issuance of Certificate of Payment shall constitute a representation by CONSULTANT to OWNER that: (i) the Work has progressed to the point indicated; (i1) that to the best of CONSULTANT'S knowledge, information and belief, the quality of the Work is in accordance with the Construction Documents subject to minor deviations from the Construction Documents correctable prior to completion, and to any specific qualifications stated in the Application for Payment; and (iii) Contractor is entitled to payment in the amount certified, . CONSULTANT shall review claims for extra compensation, or extensions of time from Contractor, make written recommendations to OWNER within five (5) business days concerning validity, and prepare responses for OWNER, . CONSULTANT shall be, in the first instance, the interpreter of the requirements of the Construction Documents, CONSULTANT shall render opinions on all claims of Contractor relating to the execution and progress of the Work and on all other matters or questions related thereto, CONSULTANT'S decisions in matters relating to artistic effect shall be final if consistent with the intent of the Construction Documents, subject to OWNER'S approval. CONSULTANT shall review for comment or approval any and all proposal requests, COLLIER COUNTY GOVERNMENT CENTER COURTHOUSE RENOVATIONS FLOORS 5 ANO 6 5 Agenda Item No. 10C March 11, 2008 Page 10 of 18 supplemental drawir:lgs ana information, substitutions, value engineering suggestions and change orders. . Prepare, reproduce and distribute supplemental drawings, specifications and interpretations in response to requests for clarification by Contractor or OWNER as required by construction exigencies. CONSULTANT'S response to any such request must be received by OWNER and Contractor within five (5) business days. CONSULTANT will review and respond to all submittals from Contractor, including but not limited to shop drawings, within a reasonable period of time so as not to delay the progress of the Work, but in no event, more than five ( 10) business days, unless OWNER expressly agrees otherwise in writing. Review of Contractor's submittals is not conducted for the purpose of determining the accuracy and completeness of other details, such as dimensions and quantities, or for substantiating instructions for installation or performance of equipment or systems, all of which remain the responsibility of Contractor as required by the Contract Documents. CONSULT ANT'S review shall not constitute approval of safety precautions or, unless otherwise specifically stated by CONSULTANT, of any construction means. methods, techniques, sequences or procedures. CONSULTANT'S approval of a specific item shall not indicate approval of an assembly of which the item is a component. . CONSULTANT shall review and provide written comment upon all Change Orders requests by the Contractor, as well as any cost estimate associated with a Change Order request, prepared by Contractor. Upon agreement by the OWNER, the CONSULTANT shall prepare and provide Work Change Directives to the OWNER for approval and issuance to the Contractor and revise the Construction Documents accordingly. . CONSULTANT shall review the Project schedule, subcontractor construction sChedule(s), schedule(s) of shop drawing submittals and schedule(s) of values prepared by Contractor and advise and/or recommend in writing to OWNER concerning their acceptability. . CONSULTANT shall attend meetings with Contractor, such as preconstruction conferences, progress meetings, job conferences, pre-closeout meetings and other Project-related meetings. . Receive notice from Contractor if other work related to the Project by OWNER'S own forces, by utility owners. or by other direct contractors will involve additional expense to Contractor or require additional time and promptly advise OWNER in writing. . Receive copies of all accident reports submitted by Contractor. . Review the Work to confirm that to the best of our knowledge the plans and facility comply with the current Florida Building Code. Report any discrepancies observed or noted to OWNER. The applicable building permit office will prepare and issue the Certificate of Occupancy at the appropriate time to the Contractor, on the form approved by OWNER . CONSULTANT shall assist in the OWNER'S Project closeout process. Upon notice from Contractor, and with the assistance of OWNER, CONSULTANT shall conduct the Substantial Completion inspection and if appropriate issue the Certificate of Substantial Completion. Review and comment upon, and supplement as appropriate. the punch lists to be prepared by Contractor. Notify Contractor in writing of work not complete. Upon notice from Contractor, conduct final inspections and assist OWNER in final acceptance of Project If appropriate, issue the Certificate of Final Inspection on the form approved by OWNER . Throughout the Construction Phase, CONSULTANT shall review Contractor's marked-up "Record" drawings and Project Manual/Specifications, on a regular basis, and at least monthly prior to certification of Contractor's monthly payment application, to verify that Contractor is regularly updating the "Record Drawings," After Contractor provides CONSULTANT with its marked-up "Record" drawings and specifications, CONSULTANT will revise the final approved Construction Documents to incorporate all "Record" information contained in the Contractor's marked-up "Record" drawings and specifications, as well as to reflect all addenda, contract changes and field changes. CONSULTANT shall provide OWNER with one (1) electronic copy on compact disk (CD) of the Record Documents, two sets of the conformed drawings. The electronic copy on CD of the Record Documents shall be provided in AutoCAD,dwg format, "purged and bound", and compatible with OWNER'S system Contents of CONSULTANTS Record drawings are conditioned upon the accuracy of the information and documents provided by the construction contractor. As part of project Close Out