Agenda 09/09-10/2008 Item #16A 5 EXECUTIVE SUMMARY , L0~S 1 SEP G, ?'I" ~. f~ ~il.;:j Pg 1.+ I Recommendation to execute a Quit Claim Deed as satisfaction for subdivision improvements for various projects developer by Lely Estates and Lely Development Corporation OBJECTIVE: To execute a Quit Claim Deed as satisfaction for subdivision improvements which were completed in the 1980's. CONSIDERATIONS: In 1985 and 1987, as was the practice at the time, Lely Estates and Lely Development Corporation respectively granted Trust Deeds to Collier County as security for subdivision related improvements in the following subdivisions: Lely Barefoot Beach, Lely Palmetto Dunes, Torrey Pines, Timbercreek I and II, Tanglewood I and II, Muirfield Woods. The required subdivision improvements within these subdivisions has been completed. Although the conveyances under the Trust Deeds became null and void at the completion of the improvements, the developer wishes to clear title by having the County record a Quit Claim Deed for the property which was posted as the subdivision security. Stock Development LLC is the successor to Lely Development Corporation. Engineering and Environmental Services Department and the County Attorney's Office recommends that the Chairman execute the Quit Claim Deed. FISCAL IMPACT: The County will realize revenues as follows: Fund: Community Development Fund 131 Agency: County Manager Cost Center: 138327 -- Engineering Project Review Revenue generated by this project: No revenue associated with this project. GROWTH MANAGEMENT IMPACT: There IS no growth management impact associated with this approval. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Quit Claim Deed and associated legal documents for legal sufficiency.
