EXECUTIVE SUMMARY
Recommendation to review and approve the recommendation of the Public
Vehicle Advisory Committee (PVAC) to adopt a fuel surcharge relating to
taxi rates.
OBJECTIVE: To have the Board of County Commissioners (Board) review and
approve the recommendation of the Public Vehicle Advisory Committee (PV AC) relating
to taxi rates.
CONSIDERATIONS: On June 24, 2008, pursuant to Section l42-35(d) of the Vehicle
For Hire (VFH) Ordinance, the Board directed County Manager to investigate taxi rates
and prepare a report to the PV AC. Pursuant to this direction, the Code Enforcement
Department prepared a report to the PV AC. The PV AC reviewed the report at their
regular August meeting and based on this report, voted to recommend that the Board
adopt a resolution amending taxi rates through the use of a per trip fuel surcharge. Under
Section l42-35(d), rate changes resulting trom this process are considered at a public
hearing, and are set by Board resolution. The PV AC recommends the following per trip
surcharge schedule: Gasoline price' Trip surcharge $3.00None $3.50$1.00
$4.00$1.50 $4.50$2.00 $5.00$2,50 $5.50$3.00 The recommended index for
gasoline price is the average weekly price of regular unleaded gasoline, as listed by the
U.S. Energy Information Administration for the Miami area. Of the available indices,
Miami area gas market prices are (historically) the closest to Naples-Collier County gas
market prices. In order to implement the fuel surcharge schedule, the average weekly
price of regular unleaded gasoline must stay at or above a level on the above chart for
three consecutive weeks. Inversely, if the average weekly price of regular unleaded
gasoline falls below a level on the above chart for three consecutive weeks, the fuel
surcharge will be reduced accordingly
FISCAL IMPACT: There is no fiscal impact to the County, but the fiscal impact
to the taxi industry and the public may be increased (or decreased), depending
on the price of gasoline.
GROWTH MANAGEMENT IMPACT: There IS no growth management impact
associated with this request.
LEGAL CONSIDERATIONS:
RECOMMENDATION: That the Board approve the recommendation of the
PVAC to adopt a resolution adopting the above fuel surcharge

OF COLUER COUNTY, FLORIDA, ACTING AS THE PUBLIC
VEHICLE BOARD, APPROVING THE RECOMMENDED RATE
ADJUSTMENTS AND ESTABUSHING THE PUBLIC VEHICLE
ADVISORY BOARD FEE SCHEDULE AND PROVIDING FOR AN
EFFECTIVE DATE.
RESOLUTION NO. 2008-
WHEREAS, Section 125.01(1)(n), Florida Statutes, provides counties authority to
regulate taxis; and
WHEREAS, pursuant to this authority, the County has enacted Ordinance No.
2006-59 (the "Public Vehicle for Hire Ordinance"), Section 142-35(n), which provides
Rate Change Procedures; and
WHEREAS, on June 24, 2008, the Board of County Commissioners (BCC)
authorized the initiation of Rate Change Procedures; and
WHEREAS, pursuant to this authorization, County staff prepared and presented a
report to the County Public Vehicle Advisory Committee (PVAC) during their August 4,
2008 meeting; and
WHEREAS, the PVAC reviewed the information presented by staff, and voted to
recommend the adoption of a fuel surcharge to counter the adverse effects of high gas
prices; and
WHEREAS, a public hearing was held before the BCC (sitting as the County Public
Vehicle Board), as required in the Rate Change Procedures; and
WHEREAS, the BCC has reviewed the PVAC recommendation and related
information provided by staff, and has voted to change taxi rates by adopting a
resolution providing for a fuel surcharge; and
WHEREAS, this taxi rate change is in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners hereby declares that the rates and terms set
forth in the per trip fuel surcharge schedule (attached as Exhibit A) are all fair and
reasonable sums relating to taxi rates, in light of the recent volatility in the price of
gasoline.

BE IT FURTHER RESOLVED that the adoption of a fuel surcharge is '~~h~Ebu8Iic/~;y

BE IT FURTHER RESOLVED that the Board hereby approves and adopts the
attached per trip fuel surcharge schedule, and the County Manager (or his designee) is
hereby given authority to implement and administer same.
BE IT FURTHER RESOLVED that this Resolution, along with the attached Exhibit A,
be recorded in the minutes of the Board of County Commissioners, with an immediate
effective date upon Board approval.
This Resolution adopted after motion, second and majority vote.