CONSULTANT shall schedule via OWNER and visit with OWNER and Contractor the facility at initial occupancy and at six (6) and eleven (11) months after issuance of the Certificate of Substantial Completion. During each facility visit, CONSULTANT shall obseNe. troubleshoot and advise in the operation of building systems. This shall not relieve CONSULTANT of its obligation to make other visits to the facility based on need should specific issues arise, SERVICES RELATING TO ALL PHASES: Notwithstanding any other provision of this Agreement, the CONSULTANT and subconsultants shall have no responsibility for the discovery, presence. handling. removal, disposal or exposure of persons to hazardous materials in any form at the project site, including but not limited to asbestos, asbestos products, mold, polychlorinated biphenyl (PCB) or other toxic substances, Notwithstanding anything in this Agreement. CONSULTANT shall not have control or charge of and shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety measures, precautions and programs including enforcement of Federal and State safety requirements, in connection with construction work performed by OWNER'S construction contractors, ADDITIONAL SERVICES: The seNices described below are not included in Basic SeNices unless so identified previously in this work order, and they shall be paid for by the OWNER as provided in this agreement, in addition to the compensation for Basic SeNices. The seNices provided below shall only be provided if authorized in writing by the OWNER. Assist OWNER and Contractor in the training of the facility operation and maintenance personnel with respect to the proper operations, schedules, procedures and inventory controls for the various Project equipment and systems. Such assistance shall include assisting OWNER in arranging for and coordinating the instruction and training on operations and maintenance of the Project's equipment and systems in conjunction with the various manufacturer representatives. Further, CONSULTANT is to attend all such training sessions, unless otherwise consented to by OWNER in writing. . Submit a facility and equipment review schedule to OWNER at the time of Substantial Completion. Perlorm reviews of facilities and equipment prior to expiration of warranty period(s) to ascertain adequacy of perlormance, materials, systems and equipment. Submit a written report to OWNER . If more extensive representation at the site than is described is required, the architect shall provide one or more project representatives to assist in carrying out such additional on-site responsibilities. . Making revisions in Drawings, Specifications of other documents when such revision are: a. inconsistent with approvals or instructions previously given by the Owner, including revisions made necessary by adjustments in the Owner's program or Project Budget. b. required by the enactment or revision of codes. laws or regulations subsequent to the preparation of such documents; or c. due to changes required as a result of the Owner's failure to render decisions in a timely manner. . Providing services required because of significant changes in the Project including, but not limited to, size, quality, complexity, the Owner's schedule. or the method of bidding or negotiating and contracting for construction. . Providing consultation concerning replacement of Work damaged by fire or other cause during construction, and furnishing services required in connection with the replacement of such Work. . Providing services made necessary by the default of the Contractor, by major defects or deficiencies in the Work of the Contractor or by failure of perlormance of either the Owner or Contractor under the Contract for Construction. . Providing documents in connection with public hearing, arbitration proceeding or legal proceeding except where the Architect is party thereto. . Providing financial feasibility or other special studies. . Providing special surveys, environmental studies and submissions required for approvals of governmental authorities or others having jurisdiction over the project. Providing detailed estimates of Construction Cost or detailed quantity surveys or inventories of material, equipment and labor. . Providing analyses of owning and operating costs. . Providing loose furnishings and equipment selections and specifications. Consultant as part of Basic Services will review and comment on loose furnishings and equipment. fabrics and colors selected by others. however making investigations. inventories of existing materials or equipment, or valuations and detailed appraisals of existing facilities are considered beyond Basic Services. . Providing assistance in the utilization of equipment or systems such as testing, adjusting and balancing, preparation of operation and maintenance manuals, training personnel for operation and maintenance, and consultation during operation. . Providing services after issuance to the Owner of the final Certificate for Payment. or in the absence of a final Certificate for Payment, more than 60 days after the date of Substantial Completion of the Work. . Providing services of consultants for other than architectural. structural, mechanical, electrical engineering as part of Basic Services. Upon the Notice to Proceed issued by OWNER. the Program Verification/Schematic Design documents shall be submitted to OWNER within (10) weeks after the date of such Notice. 2. Upon authorization by OWNER to commence the Design Development service, the Design Development Documents shall be submitted to OWNER within 8 weeks after the date of such authorization. 3. Upon authorization by OWNER to commence the Construction Document service, the Construction Documents will be submitted to OWNER within 12 weeks after authorization to commence. 4. Permitting Phase Services and Construction Administration to be provided in accordance with the terms of the Construction Contract and the Project Construction Schedule, estimated at 52 weeks.
