EXECUTIVE SUMMARY
This is a recommendation to grant final approval of the roadway (private)
and drainage improvements for the final plat of Prestwick Place, (Lely
Resort PUDlo The roadway and drainage improvements will be privately
maintained.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Prestwick Place.
CONSIDERATIONS:
1, On March 9, 2007, Engineering and Environmental Services Department
granted preliminary acceptance of the roadway and drainage
improvements in Preslwick Place.

2. The roadway and drainage improvements will be maintained by the
project's homeowners association and Community Development District
respectively.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. On May 22, 2006, the Board entered into a Construction and Maintenance
Agreement for Subdivision Improvements with the developer. The
developer has fulfilled his obligations with respect to the Construction and
Maintenance Agreement.
6. The developer was not able to obtain a letter from a representative of the
Homeowner's Association authorizing final acceptance of the
improvements. According to the developer, residents are reluctant to
accept the responsibility on behalf of all of the home owners.

7. The Lely Resort PUD is currently under development and at this time of
submittal it has been determined that not all PUD commitments have been
fulfilled. Environmental: on going as preserve areas are platted concurrent
with development; Transportation: on going, bids have been requested for
fair share contribution towards a traffic signal; Storm-water: conveyance of

storm-water easement and allowance for storm-water routing from CR 951
through project is currently under review.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association and Community Development District respectively.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency, JW
RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage irnprovements in Prestwick Place and release the maintenance
security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTIIORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN PRESTWICK
PLACE, ACCORDING TO THE PLAT THEREOF
RECORDED IN PLAT BOOK 46, PAGES 9
THROUGH 14; RELEASE OF TilE
MAINTENANCE SECURITY; A,ND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQ\JlRED TO BE MAINTAINED BY THE
PRESTWICK PLACE HOMEOWNERS'
ASSOCIATION,INC.
WHEREAS, the Board of Counly Commissioners of Collier County, Florida, on
September 13, 2005 approved the plat of Prestv.'ick Place for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance ~o. 04-41, as
amended); and
\\TffEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
Vv'HEREAS, the Engineering and Environmental Services Section of the
Community Development Department has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COV"T'{
COMMISSIOl'<'ERS OF COLLlER COUNTY, FLORIDA, that final acceptance is hereby
h"TanteJ for those roadway and drainage improvements in Prestwick Place, pursuant to
the plat then.:of recorded in Plat Book 46, pages 9 through 14, and the Clerk is hereby
autborized to release the maintenance security.
BE IT FURTHER RESOLVED A1\D ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required 10 be maintained by the Prest\vick Place
Homeowners' Association. lnc.
This Resolution adopted after motion, second and majority vote favoring same,
