Recommendation to approve a Statutory Deed between the Collier County Solid
Waste Department and the Collier County Airport Authority for 1.01 acres for the
Marco Island Executive Airport, at a cost not to exceed $25.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) for
execution of the attached Statutory Deed (Deed) between the Board on behalf of the Solid
Waste Department (Solid Waste) to the Board on behaif of the Airport Authority (Airport).
CONSIDERATIONS: On April 25, 2006, Agenda Item 16C4, the Board approved a Real Estate
Exchange Agreement with the City of Marco to exchange the County's existing Marco Island
Recycling Center property for two City of Marco properties consisting of two lots, lying westerly
of and directly across East Elkcam Circle from the existing County Recycling Center, and one
City of Marco parcel abutting the Marco Island Executive Airport. Closing with the City of Marco
occurred on February 12, 2007.
Funds were transferred from the Airport to Solid Waste in April 2006; however, a Statutory Deed
for the Airport parcel has not yet been recorded. The Statutory Deed is necessary to ensure the
eligibility of any Federal Aviation Administration grant funding for the Marco Island Executive
Airport.
FISCAL IMPACT: Recording fees for the transaction shall not exceed $25, These funds shall
be withdrawn from the Airport Authority Grants Fund (496),
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
the Board's approval of the Airport's requests, and this project is in compliance with the
Authority's Marco Island Master Plan,
LEGAL CONSIDERATIONS: The Statutory Deed has been reviewed and approved by the
County Attorney's Office, - JAB
RECOMMENDATIONS: Staff is recommending that the Board of County Commissioners:
1) Approves the attached Statutory Deed and authorizes the conveyance and the
acceptance of the parcel between Solid Waste and the Airport;
2) Authorizes the Chairman to execute the Statutory Deed; and
3) Directs the County Manager or his designee to proceed to record the Statutory Deed.

STATUTORY DEED
THIS DEED, made this _ day of , 2008, by COLLIER
COUNTY, a political subdivision of the State of Florida, on behalf of the Solid Waste
Department, whose mailing address is 3301 Tamiami Trail East, Naples, Florida
34112, (hereinafter called the Grantor), to COLLIER COUNTY, a political subdivision
of the State of Florida, on behalf of the Airport Authority for the Marco Island
Executive Airport, whose mailing address is 3301 Tamiami Trail East, Naples, Florida
34112, (hereinafter called the Grantee).
(Whenever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument
and their respective heirs, SUCCessors or assigns,)
WITNESSETH that the Grantor, for and in consideration of the sum of Ten
Dollars, ($10,00) to it in hand paid by the Grantee, receipt whereof is hereby
acknowledged, does hereby grant, bargain and sell unto the Grantee, the following
described land lying and being in Collier County, Florida:

Subject to easements, restrictions, and reservations of record.

That portion of Tract 0, Marco Shores Unit One, a subdivision according to the
Plat thereof as recorded in Plat Book 14, Pages 33 through 38, Public Records of
Collier, Florida, more particularly described as follows:
Beginning at the northeast corner of Tract "0"; thence along the east line of said
Tract "0", South 11059'55" East, 332.93 feet to a point on the north right-of-way
line of Mainsail Drive according to the plat of said Marco Shores Unit One;
thence along said right-of-way line South 77054'19" West 131.94 feet; thence
leaving said right-of-way line North 12000'24" West 307,62 feet to a point on the

( a) An appeal or request for a hearing that is not submitted within the time
limits as prescribed for each step, where no written extension has been
granted by the due date, shall be considered untimely; and, unless the
lack of timeliness results from circumstances over which the employee
has no control, untimely requests will not be considered, An appeal or
request for hearing not taken to the next step within the time limits shall
be considered settled on the basis of the last answer provided by
management. An appeal or request for a hearing that is not answered
within the time limits prescribed for the appropriate management
representative at each step shall entitle the employee to appeal to the
next step,
(b) The time limits prescribed herein may be extended for good and
sufficient reasons by management due to short term illness, vacations,
business trips, scheduling/workload conflicts, or emergencies, when
deemed in the best interest of assessing all available information to
arrive at an equitable solution. If the time limits are extended, the
employee will be so advised in writing.
(c) The time limits as set forth in this procedure for the processing of
complaints and responses by management shall remain the same for
employees regardless of work schedules. For the purpose of tms
discipline procedure, the working day shall be defined as regular
business hours Monday through Friday. An employee who seeks an
extension of the time limits set forth herein must make the request to the
Human Resources Director in writing prior to the expiration of the time
period to be extended,
(d) A court reporter shall be utilized to document the post disciplinary
demotion and post termination appeal processes,

Collier County Personnel Ordinance, Ordinance No. 200 I-50: Discipline: It is the policy
of the County to implement a policy of positive progressive discipline. The County
believes employees are the most vital resource of County government. Therefore,
Supervisors must take positive corrective action whenever practical. The disciplinary
procedures apply only to all regular full-time and part-time employees below the level of
Section Heads, Department Directors, Division Administrators, and all supervisory
employees directly reporting to the Board of County Commissioners, County Attorney,
and County Manager are exempt from the disciplinary policy, serve at the will of the
County, and may be discharged for any reason, All contractual employees of the County
are exempt from the disciplinary policy.
