EXECUTIVE SUMMARY
Recommendation to approve a Stipulated Final Judgment for Parcel Nos. 135/40, 135/40.1,
136/41, 136/41.1 in the lawsuit styled CC v. Timothy Maloney, et ai, Case No. 92-1508-CA.
(Golden Gate Wellfield Expansion Project) (Fiscal Impact $3,600)
OBJECTIVE: That the Board of County Commissioners approve the Stipulated Final
Judgment for payment of full compensation, expert fees and costs, for the taking of Parcel Nos.
135/40, 135/40.1, 136/41 and 136/41.1 in the lawsuit styled CC v1imothy Maloney, et aI, Case
No. 92-1508-CA (Golden Gate Wellfield Expansion).
CONSIDERATIONS: This case was commenced by outside counsel in 1992 to acquire
two permanent utility easements lor well sites and two temporary construction easements for the
construction of those well sites as part of the Golden Gate Wellfield expansion. These
easements were acquired by the County on September 18, 1992, by entry of an Order of Taking
and a deposit of $400 into the court registry. The case was set for trial in 2001, but was
continued at the request of owner. Efforts to resolve this matter over the past years were met
with little response from the owner, and ultimately this case was scheduled for trial in June,
2008. Through negotiation, staff and the owner have agreed to the proposed settlement of
$4,000 as full compensation for the taking of Parcel Nos. 135/40, 135/40.1, 136/41 and 136/41.1
and all fees and costs, See the attached Stipulated Final Judgment.
If approved, the County will pay the following costs:

FISCAL IMP ACT: Funds in the amount of $3,600 are available in the FY 08 Adopted Budget.
Source of funds are Water Impact Fees, Fund 411 ,
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management
Plan Standards to ensure the adequacy and availability of viable public facilities,
RECOMMENDATION: That the Board of County Commissioners:
1. Approve the Stipulated Final Judgment as to Parcel Nos. 135/40, 135/40.1,
136/41, and 136/41.1; and
2, Approve the expenditure of funds as stated.

STIPULATED FINAL JUDGMENT
THIS CAUSE, having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent,
JAMES BROWN, JR, TRUSTEE, for entry of a Stipulated Final Judgment as to Parcels 135/40,
135/40.1,136/41,136/41.1, the Court finding that the compensation to be paid by Petitioner, is
the full compensation due Respondent, JAMES BROWN, JR, TRUSTEE, and the Court being
otherwise fully advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that:
L Respondent, JAMES BROWN, JR., TRUSTEE shall receIve from Petitioner,
COLLIER COUNTY, FLORIDA, the sum of Four Thousand and No/tOO Dollars ($4,000.00),
as full payment for the property interests taken and for damages resulting to the remainder, if less
than the entire property was taken, interest, attorney's fees, and all defense costs, and for all
other damages in connection with said parcel.
2. Petitioner will be entitled to a credit for the good faith estimate of value
previously deposited in the amount of$400,00,

3, Within thirty (30) days after receipt of this order, Petitioner shall pay the sum of
Three Thousand Six Hundred and Noll 00 Dollars ($3,600.00) made payable to James Brown,
Jr., Trustee, c/o Paramont Land Corp., Inc" I 051 Clark Street, Abingdon, V A 24210.
4, Immediately after entry of the order, the Clerk shall disburse the total amount of
Four Hundred and NolIOO Dollars ($400.00) to Respondent, James BroVl'll, Jr., Trustee, made
payable to James Brown, Jr., Trustee, c/o Paramont Land Corp" Inc" 1051 Clark Street,
Abingdon, VA 24210.
5. No other defense costs or fees shall be awarded in this cause,
6. Title to Parcels 135/40, 135/40,1, 136/41 and 136/41.1, in permanent utility
easements and temporary construction easements, being fully described in Exhibit "A" attached
hereto and incorporated herein, which vested in Petitioner, COLLIER COUNTY, FLORIDA,
pursuant to the Order of Taking dated August 31, 1992, and the deposit of money heretofore
made, is approved, ratified, and confirmed.
7, The Notice of Lis Pendens filed in the above-styled cause and recorded in Official
Record Book 1708, Page 1289 of the Public Records of Collier County, Florida, is dismissed as
to Parcels \35/40, 135/40,], 136/41 and 136/4 L L
8, This Stipulated Final Judgment is to be recorded in the Official Records of Collier
County, Florida,
