CONSIDERATIONS: As part Df a 1985 Settlement Agreement (Settlement) between the Conservancy of SDuthwest FIDrida (Conservancy), Lely Estates and Collier County, the Conservancy has enforcement authority over much of the environmental standards in place within the Lely Barefoot Beach development. In addition, as part of the Settlement, the lands within Tract M and N were conveyed to Collier County for management, and placed under conservation easement to the Florida Oepartment of Environmental Protection (OEP). The Conservation Easement requires the County, in part, to, "maintain the land forever, predominantly in lhe natural vegetative and hydrologic condition existing at the time of execution of this Conservation Easement." The Conservancy recenlly received a phone call from a property owner adjacent to the County Conservation Easement in Tract M. The property owner indicated there are Brazilian pepper trees on the County property. Conservancy staff conducted a site visit and found at least one Brazilian pepper. Additional peppers were found along Barefoot Beach Boulevard, which are within the Conservation Easement Prior to the 2007 re-organization, the Environmental Services Oepartment managed this Conservation Easement using budgeted funds from the County General Fund. After the 2007 re-organizalion, the Environmental Services Oepartment no longer performed operational land management tasks such as managing this Conservation Easement. Because no other department was identified to take on the management of this Conservation Easement after the 2007 re-organization, no General Funds were budgeted for this task in FY08. The Facilities Management Oepartment is now the County Department responsible for the management of this Conservation Easement, and as such requires funds for this lask. FISCAL IMPACT: If approved, the budget amendment will decrease the Collier County General Fund (001) Board Reserves by $7,100 and increase the Facilities Maintenance (001) FY08 budget by $7,100. Future funds necessary for management of the conservation easement, approximately $1,000 annually, will be budgeted within the Facilities Maintenance (001) budget during the regular budget process. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners approves a budget amendment to move $7,100 from the Collier County General Fund Reserves to the Facilities Maintenance Fund in order to fund invasive exotic plant management within a County owned conservation easement.
