EXECUTIVE SUMMARY
RECOMMENDATION TO DECLARE A VACANCY ON THE COUNTY GOVERNMENT
PRODUCTIVITY COMMITTEE
OBJECTIVE: To declare a vacancy on the County Government Productivity Committee and to
direct staff to issue a press release soliciting resumes in an effort to fill the vacant position.
CONSIDERATIONS: Ordinance No, 2001-55, Section 8, reads as follows: "It is the intent and
strong desire of the Commission that there be full attendance of advisory Board members at all
meetings of the Boards, recognizing, however, that it may be necessary for Board members to be
absent from a meeting due to unusual or emergency circumstances. Nevertheless, full attendance at
Board meetings is encouraged and necessary for the proper operation of the Boards and in
furtherance thereof the following requirements are established: A. Any Board member who is absent
for more than one-half of the Board's meetings in a given fiscal year shall be deemed to have
tendered his or her resignation for such Board. The Commission shall, as soon as practicable after
such resignation, declare the position to be vacant and shall promptly fill same pursuant to the
provisions of Section Six herein. The Board member shall not serve at any meetings after his or her
position is declared vacant by the Commission. B. In the event that any Board member is absent
from two consecutive Board meetings without a satisfactory excuse acceptable to the Board
chairman, the Board chairman shall state such fact at the next regularly scheduled Board meeting and
shall thereafter notifY, in writing, the Executive Managcr to the Commission of the Board member's
failure to attend without satisfactory excuse. The Commission shall review the Board Chairman's
notification at a Commission meeting and shall declare the Board member's position to be vacant if
the Commission concurs that the Board member was absent from two consecutive Board meetings
without a satisfactory excuse and shall promptly fill same pursuant to the provisions of Section Six
herein. The Board member shall not serve at any meetings after his or her position is declared
vacant. C. A member of a Board shall be deemed absent from a meeting when he or she is not
present during at least 75% of the meetings.
Attached is a memoranum from the Chairman of the County Government Productivity Committee
requesting that the Board of County Commissioners declare a vacancy on the committee and direct
staff to advertise to fill the vacancy.

FISCAL IMPACT: NONE
GROWTH MANAGEMENT IMPACT: NONE
RECOMMENDATION: That the Board of County Commissioners consider the recommendation to
declare a vacancy on the County Government Productivity Committee and direct staff to issue a press
release soliciting new members. It is also recommended that the Board of County Commissioners
direct the County Attorney to prepare a resolution declaring the position vacant.

SUBJECT: Request to the Board of County Commissioners to Declare Position
Vacant and to Fill Same Position
Productivity Committee member Robert Bennett suffered an injury from a fall and has
subsequently been absent from the last six meetings of Fiscal Year 2008 (October-
March). Mike Sheffield has talked with Mr. Bennett on several occasions, emphasizing
the importance of resuming attendance at meetings. At our meeting on March 19, 2008,
the Productivity Committee reviewed and considered the following from Collier County
Ordinance 2001-55 (Section 8-a):
"Anv Board member who is absent for more than one-half of the Board's meetings in a given
fiscal vear shall be deemed to have tendered his or her resignation from such Board. The
Commission shall. as SOon as practicable after resignation.. declare the DOsition vacant and shall
promptlv fill same pursuant to the provisions of Section Six herein, The Board member shall not
serve at anv meetings after his or her DOsition is declared vacant bv the Commission. "
In accordance with Ordinance 200]-55, the Productivity Committee has deemed that Mr.
Bennett has "tendered his resignation ", and voted I 0-0 to request that the Board of
County Commissioners declare this position to be vacant, and to "promptly" re- fill the
position,
