CU-2008-AR-12996, Bob Annibale of Avis Budget Group requests a Conditional Use
to permit truck rentals within the C-4 Zoning District. The :to.98-acre subject
property is located at 1965 and 1933 Tamiami Trail, in Section 11, Township 50,
Range 25, Collier County, Florida.
OBJECTIVE:
To have the Board of Zoning Appeals (BZA) consider the above-referenced application for
Conditional Use No. 5 of the General Commercial (C-4) Zoning District, as provided in
Section 2.03.03.D.1.C.5 of the Collier County Land Development Code (LDC), to permit
truck rental/leasing within the C-4 Zoning District and the Gateway Triangle Mixed Use
Subdistrict (GTMUD-MXD); and to insure that the community's interests are maintained.
CONSIDERATIONS:

The petitioner seeks a Conditional Use for an automobile and truck leasing/rental
establishment (SIC code 7513) within the C-4 and GTMUD-MXD zoning districts. While
the C-4 Zoning District pennits the rental of automobiles, it is the applicant's desire to also
offer truck rentals that has necessitated Conditional Use approval. (The GTMUD-MXD
overlay merely provides design standards and guidelines for new development and, as
such, does not regulate uses.) The subject property, having previously operated as an
outdoor sales center for storage sheds, is currently developed with an unoccupied 1,120
square-foot building and its associated asphalt parking lot. A Conditional Use for a boat
dealership was approved for the property in 1994 (Resolution No. 94-713) and again in
1997 (Resolution No. 97-251); however, none of the available County records indicate that
either was ever utilized.
FISCAL IMPACT:
The proposed truck leasing/rental establishment, in and of itself, will have no fiscal impact
on Collier County. There is no guarantee that the project, at build out, will maximize its
authorized level of development, however, if the Conditional Use is approved, a portion of
the existing land would be developed and the new development would result in an impact
on Collier County public facilities.

The County collects all applicable impact fees before the issuance of building pennits to
help offset the impacts of each new development on its public facilities. These impact fees
are used to fund projects identified in the Growth Management Plan's (GMP) Capital
Improvement Element (CIE) needed to maintain adopted Levels of Service (LOS) for
public facilities. Additionally, in order to meet the requirements of Section 1O.02.07(C) of
the Land Development Code, 50 percent of the estimated Transportation Impact Fees
associated with the project are required to be paid simultaneously with the approval of each
final local development order. Other fees collected before the issuance of a building permit

include building permit review fees and utility fees associated with connecting to the
County's water and sewer system.
It should be noted that the inclusion of impact fees and collected taxes are for informational
purposes only, and they are not included in the criteria used by staff and the Planning
Commission to analyze this petition.
GROWTH MANAGEMENT PLAN (GMP) IMP ACT:
Future Land Use Element (FLUE): The subject site is designated Urban Mixed Use
District, Urban Residential Subdistrict on the Future Land Use Map of the GMP. The
purpose of this subdistrict, as described in the FLUE, is to accommodate a variety of
residential and non-residential land uses, such as the proposed commercial automobile and
truck rental use. The site is also within the Bayshore/Gateway Triangle Redevelopment
Overlay, depicted in the Future Land Use Map Series. The intent of the overlay is to
encourage the revitalization of the Bayshore/Gateway Triangle redevelopment area through
private investment.
Transportation Element: The Transportation Planning Department reviewed the Traffic
Impact Statement (TIS) for the subject site, and did not find any adverse consistency issues.
Based on the above analysis, staff concludes the proposed Conditional Use may be deemed
consistent with the applicable elements of the GMP.
AFFORDABLE HOUSING IMPACT:
Approval of this Conditional Use would have no affordable housing impact.
ENVIRONMENTAL ISSUES:
There are no environmental issues associated with this Conditional Use.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION:
Pursuant to LDC Section 8.06.03 0.1 Powers and Duties, the EAC did not review this
petition because the site is already developed and is under the ten-acre threshold that
triggers the submission of an Envirorunental Impact Statement
COLLIER COUNTY PLANNING (CCPCl COMMISSION RECOMMENDATION:
The CCPC heard this petition at their July 3, 2008 meeting, and voted 8-0 to forward it to
the BZA with a recommendation of approval, subject to the following condition:
1. At the time of occupational licensing and zoning verification review and approval,
landscaping on the site shall be brought up to the level of that cUlTently required by
the LDC to the extent feasible.

