EXECUTIVE SUMMARY
Recommendation for the Community Redevelopment Agency to approve an Agreement
with Florida Power and Light (FP&L) for the installation and service of lights on existing
power poles south of Thomasson Drive along the Baysbore Drive corridor; autborize tbe
CRA chairman to execute the Agreement on behalf of tbe Board; approve and authorize
the CRA Executive Director to makc paymcnt from the Bayshore Gateway Triangle CRA
Fund 187 for the costs of installation and associated monthly fees. (Fiscal Impact
$10,250.00 over 10 years).
OBJECTIVE Recommendation for the Community Redevelopment Agency to approve an
Agreement with Florida Power and Light (FP&L) for the installation and service of lights on
existing power poles south of Thomasson Drive along the Bayshore Drive corridor; authorize the
CRA chairman to execute the Agreement on behalf of the Board; approve and authorize the CRA
Executive Director to make payment from the Bayshore Gateway Triangle CRA Fund 187 for
the costs of installation and associated monthly fees,
BACKGROUND: As cited in the Bayshore Gateway Triangle Master Plan, there is a provision
for the creation of CRA programs that focus on particular needs and opportunities of each
neighborhood and to provide services that can affect the community. The Neil1hborhood Focus
Initiative program objectives:
. Support of Neighborhood Organizations for planning and action on a variety of fronts
such as community policing, clean-up activities, informational workshops, home
ownership programs, finance and employment counseling, etc.
. Code: Enforcement: Vacant property cleanup, removal abandoned automobiles,
building code, zoning codes, parking, etc.
. home improvement loan programs
. Infrastructure improvements: drainage, utilities, sidewalks, street pavmg and repairs,
street lighting etc.
. Neighborhood School programs and activities
. Community School programs and activities
. Community development corporation
. Acquisition of vacant and dilapidated sites, and of tax delinquent properties
. Home-builder/developer orientation programs.

CONSIDERATIONS: A request was made to the Bayshore/Gateway Redevelopment Agency
to address the lack of lighting along the south segment of Bayshore Drive for security and safety
reasons. Currently there are a couple of sites along this segment of Bayshore Drive that have
similar lights attached to power poles, but overall there is minimal lighting for this street
(examples of lights Exhibit "A"). The CRA staff identified seven intersections having existing
power poles that could possibly accommodate street light attachments. The CRA staff contacted
FP &L and they concurred that lights could be installed at the locations identified. FP &L
provided the CRA with a cost estimate, inclusive of installation and associated monthly power
fees. At the request of rp&L a letter of no objection was issued by John W, Miller, Projed

The Agreement is for a term often (10) years from the date of initiation of service and the annual
estimated cost to provide service to the seven lights is $9,181.20, A breakdown of the total cost
of the project is as follows:
The initial cost of installation = $1,068.33, estimated cost of monthly service = $10.93 per pole,
seven (7) poles x 10,93 per month = $76.51 per month, $76.51 x 12 months = $9] 8.12 per year.
Initial cost of installation = $1,068.33
The estimated cost to provide service for] 0 years = $918.12 x ] 0 years = $9,] 81.20
Total estimated cost of the project =
$10,250.00
The CRA contacted and surveyed the adjacent property owners, and there were no objections
(Exhibit "C"). The Local CRA advisory Board voted unanimously to forward the FP&L
Agreement to the CRA Board with a recommendation for approval.
FISCAL IMPACT: Funds in the total amount of $10,250 for the costs of installation and
associated monthly fees will be budgeted over ten years. The estimated cost to the FY08 budget
is $1,450.88 and is available in the Bayshore Gateway Triangle eRA Fund (187). Source of all
funds are in Fund (187) tax incremental finance revenues.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Plan impacts
RECOMMENDATION: That the CRA:
1. Approve the attached Agreement;
2. Authorize the CRA Chairman to execute same on behalf of the Board;
3. Authorize the CRA Executive Director to make payment of all costs and expenses
necessary to for the project from CRA Fund (187),

Upon the request of property owners in your neighborhood the Bayshore/Gateway Community
Redevelopment Agency (CRA) identified seven intersections along Bayshore Drive south of
Thomasson to receive street lights.
The CRA Advisory Board unanimously voted to totally fund this project (at no cost to you) in order
to address the lack oflighting in your neighborhood and help alleviate security and safety issues. The
proposed light fixtures will be attached to power poles located in the right-<lf-way at the comer of the
following intersections:
Woodside Avenue
Andrews A venue
Pine Tree Drive
Colonial Drive
Karen Drive
Cottage Drive.
One of the sites chosen is located in the right-of-way at the corner of your property and therefore we

That, for and in consideration of the covenants set forth herein, the parties hereto covenant and agree as follows;
FPL AGREES:
1. To install or modify the street lighting faolilles descnbed and Jdentified above (hereinafter called the Street Lighting System), fumish to the
Customer the electrtc anefQY necessary for the operation of the Street Ughting System, snd furnish such other services as are specified in this
Agreement. all in accordance with the terms of FPL's currently effectrvs street lighting rate schedule on file at the Florida Public Service
Commission (FPSC) or any successive street lightil'lg rate schedule approved by the FPSC.
THE CUSTOMER AGREES:

TO pay a contribution in the amolJnt of $~ prior to FPl's initiating the ,equested installation or modification.
To purchase from FPL all of the electric energy used for the operation of ttJe Street Lighting System.
To be responsible tor paying, when due. all bills rendered by FPl pursuant to FPL's currenlfy effective street lighting rate schedule on file at the
FPSC or any successive street '~hting rate schedule approved by the FPSC. for facllities and servIce provided in accordance with this
agreement.

