Recommendation that the Board of County Commissioners approves, and authorizes the
Chairman to sign, an Ordinance amending Ordinance 91-65, as amended, pertaining to the
Affordable Housing Commission, codified in Chapter 2, Article VII, Division 9, of the Code of
Laws and Ordinances, by amending the required composition and membership criteria of the
Affordable Housing Commission to be consistent with recent legislation enacted by the Florida
Legislature HB 1375; amending Section Eight, "Duties of Department Heads" to correctly
reference the Director of Housing and Human Services.
OBJECTIVE: Recommendation that the Board of County Commissioners approves, and authorizes
the Chairman to sign, an Ordinance amending Ordinance 91-65, as amended, pertaining to the
Affordable Housing Commission, codified in Chapter 2, Article VII, Division 9, of the Code of Laws
and Ordinances, by amending the required composition and membership criteria of the Affordable
Housing Commission to be consistent with recent legislation enacted by the Florida Legislature HB
1375; amending Section Eight, "Duties of Department Heads" to correctly reference the Director of
Housing and Human Services.
CONSIDERATIONS: On July 23, 1991, the Board of County Commissioners adopted Ordinance
No. 91-65 establishing the Collier County Affordable Housing Commission, codified as Chapter 2,
Article VIII, Division 9 of the Code of Laws and Ordinances of Collier County, Florida. This
Ordinance was subsequently amended by Ordinance 04-77 to include an alternate member, and
Ordinance 05-69 to clarify and designate the Appointment and Composition, Terms of Office and the
Functions, Powers and Duties of the Commission. The attached Ordinance will amend the
composition and criteria for the members to include two additional members and will thereby comply
with the 2007 revisions contained in HB 1375.
Changes in composition of the Board may create vacancies depending on how current members are
categorized based on the new requirements. Staff has reviewed the applications of each of the current
members and has determined the applicable categories. Staff determined that three current members fit
the category of "Resides within the Jurisdiction". One of the three current members must be selected
to fill that newly required position. According to the new statute, new members must be appointed by
June, 2008.
These categories must be advertised and filled so that there is a minimum of 11 members on the
Affordable Housing Commission, representing the categories listed in the ordinance. Additional
members that do not fulfill these positions are over and above the requirement listed by the recent
legislation.
Staff also requests amending Section Eight of the Ordinance, "Duties of Department Heads" to
correctly identify the title "Director of Housing and Human Services" and remove the title
"Operational Support and Housing Director".
In addition to the above mentioned recommendations to 1) comply with the new legislation and 2) to
comply with the reorganization of the department, staff also recommends that you remove language
that restricts membership to live in the specific geographic location of east of 951, due to the difficulty
in filling occupational specific seats. The seats specific to the City of Naples should remain; however
even these seats must be filled by citizens specific to the Ordinance. Staff also recommends that the
following specific seats be advertised: member of a planning commission, a non-profit developer of
affordable housing, a banker or mortgage broker who does affordable housing lending and a realtor
who sells affordable housing (current alternate is a realtor)

FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: The amended changes are consistent with the goals and
objectives of the Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: The proposed Ordinance was drafted by the Office of the County
Attorney and has been reviewed as to form and legal sufficiency.
STAFF RECOMMENDATION: That the Board approves and authorizes the Chairman to sign the
attached Ordinance amending Ordinance 91-65, as amended, to included an additional two members
and designated membership criteria as outlined in HB 1375 and amend Section Eight of the Ordinance
to replace Operational Support and Housing Director with Director of Housing and Human Services.

OF HOUSING AND HUMAN SERVICES; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING FOR

AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on July 23, 199t, the Board of County Commissioners adopted Ordinance
No. 91-65, establishing the Collier County Affordable Housing Commission ("Commission");
codified as Chapter 2, Article VIII, Division 9 of the Code of Laws and Ordinances of Collier
County, Florida, which Ordinance subsequently was amended by Ordinance Nos. 04-77 and 05-
69; and
WHEREAS, in 2007, the Florida Legislature amended Section 420.9076, Florida
Statutes, as it relates to the Affordable Housing Advisory Committee, by increasing the required
membership and revising membership criteria; and
WHEREAS, the Board of County Commissioners desires to amend Ordinance 91-65, as
previously amended, to provide consistency with these revised statutory provisions and amend
Section 8 of the Ordinance, "Duties of Department Heads," to correctly reference the Director of
Housing and Human Services.
NOW, THEREFORE, BE tT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Section Two of Collier County Ordinance No. 91-65, as amended, is hereby
amended to read as follows:
SECTION TWO. Appointment and Composition.
A. The Commission shall be cnmposed of ~ eleven (1 ]) voting
members and one (I) Alternate member, of which the Board of County
Commissioners shall appoint eigftt nine (9) members, including the Alternate
member. two of which must live in the Rural Area (East of Collier Boulevard),
and one of those must be a resident of Immokalee. The Naples City Council shall
appoint two members. The Alternate member shall serve in a voting capacity
only when a regular member is absent from a meeting. The Commission shall be

B. Members of the Commission appointed by the Board of County
Commissioners shall serve at the pleasure of the Board of County Commissioners
and members appointed by the Naples City Council shall serve at the pleasure of
the Naples City Council. Said members shall be permanent residents and electors
of Collier County.
C. Appointment of members to the Commission shall be by resolution
of the Board of County Commissioners and the Naples City Council, respectively,
which resolutions shall set forth the date of appointment and term of office.
SECTION TWO. Section Eight of Collier County Ordinance No. 91-65, as amended, is hereby
amended to read as follows:
Sec. 2-973. Duties of department heads.
The duties of the Director of Housinl! and Human Services 8flemtisRal SbIflfl8Ft
ana R8l:lsing; direeter and the Naples Community Development Director, or their
designees, shall be:
(1) To administer the activities of the affordable housing commission in accordance
witb established policies of the board of county commissioners and the Naples
City Council and guidelines adopted by the board and the council.