LEGAL CONSIDERATIONS:
Before you is a Conditional Use for a truck leasing/rental establishment in the C-4 and
GTMUD-MXD zoning districts. A Conditional Use is a use that is permitted in a particular
zoning district subject to certain restrictions. Decisions regarding Conditional Uses are
quasi-judicial, and all testimony given must be under oath. The attached report and
recommendations of the Planning Commission required are advisory only and are not
binding on you. The petitioner has the burden of demonstrating that the necessary
requirements have been met, and you may question the petitioner, or staff, to satisry
yourself that the necessary criteria has been satisfied. In addition to meeting the necessary
criteria, you may place such conditions and safeguards as you deem appropriate to allow
the use, provided that there is competent, substantial evidence that these additional
conditions and safeguards are necessary to promote the public health, safety, welfare,
morals, order, comfort, convenience, appearance, or the general welfare of the
neighborhood. As a further condition of approval of the Conditional Use, you may require
that suitable areas for streets, public rights-of-way, schools, parks, and other public
facilities be set aside, improved, and/or dedicated for public use, subject to appropriate
impact fee credits. Approval or denial of the petition is by Resolution, with approval of the

REOUESTED ACTION:
To have the Collier County Planning Commission (CCPC) consider an application for

GEOGRAPHIC LOCATION:
The 0.98-acre subject propClty is located on the north side of the Tamiami Trail (US 41),
approximately 657 feet west of Commercial Drive, in Section 11, Township 50, Range

PURPOSE/DESCRIPTION OF PROJECT:

ANALYSIS:
Before any Conditional Use recommendation can be forwarded to the Board of Zoning
Appeals (BZA), the CCPC must make a finding that: I) approval of the Conditional Use

will not adversely affect the public interest; 2) all specific requirements for the individual
Conditional Use are met; and 3) satisfactory provisions have been made concerning the
following matters, where applicable:
1. Consistency with the Land Development Code and the Growth Management
Plan.
As noted above, this proposal is consistent with the provisions of the FLUE of the
GMP, and would fulfill the objective of the Bayshore/Gateway Triangle
Redevelopment Overlay, which encourages private investment within the
Bayshore/Gateway Triangle redevelopment area. Truck leasing and rentals are
allowed with Conditional Use approval in the C-4 Zoning District; and as
conditioned by staff, the proposal would be found consistent with all other
applicable provisions ofthe LDC.
2. Ingress and egress to the property and proposed structures thereon, with
particular reference to automotive and pedestrian safety and convenience,
traffic flow and control, and access in case of fire or catastrophe.
Ingress and egress to the subject property would be limited to one existing driveway
on US 41. (Transportation Planning has required the eastern access point, shown in
the background in the photo on page two, be closed,) The TIS submittcd by the
applicant indicatcs that the proposed use would actually gencrate fewer trips than
the outdoor shed sales center previously operating on the site. The minimum
parking requirements for automobile and truck leasing establishments contained in
LDC Section 4.05.04, Table 17, Parking Space Requirements, are one parking
space per 500 square feet of roofed building plus one parking space per 2,000
square feet of paved storage area. As the existing building is 1,120 square feet, two
parking spaces would be required (1,120 sq. ft./500= 2 spaces) plus 14 more spaces
to address the 27,444 square feet of paved storage area on the site (27,444/2,000=14
spaces), The applicant has exceeded this requirement by providing 38 spaces, two
of which would be handicappcd-accessible, in accordance with the Handicapped
Parking Requirements of Section 4.05.07.
3. The effect the Conditional Use would have on neighboring properties in
relation to noise, glare, economic or odor effects.
The proposed use would have no impact on adjacent properties, which are also
zoned C-4. Furthermore, as staff has stipulated that a site development plan (SDP)
or site improvement plan (SIP) be submitted to the County for this project, such
issues would be addressed at that time.
4. Compatibility with adjacent properties and other property in the district.
The surrounding properties are developed with other C-4 uses, including an auto
collision body shop to the west, and a Hertz Rental Car and a U-Haul Truck Rental

