OBJECTIVE: Award Bid #08-5061 "Golden Gate Parkway (Livingston Road to 66th Street)
and 60tl' Street to Santa Barbara Blvd.) Roadway Grounds Maintenance" to Ground Zero
Landscaping Services, Inc_ in the amount of $41,651.39 for approximately one and a half (1.5)
miles oflandscaping and irrigation.
CONSIDERATIONS: On May 6, 2008, the Purchasing Department sent out two hundred and
seventy-two (272) notices for the Golden Gate Parkway (Livingston Road to 66th Street) and
(60th Street to Santa Barbara Blvd.) Landscape Maintenance Contract and forty-seven vendors
(47) downloaded the documents. On May 8, 2008, a non-mandatory pre-bid meeting was held,
On June 25, 2008 five (5) bids were opened. Staff reviewed bids and the lowest bid was
submitted by Hannula Landscaping and Irrigation, Inc. with offices in Lee County. The second
lowest bidder, Ground Zero Landscaping Services, Inc. had provided an Affidavit for Claiming
Status as a Local Business. Ground Zero Landscaping Services, Inc. was within 10% of the low
bid and met the requirements ofFS 287.087 and accepted the award at the lowest bid price. Staff
recommends awarding to Ground Zero Landscaping Services, Inc. in the amount of $41 ,651.39.

( .-. This item was originally submitted for the Board of County Commissioners' agenda on July 22,
2008 and was withdrawn at staff's request due to formal protest. A copy of the protest and the
Purchasing Director's decision are enclosed.
FISCAL IMP ACT: This maintenance contract is a one year contract with three, one year
renewals_ Sufficient budget exists to begin the contract in FY 08 MSTD General Fund (III),
Cost Center 163831 in the amount of $6,942. The FY 09 proposed budget in MSTD General
Fund (lll) appropriates funds for one complete year of maintenance for the low bid contract
amount of $41 ,651.39,
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners award Bid #08-5061
"Golden Gate Parkway (Livingston Road to 66th Street) and (60th Street to Santa Barbara Blvd.)
Roadway Grounds Maintenance" to Ground Zero Landscaping Services, Inc. and authorize the
Chairman to execute the standard contract after review by the County Attorney's Office in the
amount of$41,651.39.

This letter will serve as our "Formal Protest" for Solicitation Number 08-5061, Golden
Gate Parkway (Livingston Rd. -,66th. S1. SW), (60th. St. SW SantaBarbara) Landscape
Maintenance. Whereas the following is our conclusion regarding the submittal of pricing
and award of the contract for Solicitation Number 08-5061.
I.. Bids were submitted on Jurle 25, 2008.
2. The bid results are as follows:

through the loss of interest in County business from out of town vendors and possible
difficulties in administering and enforcing the provision of the policy.
Protest:
I. It is understood that Groundzero has indicated on the Affidavit For Claiming
Status As A Local Business, that Groundzero is a business with an address in
Collier County and has (I) employee residing in Collier County. It is unknown
whether Groundzero possesses a local business license for the work to be
contracted.
2. Hannula Landscaping And Irrigation Inc_ is a Contractor that has been licensed
and conducted work in Collier County for fifteen years. The Physical Address is
28131 Quails Nest Lane, Bonita Springs, 34135, which is located approximately
9/1 Oths of a mile form the Collier / Lee County border in Lee County. Over the
past fifteen years, Hannula Landscaping And Irrigation, Inc. has competitively bid
on and been awarded projects in Collier County. During that time we have
performed landscaping, site work, irrigation, and maintenance services for well
over twenty-five miles of medians and right of ways. We have met all contractual
obligations and professional requirements in order to be considered qualified to
perform work in accordance with the expertise and professionalism required by
Collier County.
3. Over the past years Hannula Landscaping And Irrigation has contributed
significantly to the economic well being of Collier COWlty. The following is an
example of purchases made from businesses with addresses in Collier County
which have helped support the local business environment:

4. In addition, Hannula Landscaping And Irrigation, Inc. employs a considerable

It anticipated that 2008 will be comparable to the average of the past three years
depending on the overall impact the general economy has on local business.