(2) To provide periodic written reports to the commission, the county administrator,
the city manager, the Naples City Council and the Board of county commissioners
on the growth management plan of each jurisdiction.
(3) To attend all commission meetings.
SECTION THREE: INCLUSION IN THE CODE OF LAWS AND ORDINANCES.
The provisions of this Ordinance shall become and be made apart of the Code of Laws and
Ordinances of Collier County, Florida The sections of the Ordinances may be renwnbered or
re-Iettered to accomplish such, and the word !1ordinancell may be changed to "section/, "article,"
or any other appropriate word.
SECTION FOUR: CONFLICT AND SEVERABILITY.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. Ifany phrase or portion ofthis Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FIVE: EFFECTIVE DATE.
This Ordinance shalt take effect upon filing with the Department of State.

Dear Commissioners:
As you are aware, a new law setting position requirements for affordable housing
commission member qualifications and backgrounds was recently passed. In an effort
to adhere to the new state law the Collier County Affordable Housing Commission is
requesting the following.
1. Amend enabling ordinance 2005-69 to reflect changes stated in the new state
law.
2. Allow existing Affordable Housing Commission members to maintain their
positiDns or "grandfather". Allow current commission members to reapply for
same position as terms expire regardiess of professional affiliation.
3. Advertise for three newly created positions, requesting applicants from three
sectors defined by the new law:
a. Planning (City of Naples)
b. Banking
c. Not for profit affordable housing
4. Allow Sally Masters, current alternate Commission Member, to become a full
time member representing the Real Estate industry.
5. As current members resign, fill openings into select fields on an as needed
basis.
Today's Affordable Housing Commission consists of highly talented and knowledgeable
individuals committed to providing a comprehensive solution to the affordable housing
issue.

xperience: Mr. Hruby is a founding principal of Architects Uulimited, a 25 year old architectural,
ban design and town planning finn, and President of that firm's affiliate, AU Consulting which
ializes in housing and development consulting. The fIrmS were established in New York City and
located their corporate offices to Naples, Florida in 2002. They engage in a national practice with a
rimary focus on housing and community revitalization. Mr. Hruby is a nationally recognized
cialist in housing with a particular emphasis on affordable housing, mixed income communities an
mmunity revitalization. He has extensive experience with the public administration of large
ommunity revitalization programs and funding grants which he has gained through more than 30
ears of experience in master planning, mixed finance funding, program management, strategic capital
lanning and administration, zoning, and land use. Mr. Hruby is highly skilled in community
articipation and consensus building and is noted for his ability to achieve consensus among
takeholders with varying priorities. Mr. Hruby has been in charge of numerous community
evitalization projects involving mixed-income, mixed-finance housing and mixed use developments
ough out the country. He has overseen the master planning, and or program implementation of
OPE VI and mixed fmance developments in Memphis IN, Baltimore MD, Orlando FL, Dallas TX,
ontiac MI, Springfield OH, and Cincinnati OH among others. Mr. Hruby is a distinguished authority
n both the physical design aspects of community revitalization and the funding mechanisms, such as
ocal and State, and Federal grants and Tax Credits which make his vision a reality. His most recent
complishment was a 6-year long revitalization of the Uptown Neighhorhood in Memphis IN which
urrounds the renowned SI. Jude Children's Hospital. Mr. Hruby was responsihle for the overall
eighborhood revitalization master plan, and functioned as the program manager throughout the
. plementation of the project. Financing mechanisms included federal HOPE VI grants, local
ontributions, Low Income Housing Tax Credits, bond financing and Tax Increment Financing. A
ommunity Revitalization Authority was established, overlay zoning was crafted and overall design
dards and prototypes were developed for affordable and market rate housing. A sizeable property
semblage was accomplished for construction of infill housing, Code enforcement was revamped and
frastructure improvement programs were implemented. Mr. Hruby has served as Director of Capital
mprovements and Development for the housing agencies of Memphis IN and Camden NJ under
rivatization contracts AU had with those cities. These experiences formed his consummate
derstanding of the complexities and challenges faced by municipalities in developing and managing
ordable housing. Mr. Hruby has developed nwnerous strategic housing plans for capital
provement and development in some of the largest cities in the nation. He crafted the underlying
trategies for the housing revitalization policies in Baltimore MD, Washington DC, Newark NJ, SI.
ouis MO, and East SI. Louis II. among others. His plans remain the guiding principals for communi
vitalization and affordable housing development in those cities to this day. Mr. Hruby was a member
f a Housing and Urban Redevelopment (OOD) Target Team established by then Secretary Henry
isneros to improve the troubled housing agency in New Orleans, LA- Mr. Hruby was in charge of
eveloping the overall capital investtnent, community revitalization and affordable housing
evelopment strategies for the city's housing agency to achieve HUD's goal of improve housing
onditions in the city. Mr. Hruby has also conducted training programs for municipal housing agencies
strategic capital and development planning though out the nation. Mr. Hruby is a registered
hitect in 6 states includin Florida and holds a national accrediation.
