A RESOLUTION OF THE COLLIER COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING STAFF TO NEGOTIATE A LEASE
FROM THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION TO AUTHORIZE THE COUNTY'S USE OF
ADJACENT STATE LANDS FOR EXPANSION OF TIlE EXISTING 951
BOAT RAMP FACILITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Collier County determined that additional parking space is needed adjacent
to the existing 951Boat Ramp, and
WHEREAS, The State right-of-way of the east side of State Road 951 is available for
construction of additional parking facilities and limited expansion of boat ramp facilities;
WHEREAS, the filled lands of the existing 951 Boat Ramp. parking lot land and
adjacent lands 800 linear feet to the North and 800 Imear feet to South, are available for these
uses from the State of Florida, Department of Transportation, and
WHEREAS, the State ot Florida Department of Transportation requires that a leasing
agreement be entered into between the Department and the County for the use of these lands and
that a resolution be adopted by the Board of County Commissioners approving a long-term
leasing arrangement with the Department prior to the Department's preparing such an agreement;
and
WHEREAS. The boat ramp facilitie, are currently used by the public and additional
parking facilities are needed; and
WHEREAS, the precise terms of the lease will be negotiated by staff and will be subject
to the Board's final agenda approval.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, F'LORIDA, that:
I. The Board of County Commissioners hereby approves staff negotiating a leasing
agreement with the State of Florida, Department of Transportation for the County's
use of State property for a period of ninety-nine (99) years or less.
2. Staff is authorized to negotiate the terms of the subject leasing agreement.
3. The subject property shall be useq only for public purposes, including, but not
limited to, parking of motor vehicles and boat launching trailers.
4. It is mutually understood that Collier County will comply with all laws, rules, and
regulations of the Stale of Florida and the Federal Government and that any
agreement with the Department of Transportation will not be transferable or
assignable to any person or firm.
5. This resolution shall become effective immediately upon adoption.