to the east. Although located in the GTMUD-MXD Zoning District, whic~,r~ires
additional design standards for redevelopment, this project, as it proposes to- re::uS-"
an existing building, would not be obligated to meet those standards. However, the
applicant would be required by staff to augment the existing landscaping on the site
to bring it up to the level of that currently required by the LDC to the extent feasible
at the time of occupational licensing and zoning verification review and approval.

The EnviromnentaI Advisory Council did not review this petition because the site is
already developed and is under the ten-acre size threshold triggering the submission of an
Environmental Impact Statement.

The NIM was duly noticed by the applicant and held on May 20, 2008 at 6:00 p.m. at the
subject site (the former location of Suncrest Sheds). The applicant's team, Bob Annibale
and Claudia Haney of Avis Budget Group, along with the property owner, Michael
Corradi, and County staff were in attendance. No one from the public attended; and at
6: 15 p.m. the meeting was officially adjourned.
Subsequent to the NIM, staff has received no correspondence regarding this petition.

a. Describe how the project is consistent with the Collier County Land
Development Code and Growth Management Plan (include information on
how the request is consistent with the applicable section or portions of the
future land use element):
Response: The proposed tIuck rental is consistent with the Future Land Use
Element's Bayshore/Gateway Triangle Redevelopment Overlay and its intent to
encourage revitalization of this urban area by providing incentives for the private
sector to invest. Plan Policy (IX)(F) Bayshore/Gateway Triangle Redevelopment
Overlay indicates that "The intent of this Overlay is to allow for more intense
development in an urban area where urban services are available." The Gateway
Triangle Area is also targeted as a Community Redevelopment Area per
Resolution 2000-82. The proposed truck rental use is permitted as a Conditional
Use in C-4 zoning by the County's LDC resulting in the revitalization of a vacant
business on US 41/Tamiami Trail.
b. Describe the existing or planned means of ingress and egress to the property
and proposed structure thereon with particular reference to automotive and
pedestrian safety and convenience, traffic flow and control, and access in
case of fire 01' catastrophe:
Response: No stIuctures are proposed by this Conditional Use request for a truck
rental on a site which was occupied by outdoor shed sales until the end of
November, 2007. The attached site plan shows the layout of 36 parking spaces,
the existing 1,120 square feet building which will be used as the rental office and
the two existing access points which will continue to be used as ingress and egress
for the proposed vehicle rental. The parking layout meets or exceeds Chapter
4.05, Off Street Parking and Loading of the Land Development Code as it relates
to stall size and two-way aisle widths for pedestrian safety and convenience as
well as efficient traffic flow and control and emergency access.
c. Describe the effect the conditional use will have on neighboring properties in
relation to noise, glare, economic impact and odor:
Response: The proposed conditional use for vehicle rental including trucks will
have little or no impact on the neighboring properties regarding noise, glare and
odor or from an economic standpoint because there are similar uses in the
immediate area. The existing C-4 zoning pelmits auto rentals, automotive services
and gasoline service stations as well as building materials, hardware, garden

Response: The subject site is located in an area that is predominantly developed
with auto sales and auto repair type uses such as an auto collision shop (1911
Tamiami Trail), Hertz Car Rental (1991 Tamiami Trail) to the east of the Property
and a U-Haul Truck Rental further east. The proposed truck rental is in keeping
with the surrounding uses that already exist in this area. In addition, the Property
has been granted Conditional Use approvals in the past for used car and boat sales
and shed sales. I

