Agenda 06/10/2008 Item #16A 6 Agenda Item No. 16A6 June 10, 2008 Page 1 of 9 /- EXECUTIVE SUMMARY This is a recommendation to grant final approval of the roadway (private) and drainage improvements for the final plat of Masters Reserve, (Lely Resort PUDlo The roadway and drainage improvements will be privately maintained. OBJECTIVE: To grant final approval of the infrastructure improvements associated with that subdivision known as Masters Reserve. CONSIDERATIONS: 1. On July 28, 2003, Engineering and granted preliminary acceptance improvements in Masters Reserve. Environmental Services Department of the roadway and drainage ,..-, 2. The roadway and drainage improvements will be maintained by the project's homeowners association and Community Development District respectively. 3. The required improvements have been conslructed in accordance with the Land Development Code. The Engineering and Environmental Services Department has inspected the improvements and is recommending final acceptance of the improvements. 4. A resolution for final acceptance has been prepared and approved by the County Attorney's Office. A copy of Ihe document is attached. 5. On September 11, 2001, the Board entered into a Construction and Maintenance Agreement for Subdivision Improvements with the developer. The developer has fulfilled his obligations with respect to the Construction and Maintenance Agreement. 6. A letter from the Masters Reserve Homeowner's Association is attached. r' 7. The Lely Resort PUD is currently under development and at this time of submittal it has been determined that not all PUD commitments have been fulfilled. Environmental: on going as preserve areas are platted concurrent with development; Transportation: on going, bids have been requested for fair share contribution towards a traffic signal; Storm-water: conveyance of storm-water easement and allowance for storm-water routing from CR 951 through project is currently under review. GROWTH MANAGEMENT IMPACT: There is no growth management impact. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Resolution for legal sufficiency. JW RECOMMENDATION: That the Board of County Commissioners grant final acceptance of the roadway and drainage improvements in Masters Reserve and release the maintenance security. 1. The responsibility with respect to maintenance of the water management system, including the lakes, culvert structures, drainage, and littoral zone pIantings lies with Lely Community Development District and is not the responsibility of MR HOA. We are aware of our responsibility to maintain the roadways, sidewalks, street lighting, landscaping, and to implement a program of constant removal of exotic vegetation within our community. We are not aware of any outstanding developer commitments or responsibilities with respect to our subdivision, or the Lely Resort P{ID. II ~ III ii, 111-1 8 o 2' g I=: 0""': ,.: ....;; :r:. i ~ o o ~ c;l I " I I I I, II I 1 I t:; W 3 '" ~ -' < ~ o ;- Agenda Item No. 16A6 June 10, 2008 Page 8 of 9 RESOLUTION NO. 08-_ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AUTHORIZING FINAL ACCEPTANCE OF CERTAIN ROADWAY AND DRAINAGE IMPROVEMENTS IN MASTERS RESERVE, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 38, PAGES 3S THROUGH 40; RELEASE OF THE MAINTENANCE SECURITY; AND ACCEPTANCE OF THE MAINTENANCE RESPONSIBILITY FOR THE ROADWAY AND DRAINAGE IMPROVEMENTS THAT ARE NOT REQUIRED TO BE MAINTAINED BY THE MASTERS RESERVE HOMEOWNERS' ASSOCIATION, INC. , WHEREAS, the Board of County Commissioners of Collier County, Florida, on September 11, 2001 approved the plat of Masters Reserve for recording; and WHEREAS, the Developer has constructed and maintained the roadway and drainage improvements in accordance with the approved plans and specifications as required by the Land Development Code (Collier County Ordinance No. 04.41, as amended); and WHEREAS, the Developer is requesting final acceptance of the roadway and drainage improvements and release of his maintenance security; and WHEREAS, the Engineering and Environmental Services Section of the Community Development Department has inspected the roadway and drainage improvements, and is recommending acceptance of said facilities. NOW, THEREFORE, IJE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORJDA. that final acceptance is hereby granted for those roadway and drainage improvements in Masters Reserve, pursuant to the plat thcreof recorded in Pial Book 38, pages 35 through 40, and the Clerk is hereby authorized to release the maintenance security. BE IT FURTHER RESOLVED AND ORDERED that the County accept the future maintenance and other attendant costs for those roadway and drainage improvements that are not required to be maintained by the Ma..<;tcrs Reserve Homeowners' Association, Inc.
