EXECUTIVE SUMMARY
This is a recommendation to grant final approval of the roadway (private)
and drainage improvements for the final plat of Masters Reserve, Phase
Two (Lely Resort PUDlo The roadway and drainage improvements will be
privately maintained.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Masters Reserve, Phase Two.
CONSIDERATIONS:
1. On July 28, 2003, Engineering and Environmental Services Department
granted preliminary acceptance of the roadway and drainage
improvements in Masters Reserve, Phase Two.

2. The roadway and drainage improvements will be maintained by the
project's homeowners association and Community Development District
respectively.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office, A copy of the document is attached.
5. On January 28, 2003, the Board entered into a Construction and
Maintenance Agreement for Subdivision Improvements with the
developer. The developer has fulfilled his obligations with respect to the
Construction and Maintenance Agreement.
6. A letter from the Masters Reserve Homeowner's Association is attached.

7. The Lely Resort PUD is currently under development and at this time of
submittal it has been determined that not all PUD commitments have been
fulfilled. Environmental: on going as preserve areas are platted concurrent
with development; Transportation: on going, bids have been requested for
fair share contribution towards a traffic signal; Storm-water: conveyance of
storm-water easement and allowance for storm-water routing from CR 951
through project is currently under review.

FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association and Community Development District respectively.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency. JW
RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage improvements in Masters Reserve, Phase Two and release the
maintenance security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

RESOLUTION NO. 08-_
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTHORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN MASTERS
RESERVE, PHASE II ACCORDING TO THE
PLAT THEREOF RECORDED IN PLAT BOOK
39, PAGES 63 THROUGH 66; RELEASE OF THE
MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY THE
MASTERS RESERVE HOMEOWNERS'
ASSOCIATION,INC.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
January 28, 2003 approved the plat of Masters Reserve, Phase II for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-41, as
amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
WHEREAS, the Engineering and Environmental Services Section of the
Community Development Department has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements in Masters Reserve, Phase II
pursuant to the plat thereof recorded in Plat Book 39. pages 63 through 66, and the Clerk
is hereby authorized to release the maintenance security.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required to be maintained by the Masters Reserve
Homeowners' Association, Inc.
This Resolution adopted after motion, sccond and majority vote favoring same,

I hereby certify that I am a board member within the subdivision project knO'Ml as
Masters Reserve in Lely Resort. r also certify that I am a legally elected representative of
the HOA and have no legal tics to the deve1oper(s) of Masters Reserve_

The developer and his professional engineer, WaJdrop Engineering, have explained to our
HOA the functioning of the water management system within our development. The
responsibility with respect to maintenance of the water management system, including
the lakes, culvert structures, drainage, and littoral zone plantings lies with Lely
Community Development District and is not the responsibility of MR HOA. We are
aware of our responsibility to maintain the roadways, sidewalks, street lighting,
landscaping, and to implement a program of constant removal of exotic vegetation within
our community.
We are not aware of any outstanding developer commitments or responsibilities with
respect to our subdivision, or the Lely Resort PUD. We have attended the final site
inspection of the project by representatives of Collier County and have no objection to
the release of all performance bonds or maintenance bonds of any kind. If] can be of any