IT IS MUTUALLY AGREED THAT:
7. Modifications to the facilities provided by FPL under this agreement, other than for maintenance, may only be made through the ~ecution of
an additional street IglUing agreement delineating the modifications to be accomplished. Modificalton of FPL street lighUng faciltties is defined
as the following:

c. the removal of street lighting facilities and the replacement of such facilities wilh new facniUes. and/or additional facililies.
Modifications wit! be subject to the costs identified in FPL's currently effective street lighting rate schedule on file at the FPSC, or any
successive schedule approved by the FPSC.
8. FPL will, at the request of the Customer, refocate the street lighting facilities covered by this. agreement. if provided sufficient rlght-of-ways Of
easements to do so. The Customer shall be responsible for the payment of all costs associatect with any such Customer- requested rek>catlon
of FPL street lighting facUities. Payment shall be made by the Customer in advance of any relocation.
9. FPL may, at any time, substitute for any lumlnairellamp installed hereunder another luminaireflamp which shall be of at <<Jast equal illuminating
capacity and efficiency.
10. This Agreement shall be for a term of ten (10) years from the date of initiation of service, and, except as provided below. shall extend thereafter
for further successive periods of five {5} yeafS from the expiration of the initial ten (10) yeartelTI1 or from the expiration afaoy extension thereat.
The date of initiation of servIce shall be defined as the date the first lights are energlzed and billing begins, not Ihe date of this Agreement.
This Agreement shall be extended automatically beyond the i"itlal the (10) yea.r term or any extension thereof. unless either party shall have
given written notice to the other of its desire to terminate this Agreement The written notice shall be by certjfied mail and shall be given not
less than ninety (90) days before the expirafion afthe initial ten (10) year term, or any extension thereof.
11. I" rhe event street lighting facilities covered by this agreement are removed, anher at the request of the Customer or through termination or
breach of this Agreement. the Customer shall be responsible for paying to FPl an amount equal to the original installed cost of the facilitIes
provided by FPL under this agreement less any salvage value and any depredation (based on current deprecialk>n rates as approved by the
FPSC) plus removal cost
12. Should the Customer fail to pay any bills due and rendered pursuant to th;s agreement of otherwise fail to perform the obligations contained in
Ihis Agreement, said abligattCIns being material and going to the essence of this Agreement, FPL may cease to supply electric energy or
service until1he Customer has paid the bills due and rendered or has fully cured such other breach of this Agreement. Any failure of FPL to
exercise its rights hereunder shall not be a waiver of its rights. It is understood, however, that such discontinuance of the supplying of electric
energy or seNice shall not constitute a breach of this Agreement by FPL. nor st1all it relieve the Customer of the obligation to perform any of
the terms and conditions of this Agreement
13. The oblfgatian 10 furnish or purctlase seNice shall be excused at any time that eilher party is prevented from complying wit" this Agreement by
strikes, lockouts, fires., riots. acts of Gad, the public enemy, or by cause or causes not under the control of the party thus prevented from
compliance and FPL shall not have the obligation to furnish service if it is prevented from complying with this Agreement by reason of any
partial. temporary or entire shut-down of serviea which, in the sole opinion of FPL, is reasonably necessary for the purpose of repairing or
making more efficient all or any part of its generating or other electrical equipment
14. This Agreement supersedes all previous Agreements or representations. either written, oral or otherwise between the Customer and FPl, with
respect to the facilities referenced herein and constitutes the entire Agreement between the parties. This Agreement does. not create any
rights. or provide any remedies 10 IJlird parties or create any additional duty, obligation 0( undertakings by FPL to tl'tird parties.
15. This Agreement shalt inure to the benefit of, and be binding upon the successors and assigns of the Customer and FPL.
16. This Agreement is subject to FPL's Electric Tariff, including. but not limited to, the General Rules and Regulations for Efectric Service and the
Rules of the FPSC. as they are written, or as they may be hereafter revised, amended or supplemented. In the event of any conflict betvJeen
the terms of this Agreemenr and the provisions of the FPL Electric Tariff or the FPSC Rules, the provisions of the Electric Tariff and ,FPSC
Rules shall control, as they are now written. or as they may be hereafter revised, amended or supplemented.
IN WITNESS WHEREOF, the parties hereby caused this Agreement to be executed In triplicate by their duly authorized representatives to
be effective as of the day and year first written above.
