Recommendation that the Board of County Commissioners approves and authorizes its
Chairman to sign an Agreement between Collier County and VI Ltd., Limited Partnership,
regarding professional services that VI Ltd. will provide to Collier County for Collier
County beach amenities on Bluebill Avenue.
Obiective: Request that the Board of County Commissioners approves and authorizes its
Chairman to sign an Agreement between Collier County and VI Ltd" Limited Partnership
regarding professional services that VI Ltd. will provide to Collier County for beach amenities
on Bluebill Avenue.
Considerations: VI Ltd, is a local development company that is currently developing the
Moraya Bay Beach Tower Condominiums adjacent to County-owned land on Bluebill Avenue.
In a June 14, 2005 settlement agreement with VI Ltd., the developer agreed to provide the
County with beach access amenities. The developer also paid the County $500,000 toward these
beach amenities as per additional conditions of the settlement agreement.
This agreement contracts with VI Ltd. to provide professional services for these beach amenities.
These services include the engineering, design, zoning, planning, and permitting support for the
utilities to site, the right-of-way, beach access, public restroom facilities, landscaping, fencing,
paver walkway and dune walkover for $278,825.00 on a not-to exceed, cost reimbursable basis.
A future agreement between Collier County and VI Ltd will contract the construction of these
amenities/facilities once the design is completed, This future construction agreement will be
brought to the Board of County Commissioners for approval when it is completed.
Construction of these facilities will be concurrent with the Moraya Bay Beach Tower
Condominium project with completion no later than June 1,2009. Upon completion, Collier
County will be provided title to these facilities and assume responsibility for maintenance and
operating expenses.
This project provides beach access and public restroom facilities to a portion of the beach where
none previously existed.
Advisorv Committee Recommendations: No Advisory Committees have reviewed or
contributed to this proposal.
County Attornev Findinl!s: The County Attorney's Office has reviewed and approved this
item. It is legally sufficient for Board action. - CMG.
Fiscal Impact: Capital funding for this project will be from a previously provided developer
contribution to the County. Additional capital funds required for construction will be from
Tourist Development Tax Fund 183 Beach Park Facilities.
