EXECUTIVE SUMMARY
Recommendation to approve a Statutory Deed between the Collier County Transportation
Division and the Conservation Collier Program for approximately 12.5 acres under the
Conservation Collier Land Acquisition Program, at a cost not to exceed $65,000.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) for
execution of the attached Statutory Deed (Deed) between the Board on behalf of the
Transportation Division (Transportation) to the Board on behalf of the Conservation Collier
Program (Program).
CONSIDERATIONS: On January 27, 2004, Agenda Item 10A, the Board approved a
Conservation Collier Land Acquisition Advisory Committee (CCLAAC) recommended Cycle I -
Active Acquisition List, (AAL) with changes, and directed staff to actively pursue acquisition of
the properties under the Program. One of the changes was to add the undetermined acreage
of wetlands on the property formerly known as the Fleischmann North parcel (Property).
In April 2004, Transportation purchased the property formerly known as the Fleischmann North
parcel consisting of 45.24 acres for the development of the Gordon River Water Quality Park
Project (Project). This Project is now known as Freedom Park.
At the December 2006 CCLAAC meeting, the CCLAAC made the recommendation to place this
Property on the "C" list since they were advised that the wetlands would most likely be
necessary for mitigation for the Project. On January 23, 2007, Agenda Item 10A, the Board
approved the Cycle 4 - AAL with changes, and directed staff to actively pursue acquisition of
the properties under the Program. One of the changes was to add the Property to the "A" list.
On October 9, 2007, Agenda Item 16B3, the Board approved a Deed of Conservation Easement
to South Florida Water Management District (SFWMD) to comply with Transportation's Permit
No. 11-00820-S requirements for the development of the Project. The Deed of Conservation
Easement is recorded in the Official Public Records of Collier County at Official Records Book
4292, Page 3317.
On January 29, 2008, Agenda Item 10F, the Board approved the current AAL which provides lor
the Property to remain as an "A" parcel.
The purchase of the Property by Conservation Collier will enable management partnership of
the Property between Transportation, Parks and Recreation and Conservation Collier. This
management plan is consistent with the management plan that was submitted for the Florida
Community Trust grant.
Pursuant to Ordinance 2007-28, an in-house appraisal by Real Property Management's staff
values the 12.5 acre parcel at $56,300.
Pursuant to Ordinance 2003-63, Section 13(8), a Project Design Report for the property is
provided herewith.

On April 14, 2008. the CCLAAC voted 5/4 to make the recommendation that the Board not
approve this transaction.
The Statutory Deed has been reviewed and approved by the County Attorney's Office.

FISCAL IMPACT: The total cost of acquisition will not exceed $65,000 ($56,300 for the
property, $8,600 survey services, and approximately $100 for recording of documents). The
funds will be withdrawn from the Conservation Collier Trust Fund (172) and will be deposited in
Fund 325 Gordon River Water Quality Park Project (Project No. 510185).
GROWTH MANAGEMENT IMPACT: Fee simple acquisition of conservation lands is consistent
with and supports Policy 1.3.1 (e) in the Conservation and Coastal Management Element of the
Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: The Conservation Collier Ordinance (2007-65) provides a legal
framework for property acquisition for the Conservation Collier Program. The process for
acquiring this property falls within the legal framework of Ordinance 2007-65.
RECOMMENDATIONS: Staff is recommending that the Board of County Commissioners:
1) Approves the attached Statutory Deed; 2) Authorizes the Chairman to execute the Statutory
Deed; 3) Authorizes the County Manager or his designee to prepare related vouchers and
Warrants for payment; and 4) Directs the County Manager or his designee to proceed to record
the Statutory Deed.