I. Hannula Landscaping And Irrigation, Inc. does not have a physical address in
Collier County and therefore cannot claim "Local Status". However, we do
contribute to the "economic development and well-being of Collier County in a
verifiable and measureable wav " as evidenced by the purchases made from Collier
County vendors and the number of employees that we employ who reside in Collier
County. On this basis we feel we meet the local status.
2_ Hannula Landscaping And Irrigation, Inc. has and pays for the required
occupational licenses required to conduct business in Collier County.
3. The Local Vendor Preference policy states that Post Office Boxes are not
verifiable and shall not be used for the purpose of establishing said physical address.
However, there is no definable explanation of what does qualify as a physical address
and verifiable business, For example, is a non-local business with a satellite office in
Collier County considered a local business? If so, what is the definition of a satellite
office?
4. The Local Vendor Preference Policy restricts the ability for a non-local vendor to
conduct business in Collier County. In our case it has a significant impact on our
commitment to provide jobs for our employees who reside in both Collier and Lee
Counties.
Hannula Landscaping And Irrigation asks that we be considered a Local Vendor
based on the impact we have on the economic well being of Collier County which is
in essence the underlying basis for the policy, not meerly a physical address.

RE: Protest Decision, ITB 08-5061, Golden Gate Parkway (Livingston Rd to 66th
ST SW and 60th St SW to Santa Barbara Blvd) Landscape Maintenance
Dear Mr. Hannula:
I am in receipt of your formal protest letter of July 27,2008, regarding the referenced
contract award. The following is a summary of issues that have been raised in your protest
and findings regarding each issue.
1. Hannula Landscaping and Irrigation has been licensed to do business in Collier County
for 15 years and possesses a Collier County occupational license as expressly required
in the local vendor preference policy. It is not known whether the recommended
awardee, Ground Zero Landscaping Services Inc., possesses the required occupational
(e.g.; "local business") license for the work to be performed.
FINDINGS: Ground Zero Landscaping possesses a Occupational License in Collier
County. The description of the license includes "Landscaping Unlimited Contractor".
The current license number is 900366. A copy of the referenced information is enclosed.
2. Hannula Landscaping physical business address is not located in Collier County.
Rather it is located in Lee County less than one mile from the Lee/Collier County line.
However, Hannula Landscaping does contribute to the economic development and well
being of Collier County in "a verifiable and measurable way" as set forth in the local
preference policy. To wit, over the last three full years, Hannula Landscaping and
Irrigation has transacted $7,349,875 in purchases with Collier County businesses.
Additionally, Hannula Landscaping has employed between 26 and 37 Collier County
residents over that same time period and has paid wages to these individuals totaling
$2,324,628.09.
FINDINGS: Under Section XI. (1) of the County's purchasing policy, in order for a
vendor to be considered '10cal" and be eligible for local preference, each of the following
must be true:

a. The vendor must hold a valid occupational license issued by Collier County.
b. The vendor must have a physical business address within Collier County
The vendor must contribute to the economic development and well-being of Collier
County in a verifiable and measurable way.

Pursuant to tendering its bid offer, Ground Zero Landscaping has signed and submitted
the required "Affidavit for Claiming Status as a Local Business" representing that it
meets each of the three criteria.. Though the policy does not require Collier County to
independently collaborate these representations, Purchasing Department staff has
obtained and enclosed the requisite licensing information. Further, under the same
form, Ground Zero has stated that it employs 10 Collier County residents.
3. The present local preference policy does not expressly define what constitutes a
physical address.
FINDINGS: The policy does not define the phrase "physical address" other than to
expressly exclude post office boxes from the definition. The plain understanding of the
phrase would be a permanent fixed location where business is regularly conducted
within the legal boundaries of the County.
4. The local preference policy restricts the ability for a non-local vendor to conduct
business in Collier County and by extension to create and maintain employment for
residents of Collier County and other counties.
FINDINGS: The policy was adopted by the Board of County Commissioners with the
expressed intention of helping businesses physically located within Collier County
compete for County work. Any changes to the policy would have to be approved by the
Board.
After reviewing the information submitted in the protest, there does not appear to be any
evidence that the County's local vendor preference policy as written was improperly
applied. Therefore, it is the decision of this office to reject the protest and to authorize staff
to proceed with submission of the award recommendation to the Board for action.
Under Section XIX.F of the County's purchasing policy, the decision of the Purchasing
Director shall be considered final and conclusive unless the protestor delivers a subsequent
written objection to my attention within two business days from the date of receipt of this
decision or not later than close of business on Friday, August 15, 2008.