Response: TIle proposed vehicle rental including tlUcks will occupy an existing
commercial site that has been vacated in an area zoned C-4 where urban
revitalization is encouraged by Plan policies. The proposed truck rental is
compatible with sUll'Dunding uses in the area and is not expected to have a
negative impact on either the adjacent uses or the general area as a whole. The
Propeliy has previously been granted Conditional Use approvals for used boats
and auto sales and shed sales. The Conditional Use process gives both the
recommending entities as well as the decision maker the oppOliunity to review the
proposed site plan and confirm that ingress and egress to the Property will be safe
and convenient for both vehicles and pedestrians.

the above referenced address.
Project Description
The purpose of this Conditional Use is to permit a Budget truck rental within an
established commercial area zoned C-4 at the southeast quadrant of Tamiami Trail and
Davis Boulevard in unincorporated Collier County. Budget intends to operate a truck and
auto (vehicle) rental on the above referenced property (the Property). The existing C-4
zoning permits an auto rental but requires a Conditional Use for truck rental.

Size: 0.98 acres (per survey)
Zoning: C-4 and Gateway Triangle Mixed Use Overlay District
Plan: Bayshore Gateway Triangle Redevelopment Overlay
The 0.98 acre Propelty consists of two parcels; Folio #'s 00388480009 and 77510200006
which are under the same ownership. The proposed vehicle rental office will occupy the
existing 1,120 square feet structure located at 1965 Tamiami Trail on Folio
#00388480009. Folio # 77510200006 is located at 1933 Tamiami Trail on the western
side of the Property. It was confirmed by the Addressing Department, that the address
assigned to the proposed truck rental is 1965 Tamiami Trail.
Plan and Zoning
The proposed truck rental is located within the Bayshore/Gateway Triangle
Redevelopment Overlay of the Future Land Use Element and within the C-4, General
Commercial zoning district and the Gateway Triangle Mixed Use Overlay District.
Existing uses surrounding the Property include an auto collision shop to the west and
Hertz Rent a Car and a U-Haul Truck Rental to the east.
Parking
Parking requirements for auto/truck/trailer leasing per Section 4.05.04 Parking Space
Requirements of the Land Development Code are 1 per 500 square feet of roofed
building area plus 1 per 2,000 square feet of paved out door vehicle storage area. These

spaces shall not be used for the parking of rental vehicles. It is estimated that' c--- ~ !
approximately 8 parking spaces are required for non-vehicle storage. The proposed site
plan shows 36 parking spaces including the required 2 handicapped spaces.
Access
The Property contains two existing access points. These access points will continue to be
used for ingress and egress. These access points were used by the previous outdoor shed
sales until it closed at the end of November, 2007, The proposed site plan shows the
existing access points, the existing stlUcture and proposed parking spaces which insure
safety for both traffic and pedestrian flows.
Traffic
This CD application for a truck rental use will generate fewer trips than the previous
outdoor shed sales. The attached trip Generation table shows a net decrease of 1.18 trips
in the peak hour between 4 and 6 p.m. when comparison is made between a Building
Materials and Lumber Store (812) and an Automobile Care Center (942).
CU Application Submittal Checklist Items
1. The pre-application meeting for this petition was held on January 31, 2008 when
it was determined that architectural review would not be applicable since there
would be no renovations to the existing building (See pre-application meeting
notes made by Linda Bedtelyon).
2. On February 12, 2008 following discussions with the County Landscape Architect
and Manager, it was determined that the site would not have to meet current
Code. However, the dead landscaping should be replaced so that it meets Code
requirements at the time of the building's construction (See email from John-
David Moss dated FeblUary 12, 2008)
3. Gateway Overlay Landscape Buffer requirements are not applicable because there
will be no structural changes (see Conditional Use Application Submittal
Checklist and February 12, 2008 email).
4. According to Annis Moxam, Addressing Department, the address for the
proposed truck rental will be 1965 Tamiami Trail.
5. An email from John Podczerwinsky dated February 25, 2008 waives a
Transportation Impact Statement and confirms the applicable transpOltation
methodology for the attached trip generation table.