Purpose of Proiect: Conservation Collier
Pro2ram Oualifications:
The statutory deed covers ] 2.5 +/- acres of a parcel approximately 50 acres in size
purchased by the Collier County Transportation Depar1ment in April 2004 for the Gordon
River Water Quality Park (now know as the Freedom Park). The purpose of the
acquisition was to develop a project for the purpose of filtering pollutants from
surrounding stormwater runoff, providing flood protection and providing passive
recreational and educational opportunitics for citizens. The property was purchased by
Collier County on March 29, 2004. A post acquisition grant from the Florida
Communities Trust for $5.8 million and with a $1 million grant each year for 10 years
from the Big Cypress Basin, an arm of the South Florida Water Management District,
were awarded in 2005. Under the project permit and the FCT-required management plan,
the eastern 12.5 acres are to be rcstorcd via exotic plant removal and native plant
restoration. A boardwalk connecting with other areas of the property is to bc installed to
provide the recreational and educational component. Conservation Collier is envisioned
to be the long tenn manager Jor this portion of the project in partnership with the Parks
and Recreation Dept.
The 12.5 acres wetland portion of the Frecdom Park Project fulfills Conservation Collier
program qualif1cations by satistying many applicable screening criteria. Critcria satisfied
include presence of native habitat, potential for nature based recreation, protection of
water resource values and wetland dependent and listed species habitat, connectivity and
restoration potential. Those not satisfied are presence of signiticant biological/ecological
values and vulnerability to development. The propeliy is signiticantly impacted by
exotics and little intact habitat remains. Additionally, the propcliy is not vulnerable to
development, having been under Conscrvation Designation by the City of Naplcs, in
who's jurisdiction it lies, and more recently, under conservation easement to South
Florida Water Management District (SFWMD) under Pemlit Il-00820-S-02.
Native vegetation eUITently present in the wetland portion of the Freedom Park Project
consists primarily of laurel oak, slash pine, cabbagc palm, swamp fern, and myrsine.
Directly adjacent to the Gordon Rivcr arc Red and white mangroves and leather fern.
Exotic plants constitute a signif1cant portion of the existing vegetation. Dominant exotic
plant species are Brazilian pepper, carleaf acacia, downy rose-myrtle, and shoebutton
ardisia. Exotic removal pursuant to the SFWMD pe11l1it is currently underway, with a

project for replanting native vegetation to be undertaken after the exotics are removed
and the boardwalk installation is complete.
The wetland habitat, when restored, will provide appropriate habitat and foraging area for
wetland dependent and listed species, which have been previously documented on this
parcel. In 2002, a local environmental consulting f1rm, WilsonMiller, documented a
snowy egret and little blue heron. both state-listed as Species of Special Concern (SSC)
and a wood stork, listed by both the state and federal governments as Endangered. In
2003 staff observed a tricolored heron. listed by the State as a SSe. There is potential for
other listed (and non-listed) wading birds to use the site and for the presence of alligators,
listed as Threatened by the state and federal government.
The 12.5 acres wetland portion is directly adjacent on the east side to the approximately
65-acre preserve along the western edge of the Estuary at Grey Oaks and to a small,
(under one acre) Collier County-owned conservation easement. Management of the 12.5
wetland acres for conservation will enhance and enlarge these connected conservation
lands. Removal of exotic plants will eliminate seed source for re-infestation of both the
12.5-acre parcel and surrounding lands.
Parking will be provided at the education building with access off of Golden Gate
Parkway, where the boardwalk trails will begin. In the future, there is potential
boardwalks and trails from this project site to be interconnected with the entire Gordon
River Greenway Project. This will signif1cantly enhance the aesthetic setting of Collier
County by providing a naturally vegetated and highly visible public recreation and
conservation area.
Proiected Manal!ement Activities:
An overall management plan for the Freedom Park was developed in early 2007 by the
Collier County Stormwater Management Section (Stormwater) and Parks and Recreation
(Parks) Department. Yearly Annual Stewardship Reports are provided to FCT by
Stornlwater pursuant to grant requirements; the most recent one dated January 8, 2008.
An interdepartmental agreement is in the process of being developed between
Conservation Collier, Parks and Stornlwater for the coordinated management of Freedom
Park.
Conservation Collier's portions of management activities are projected to include the
following:
. Provide appropriate signage identitying Conservation Collier involvement.
. Cost share with Parks and Recreation for the ongoing exotic plant maintenance
after pennit obligations are completed.
. Cost share for refurbishment projects with Parks and Stormwater if they affect the
Conservation Collier wetland acreage - to be determined on a case-by-case basis.
. Participate in educational programs to fulf1ll FCT educational programs
commitments.
. Participate with Parks and Storm water in FCT monitoring commitments.
. Participate with Parks and Stonnwater in FCT Stewardship reports.
