Recommendation to approve the after-tbe-fact submittal of a Federal Emergency
Management Agency Assistance to Firefighter's Grant in the amount of $340,000 for the
purcbase of a Pumper Tanker for tbe Ocbopec Fire Control District
OBJECTIVE: To obtain after-the-fact approval of a Federal Emergency Management Agency
Assistance to Firefighters Grant (AFG) for the purchase of a pumper tanker to provide water
supply for further protection of the Ochopee Fire Control District.
CONSIDERATIONS: Ochopee Fire Control District has received this type of grant from the
Federal Emergency Management Agency (FEMA) in past years. At this time the District is in
dire need of replacing its existing pumper tanker that is 18 years old and has reached the end of
its life expectancy. This vehicle will be replaced with a 3000 gallon pumper tanker with class A
and B foam capabilities. The pumper tanker will provide water supply for the District for
structure fires, vehicle fires, brush fires and hazardous materials incidents. This is an extremely
viable piece of equipment especially because the closest mutual aid for water supply is up to 55
minutes away. This equipment will increase firefighter safety and firefighting resources in the
District.
The AFG grant program typically provides only a month for development and submittal of grant
applications. Unfortunately, in the rush to get the application materials together and submit the
application on-time, Ochopee Fire Control District inadvertently submitted the grant via the
electronic submittal process prior to getting proper approval to submit. After the submittal, the
Grants Office became aware of the oversight and together we immediately sought County
Manager approval so the approval could be documented at least by the grant deadline. This
approval follows standard practice as outlined in CMA #5330 for after-the-fact approval of grant
applications.
FISCAL IMPACT: The total cost of the Pumper Tanker is $340,000. This is a 95/5 matching
grant split between FEMA and the Ochopee Fire Control District with FEMA providing 95% of
the costs at $323,000. If awarded, the District's share of 5% in the amount of $17,000 will be
funded from Ochopee Reserves of Fund 146, Ochopee Fire Control District. Following the
award, a grant agreement will be presented to the Board of County Commissioners along with a
budget amendment to transfer funds to Fund 118, Emergency Management and Fire Grants.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: Upon award, tbe grant agreements will require legal
review and approval.
RECOMMENDATION: To approve the after-the-fact submittal of a Federal Emergency

Project Description

Please provide your narrative statement in the space provided below. Include in your narrative, details
regarding (1) your project's description and budget, (2) your organization's financial need, (3) the benefit to be
derived from the cost of your project, and (4) how the activities requested in your application will help your
organization's daily operations and how this grant will protect life and property.
We are requesting one 3000 gallon pumper tanker with class A and B foam capability for fire and haz-mat
operations. Presently our 18 year old existing tan ker has over 150,000 miles and has been out of service 83
days in the last year for repairs, It has broken down on 13 calls. Our operating budget is about $340,000. These
monies must pay for fuel, maintenance, station repairs, utilities and normal operating expenses incurred doing
day to day business. The cost of replacing the existing tanker with a new NFPA compliant unit is out of our
budgetary limits.
Our Department responds to 1100 square miles from one centrally operated station and the average call is 35
miles one way. Oniy 1 % of our district has an established water supply therefore 99% of our fire operations rely
on tanker operations. These operations include structure, vehicle, wild land responses and hazardous materials.
The closest mutual aid unit for water supply can be from 35 minutes to 55 minutes away.
The Ochopee Fire Control District provides service to 1100 square miles. This area includes the rural
communities of Everglades City, Plantation, Chokolsokee Island, Jerome, Lee Cypress, and various small
Miccosukee Indian settlements along U.S. Highway 41. District responsibility includes Fire EMS operations, wild-
land Operations, Haz-Mat Operations, Water rescue Operations, Airport Operations, as well as other rescue
operations within the scope of the fire service.
The district also supplies aid to the Big Cypress National Preserve, Everglades National Park, the Panther
Preserve (USFWS), Collier Seminole State park, Fakahatchee State Park, Pyciune State Park, 32 miles of
Interstate "/5, and 58 miles of US. highway 41.
The funding of this grant request would provide water for fire protection throughout the district as well as several
State and National preserves and parks. Without grant funding the District will loose its ability to adequately
provide fire protection to all the afore mentioned organizations as well as the District.

Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L 91-646)
which provide for fair and equitable treatment of persons displaced or whose property is
acquired as a result of Federal or Federally assisted programs. These requirements apply to
all interest in real property acquired for project purposes regardless of Federal participation in
purchases.
8. Will comply with provisions of the Hatch Act (5 U.SC. Sections 1501-1508 and 7324-7328),
which limit the political activities of employees whose principal employment activities are
funded in whole or in part with Federal funds.

10. Will comply, if applicable, with fiood insurance purchase requirements of Section 102(a) of
the Flood Disaster Protection Act of 1973 (PL 93-234) which requires recipients in a special
flood hazard area to participate in the program and to purchase flood insurance if the total
cost of insurable construction and acquisition is $10,000 or more.
11. Will comply with environmental standards which may be prescribed pursuant to the following:
(a) Institution of environmental quality control measures under the National Environmental
Policy Act of 1969 (P.L. 91-190) and Executive Order (EO) 11514; (b) notification of violating
facilities pursuant to EO 11738; (c) protection of wetlands pursuant to EO 11990; (d)
evaluation of fiood hazards in flood plains in accordance with EO 11988; (e) assurance of
project consistency with the approved State management program developed under the
Coastal Zone Management Act of 1972 (16 U.S.C. Section 1451 et seq.); (I) conformity of
Federal actions to State (Clean Air) Implementation Plans under Section 176(c) of the Clean
Air Act of 1955, as amended (42 U.S.C. Section 7401 et seq.); (g) protection of underground
sources of drinking water under the Safe Drinking Water Act of 1974, as amended. (P.L. 93-
523); and (h) protection of endangered species under the Endangered Species Act of 1973,
as amended, (P.L. 93-205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.)
related to protecting components or potential components of the national wild and scenic
rivers system.
13. Will assist the awarding agency in assunng compliance with Section 106 of the National

3. Drug-Free Workplace (Grantees other than Individuals)
As required by the Drug-Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for
grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlied substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on-going drug free awareness program to inform employees
about
(1) The dangers of dnug abuse in the workplace;
(2) The grantees policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse
violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the performance of
the grant to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment under the grant, the employee will:
(1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a violation
of a criminal drug statute occurring in the workplace no later than five
calendar days after such conviction.
(e) Notifying the agency, in writing within 10 calendar days after receiving notice
under subparagraph (d)(2) from an employee or otherwise receiving actual notice of
such conviction. Employers of convicted employees must provide notice, including
position title, to the applicable DHS awarding office, i.e. regional office or DHS office.
(I) Taking one of the following actions, against such an employee, within 30 calendar
days of receiving notice under subparagraph (d)(2), with respect to any employee
who is so convicted:
(1) Taking appropriate personnel action against such an employee, up
to and including termination, consistent with the requirements of the
Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse

Federal, State, or local health, law enforcement or other appropriate

County Manager Review and Approval of an Assistance to Firefighters Grant (AFG)
Application to the Federal Emergency Management Agency
Ochopee Fire Control has developed a grant application on behalf of Collier County to request
funding to purchase a 3000 gallon pumper tanker with class A and B foam capability for hire and
haz-mat operations. This vehicle will benefit multiple fire districts and areas, The grant request is
$323,000, and if awarded, the local match will be $17,000. For vehicles, the Assistance to
Firefighters Grant (AFG) requires a 5% match and the grantor provides 95% of the total project
cost. As you know. EMS is also submitting an AFG grant, however, their application is submitted
under a different category of funding (Operations & Safety) so there is no conflict or internal
competition for funds.
This grant program typically provides only a month for development and submittal of grant
applications. This year the program opened on March 3,d with a deadline of April 4th
