Recommendation to Approve a Stipulated Final Judgment for Parcels 862, 962 and 963 in
the Lawsuit Styled Board of County Commissioners of Collier County v. Grand Cypress
Communities, et ai., Case No. 05-1053-CA. (South County Regional Water Treatment
Plant Reverse Osmosis Wellfield Expansion Project #70892)(Fiscallmpact: $43,070.00).
OBJECTIVE: That the Board of County Commissioners approve the Stipulated Final
Judgment for payment of full compensation, expert fees and costs for the taking of Parcels 862,
962 and 963 in the lawsuit styled Board (if County Commissioners of Collier County v. Grand
Cypress Communities, et 0/" Case No. 05-1053-CA.
CONSIDER<\ TIONS: This Executive Summary seeks approval of a proposed Stipulated Final
Judgment as to Respondents, Citygate Development and City Gate Master Property Owner's
Association, Inc., in the amount of $134,000 as full compensation for the condemnation of
Parcels 862, 962 and 963 in Board of COU11ty Commissioners of Collier COU11ty v, Grand Cypress
Communities, fnc', et or, Case No. 05-1053-CA. Parcels 962, 963 and 862 were acquired as
permanent utility (pipeline) easements and an access easement, respectively, for the well field
expansion to provide sufficient raw watcr to the South County Water Treatment Plant. On
January 14, 2005, well before initiation of the suit, staff offered Citygate Development and City
Gate Master Property Owner's Association, Inc" $75,000 for all parcels, which was rejected.
The County ultimately acquired the subject property by entry of an Order of Taking and by
depositing $114,900 into the Court registry on November 2, 2005. The deposit well exceeded
the original olfer due to rapidly increasing market values through much of 2005, Citygate
Development has agreed to accept the amount of $134,000 as full compensation for the property
taken. In addition, the Stipulated Final Judgment provides for payment of statutory attorney's
fees based on 33% of the difference between the settlement amount and the initial offer, i.e., 0.33
X ($75,000 - $134,000), and expert costs of $4,500. Attached is the Stipulated Final Judgment.

GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
Standards to ensure the adequacy and availability o[viable public facilities.

THIS CAUSE, having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, and Respondents, CITYGATE DEVELOPMENT, LLC and
CITY GATE MASTER PROPERTY OWNER'S ASSOCIATION, INC., aka CITY GATE
COMMERCE PARK MASTER PROPERTY OWNERS ASSOCIATION, INC, by and through
their undersigned counsel, for entry of a Stipulated Final Judgment as to Parcel Nos. 862, 962
and 963, the Court finding that the compensation to be paid by Petitioner, COLLIER COUNTY,
FLORIDA, is the full compensation due Respondents, CITYGATE DEVELOPMENT, LLC, and
CITYGATE MASTER PROPERTY OWNER'S ASSOCIATION, INC., and the Court being
otherwise fully advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that:

FLORIDA, the sum of One Hundred Thirty-Four Thousand and No/I00 Dollars
($134,000.00), as full payment for the property interests taken and for damages resulting to the
remainder, if less than the entire property was taken, business damages, and for all other
damages in connection with said parcels.
2. Petitioner will be entitled to a credit for the good faith estimate of value
previously deposited in the amount of $114,900,00.
3, Respondents shall receive, pursuant to Florida Statutes 973.092(1), as a
reasonable attorney's fee, the sum of Nineteen Thousand Four Hundred Seventy and NollOO
Dollars ($19,470.00), based on a benefit to the property owner of $59,000, and that no other
attorney's fees shall be awarded in this cause,
4, Respondents shall receive as full settlement of any and all claims for expert fees
and costs the sum of Four Thousand Five Hundred and No/I00 Dollars ($4,500.00).
5, Within thirty (30) days of entry of this Order, Petitioner shall pay the sum of
Forty Three Thousand Seventy and NollOO Dollars ($43,070.00) to CITYGATE
DEVELOPMENT, LLC, made payable to Roger B. Rice, P.A Trust Account, c/o Roger B. Rice,
Esquire, 9010 Strada Stell Ct., Unit 207, Naples, FL 34109, for proper disbursement in
accordance with this Order.
6, The Clerk shall disburse forthwith the total sum of $114,900 to CITYGA TE
DEVELOPMENT, LLC made payable to Roger B. Rice, P,A Trust Account, c/o Roger B. Rice,
Esquire, 9010 Strada Stell Ct., Unit 207, Naples, FL 34109
7, Title to Parcel Nos. 862, 962 and 963 in perpetual, non-exclusive access
easements and utility easements, being fully described in Exhibit "A" attached hereto and
incorporated herein, which vested in Petitioner, COLLIER COUNTY, FLORIDA, pursuant to

the Order of Taking dated October 18, 2005, and the deposit of money heretofore made, is
approved, ratified, and confirmed.
8. CITY GATE MASTER PROPERTY OWNER'S ASSOCIATION, INC. makes
no claim to any portion of the compensation award and shall receive no award, including fees
and costs, in this proceeding,
9. The Notice of Lis Pendens filed in the above-styled cause and recorded in Official
Record Book 3825, Page 3721 of the Public Records of Collier County, Florida, is dismissed as
to Parcel Nos. 862,962 and 963.
10. Pursuant to Section 74.051(3), F.S., the Clerk of Courts shall disburse the interest
earned on the funds, via wire transfer, in the amount of $12,040.96, from the Clerk of Courts to
Collier County Board of County Commissioners account #411-273511-70892 L
11, This Stipulated Final Judgment is to be recorded in the Official Records of Collier
County, Florida.
12, This Court retains jurisdiction to enforce the terms of this Stipulated Final
Judgment.
