Recommendation to convey a Utility Easement to the Water-Sewer District for Master Pump
Station #304 at East Naples Community Park at a recording cost not to exceed $27.00, Project
739701.
OBJECTIVE: That the Board of County Commissioners of Collier County, Florida (Board)
convey a Utility Easement to the Board of County Commissioners of Collier County, Florida, as the
Governing Body of Collier County and as Ex-Officio the Governing Board of the Collier County
Water-Sewer District (District), The public putpose is to provide the easement required for the
operation and maintenance, to build a spill containment area for Master Pump Station #304 located
at the East Naples Community Park.
CONSIDERATIONS: The master pump station located at East Naples Community Park was built
over fifteen years ago. There is no easement of record for the infrastructure. A Utility Easement
will define the boundary for the master pump station as well as responsibilities for the
infrastructure. No changes to the historical use of the footprint for the master pump station will
occur as a result of this Utility Easement
The attached Utility Easement has been reviewed and approved by the County Attorney's Office,
the Parks & Recreation Department, Wastewater Operations and the Public Utilities Engineering
Department.

This project is consistent with the 2005 Wastewater Master Plan Update adopted by the Board of
County Commissioner (Board) on June 6, 2006, under Agenda Item 10(B), This project is
referenced in the Wastewater Master Plan under 8-2, page 4 of 5 line 109.
A Location Map, depicting East Naples Community Park with the area occupied by Master Pump
Station #304 and defmed by the Utility Easement, is attached.
FISCAL IMPACT: The total cost will not exceed $27.00 for recording the Utility Easement
Funds in the amount of $27.00 are available in the FY 08 budget for this action in Project 739701.
The FY 08 budget was approved by the Board of County Commissioners on September 20, 2007.
Source of funds is Wastewatcr User Fees fund 414.
GROWTH MANAGEMENT: This project meets current Growth Managcment Plan standards to ensure
the adequacy and availability 0 f viable public facilities.
RECOMMENDATION:
L That the Board of County Commissioners approve, and authorize the Chairman to
execute, the Utility Easement;
2. That the Board of County Commissioners, as Ex-Officio the Governing Board of the
Collier County Water-Sewer District, accept the Utility Easement; and

3. Direct the County Manager or his designee to record the Utility Easement in the Public
Records of Collier County, Florida.

UTILITY EASEMENT
THIS EASEMENT, made and entered into this_day of , 2008, by
COLLIER COUNTY, a political subdivision of the State of Florida, whose post office address is
3301 Tamiami Trail East, Naples, Florida 34112 (hereinafter referred to as "Grantor"), to the
BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX-0FFICIO THE GOVERNING
BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, its successors and assigns,
whose post office address is 3301 Tamiami Trail East, Naples, Florida 34112, (hereinafter
referred to as "Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this
instrument and their respective heirs, legal representatives, successors or assigns.)
WIT N E SSE T H:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged,
hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a
perpetual, non-exclusive easement for utility purposes, and access, on the following described
lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter
upon said land, excavate, and place or remove materials, including, but not limited to, water
and sewer lines and pipes, lift and pumping stations and other equipment or improvements
appurtenant thereto for the purpose of constructing, operating, and maintaining utility facilities
thereon. The easement granted herein shall constitute easements running with the land and
shall burden the lands described above.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed the
