EXECUTIVE SUMMARY
Recommendation to recognize and accept revenue for Collier Area Transit in the
amount of $5,000 and to approve needed budget amendmeuts.
OBJECTIVE: To recognize and accept revenue in the amount of $5,000 for Collier Area
Transit and to approve needed budget amendments.
CONSIDERATION: Ordinance No. 05-22 adopted by the Board of County Commissioners
on May 10, 2005, created the Wilson Boulevard Center CPUD. Section 4.9 Transportation,
Item K reads:
"K. At the time of the first application for site development plan, the petitioner shall
contrihute $5,000 to the Collier County School District for acquisition and/or construction of
a public school bus stop to be located as close as possible to the subject site and be subject to
approval by the Department of Alternative Transportation Modes."
In the past, the School Board in conjunction with the County, installed bus shelters in the
Estates area for children. This was part of a one time school bus shelter grant program that
the Department of Alternative Transportation Modes helped administer and construct. The
School Board no longer supports the construction of school bus shelters due to changing
school bus stop locations. School bus stops are located where the students are. Permanent
structures do not necessarily meet the needs continually.

The Transportation Department of Collier County working with the Hoover Planning &
Development Corp. collected $5,000 towards the future purchase and construction of a CAT
bus shelter as a part of a PUD commitment, since school bus shelters no longer are
constructed. Collier County Department of Alternative Transportation Modes received a
check from Hoover Planning & Development Corporation in the amount of $5,000 towards
the purchase and construction of a bus shelter.
A budget amendment is needed to recognize the $5,000 revenue in Fund 426 Project 60083
for capital bus shelter expenses.
FISCAL IMPACT: To approve the budget amendment in the amount of $5,000 for bus
shelters.
LEGAL CONSIDERATIONS: This executive summary has been reviewed for legal
sufficiency. It is ready for Board consideration and approval- HFAC.
GROWTH MANAGEMENT IMPACT: Consistent with Ohjectives 10 and 12 of the
Transportation Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners recognizes and accepts
revenue in the amount of $5,000 for Collier Area Transit and approve necessary budget
amendments.

Dear Jeff:
Claudine Auclair of the Transportation Planning Department has requested our
advice as to whether the School District is able to accept a $5000.00 contribution from
the developer of the Wilson Boulevard Center PUD under the County's Ordinance 05-
22 for the purpose of acquiring and constructing a bus stop shelter.
The short answer is that we are not in a position to do so, and to confirm that the
County is authorized to accept and utilize the contribution for that purpose.
The longer answer is that the District does not construct offsite bus stop shelters.
This is due to a combination of factors including issues of statutory authority,
acquisition, and actual construction of such facilities. Bus stop shelters which now exist
around the county are apparently the work of civic organizations and developers, but
not the work of the District. If the District tried to get involved in acquiring and
constructing such facilities, application of the Jessica Lunsford Act would appear
to present an insurmountable obstacle in terms of use of the facilities by our students.
